113 <br /> <br /> Mr. Buck recommended deferring the second reading of the <br />ordinance until Ms. Jensen, the Traffic Engineer, and the <br />City Manager could further discuss the situation~ <br /> <br />ORDINANCE: CLOSING AN ALLEY FROM BRANDON AVENUE TO MONROE LANE <br /> <br /> Mr. Buck stated that he would abstain due to a conflict <br />of interest. <br /> <br /> Mr. Hendrix stated that a letter had been received from <br />the University of Virginia opposing the closing because of <br />its use as a pedestria5 walkway. Mr.. Hendrix stated that the <br />viewers had also commeSted that the pedestrian walkway be <br />maintained. Mr. Hendrix added that ~he alley has been <br />partially closed apparently illegally. <br /> <br /> Mr. Jim Grigg, owner of the property on both sides of <br />the alley, stated that changes had been made in the alley <br />with approval by the Community Development staff. Mr. Grigg <br />stated that his plan is to convert the property on Brandon <br />Avenue into condomiuns and to remove the building on Monroe <br />Lane and rebuild. Mr. Grigg indicated his willingness to make <br />improvements to and maintain a pedestrian walkway in the alley. <br /> <br /> Mr. Huja recommended that permanent access to an apartment <br />building off the alley also be maintained. <br /> <br /> It was decided that the ordinance should be rewritten for <br />the next meeting. <br /> <br />ORDINANCE: RBZONING PROPERTY ON EAST SIDE OF STH STREET, S.W. <br />SOUTH OF WILLOUGHBY SUBDIVISION FROM R-2 TO B-3 <br /> <br /> Mr. Huja stated that the Planning Commission had been <br />concerned with how the property related to the flood plain. <br />Mr. Huja listed t'he following reasons for the Planning <br />Commission's recommendation to approve the rezoning: 1) The <br />property is located at a transitional area between commercial <br />land and residential land in the Land Use Plan, 2) The property <br />is located south of required open space as part of the Willoughby <br />Subdivision PUD which guarantees proper buffering for that <br />development, 3) The proposed conceptual plan minimizes the <br />impact on the 100 Year Flood Plain and includes a deed restriction <br />to further prevent encroachment into the 100 Year Flood Plain <br />on the applicant's property in the county, 4) The conceptual <br />plan provides that only two curb cuts will be proposed along <br />the 5th Street frontage, and 5) The conceptual plan provides <br />sufficient frontage landscaping to meet the objectives of our <br />site plan development standards and our Comprehensive.Plan. <br /> <br /> Mr. Huja added that the owner of the property had agreed <br />to having only one access into the property. <br /> <br /> Mr. Buck questioned whether the single access could be <br />required in the site plan approval. <br /> <br /> Mr. Huja responded that he felt the single entrance could <br />be required as a safety factor. <br /> <br /> Mr. Murray, representing the owner, stated that as a <br />practical matter the grade would make additional accesses to <br />the property very unlikely. <br /> <br /> On motion by Dr. Gunter, seconded by Dr. Hall, the <br />ordinance entitled "AN ORDINANCE AMENDING AND REENACTING THE <br />DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING <br />ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY THE REZONING OF PROPERTY LOCATED AT FIFTH STREET, <br />S.W." was offered and carried over to the. next meeting for <br />consideration. <br /> <br />PUBLIC <br /> <br />There were no matters by the public. <br /> <br /> <br />
