174 <br /> <br />the arbitrary, ill-advised nature by which it seeks to <br />reduce the federal deficit; and <br /> <br /> BE IT FURTHER RESOLVED that the City Council of <br />Charlottesville, Virginia calls upon the Congress of the <br />United States to return to a proper budgetary policy of <br />needs and effects analysis and to make, rather than~evade, the <br />admittedly difficult decisions that such fair and responsible <br />budgeting entails. <br /> <br />RESOLUTION: <br />REMOVAL <br /> <br />AUTHORIZING RETENTION OF ATTORNEY FOR ASBESTOS <br /> <br /> Mr. Roger Wiley, City Attorney, stated that hiring <br />the local firm of Michie, Hamlett, Donato and Lowry' to <br />recover the costs of removing asbestos on City property <br />had previously been discussed and at that time Mr. Barnes <br />had suggested dealing directly with the South Carolina <br />law firm that has been active in the asbestos claim cases. <br />Mr. Wiley stated that it was the South Carolina law firm's <br />preference that the City retain the local firm. <br /> <br /> On motion by 'Mr. Barnes, seconded by Dr. Gunter, the <br />City Attorney was unanimously authorized to retain the law <br />firm of Michie, Hamlett, Donato and'Lowry fo~ the asbestos <br />removal claim. <br /> <br />ORDINANCE: UNLAWFUL PLACEMENT OF REFUSE INTO THE CITY (2nd reading) <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND <br />REORDAIN ARTICLE II OF CHAPTER 23 OF THE CODE OF THE CITY <br />OF CHARLOTTESVILLE, 1976, AS AMENDED, BY ADDING A NEW <br />SECTION NUMBERED 23-6.1, PROHIBITING BRINGING GARBAGE <br />OR REFUSE INTO THE CITY AND DEPOSITING IT FOR COLLECTION, <br />AND PRESCRIBING THE PENALTY THEREFOR" which was offered <br />at the January 1st meeting, was approved by the following <br />vote. Ayes: Mr. Barnes, Mr. Buck, Mrs. Gleason, Dr. <br />Gunter. Noes: None. Absent: Dr. Hall. <br /> <br />ORDINANCE: PARK CURFEWS <br /> <br /> Mr. Hendrix stated that it was staff's recommendation <br />to have more restrictive curfews in the parks in order <br />to help the police curb vandalism and apprehend trespassers. <br /> <br /> Mr. Buck questioned why the curfew had been extended <br />an hour in Tonsler Park. <br /> <br /> Mr. German responded that the basketball courts are <br />lighted and are heavily used. <br /> <br /> Mr. Buck noted concern that the curfew for the parking <br />lot next to Crow Recreation Center was 9:00 p.m. when some <br />of the programs in the Center did not end until 9:00 and <br />since the adjoining parking lot did not have a curfew. Mr. <br />Buck requested that staff discuss this situation before the <br />next meeting as he felt the curfew in that area had the <br />potential to be arbitrarily applied. <br /> <br /> Mr. Hendrix stated that he was meeting with the <br />presidents of the neighborhood associations and would <br />discuss the-specific curfews with them. <br /> <br /> On motion by Mr. Barnes, seconded by Mrs. Gleason, <br />the ordinance entitled "AN ORDINANCE TO AMEND CHAPTER VI <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, <br />BY THE ADDITION OF A SECTION NUMBERED 6-12, AND FURTHER TO <br />AMEND SECTION 18-3 OF SUCH CODE, THE ADDED AND AMENDED <br />SECTIONS RELATING TO CLOSING HOURS FOR CITY CEMETARIES, <br />PARKS AND CERTAIN RECREATIONAL FACILITIES" was offered and <br />carried over to the next meeting for consideration. <br /> <br /> <br />
