AN ORDINANCE AMENDING AND REENACTING SECTIONS 1, <br />2, 3, 5, 7 AND 8 AND REPEALING SECTION 4 AND 6 <br />OF CHAPTER 12 OF THE CODE OF THE CITY OF CHAR- <br />LOTTESVILLE,, <br />HAR- <br />LOTTESVILLE, 1959, ENTITLED "FIRE DEPARTMENT" <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT SECTIONS 4 AND 6 OF CHAPTER 12 <br />BE REPEALED, AND SECTIONS 1, 2, 3, 5, 7 AND 8 OF CHAPTER 12 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1959, ENTITLED "FIRE DEPARTMENT" BE AND THE SAME ARE HEREBY AMENDED AND REENACTED TO READ AS FOLLOWS: <br />ARTICLE 1. FIRE DEPARTMENT <br />SEC. 12-1. COMPOSITION; DIRECTION AND CONTROL. <br />THE FIRE DEPARTMENT OF THE CITY SHALL BE COMPOSED OF A VOLUNTEER ORGANIZATION KNOWN AS THE <br />"CHARLOTTESVILLE FIRE COMPANY" AND SUCH PERSONS AS MAY BE EMPLOYED BY THE CITY MANAGER FOR THE DEPART- <br />MENT. SUCH DEPARTMENT SO ORGANIZED SHALL BE UNDER THE DIRECTION AND CONTROL OF AN OFFICER TO BE STYLED <br />THE CHIEF OF THE FIRE DEPARTMENT, AND ONE ASSISTANT CHIEF, ELECTED BY THE COMPANY, AND A SUPERINTENDENT <br />APPOINTED BY THE CITY MANAGER; ALL OF WHOM SHALL BE SUBJECT TO THE CONTROL AND DIRECTION OF THE CITY <br />MANAGER. <br />SEC. 12-2. ELECTION OF OFFICERS BY FIRE COMPANY; CONFIRMATION BY COUNCIL. • <br />ALL VOLUNTEER OFFICERS, AS THE FIRE COMPANY MAY DEEM NECESSARY, SHALL BE ELECTED BY THE COMPANY <br />AT ITS REGULAR MEETING IN AUGUST OF EACH YEAR, OR AS SOON THEREAFTER AS PRACTICABLE, AND THEIR TERM OF <br />OFFICE SHALL COMMENCE ON THE FIRST DAY OF SEPTEMBER NEXT FOLLOWING. THE NAMES OF THE OFFICERS THUS <br />CHOSEN BY THE COMPANY SHALL BE PRESENTED TO THE COUNCIL AT ITS NEXT REGULAR MEETING FOR CONFIRMATION. <br />IN CASE THE COUNCIL REFUSES TO CONFIRM SUCH OFFICERS, THE COMPANY SHALL FORTHWITH ELECT OTHER PERSONS <br />IN PLACE OF THOSE WHOM THE COUNCIL REFUSED TO CONFIRM AND SUBMIT THEIR NAMES TO THE COUNCIL AT ITS NEXT <br />REGULAR MEETING FOR CONFIRMATION. <br />SEC. 12-3. POWERS AND DUTIES OF THE CHIEF AND SUPERINTENDENT. <br />THE CHIEF, OR IN HIS ABSENCE THE SUPERINTENDENT, OR IN THE ABSENCE OF BOTH, THE NEXT RANKING <br />VOLUNTEER OFFICER, SHALL BE IN FULL AUTHORITY AND HAVE COMPLETE SUPERVISION OF ALL EQUIPMENT AND <br />PERSONNEL IN ATTENDANCE AT A FIRE. THE SUPERINTENDENT SHALL AT ALL TIMES, EXCEPT AS PROVIDED ABOVE, <br />HAVE FULL SUPERVISION OVER ALL PAID PERSONNEL. <br />IT SHALL BE THE DUTY OF THE SUPERINTENDENT TO KEEP A RECORD OF ALL FIRES, THEIR PLACE AND TIME <br />OF OCCURENCE, AND SHALL ASCERTAIN IF POSSIBLE, THE AMOUNT OF INSURANCE, IF ANY, AND ACTUAL LOSS AND <br />MAKE REPORT THEREOF TO THE CITY MANAGER FOR EACH MONTH BY THE TENTH OF THE NEXT MONTH. THIS MONTHLY <br />REPORT SHALL, IN ADDITION, SHOW THE GENERAL CONDITION OF THE DEPARTMENT, TOGETHER WITH AN INVENTORY <br />OF ALL APPARATUS AND EQUIPMENT AND THE CONDITION AND ESTIMATED VALUE THEREOF AND SUCH OTHER INFORMATION <br />AS THE SUPERINTENDENT MAY DEEM PROPER OR AS THE CITY MANAGER MAY REQUIRE. HE SHALL ALSO MAKE SUCH <br />REPORTS TO THE STATE COMMISSIONER OF INSURANCE AS MAY BE REQUIRED OF HIM BY STATE LAW. THE SUPERINTENDENT <br />SHALL DELIVER TO HIS SUCCESSOR IN OFFICE ALL RECORDS PERTAINING TO THE FIRE DEPARTMENT WHICH MAY BE IN • <br />HIS CONTROL. <br />THE CHIEF AND THE SUPERINTENDENT OF THE FIRE DEPARTMENT SHALL HAVE CHARGE OF THE FIREHOUSE AND <br />APPARATUS, AND IT SHALL BE THEIR DUTY TO SEE THAT THE APPARATUS IS KEPT IN GOOD CONDITION AND READY AT <br />ANY AND ALL TIMES TO RESPOND TO A CALL, AND PROPERLY CARED FOR AT AND AFTER RETURNING FROM A FIRE, THAT <br />THE HOSE IS PROPERLY DRIED OUT, THAT THE HOUSE IS PROPERLY CARED FOR, AND PERFORM SUCH OTHER DUTIES AS <br />MAY BE NECESSARY TO KEEP THE FIREHOUSE AND APPARATUS IN GOOD CONDITION. <br />SEC. 12-5. ELIGIBILITY AND OATH OF CHIEF AND ASSISTANT. <br />NO PERSON SHALL BE ELIGIBLE TO THE OFFICE OF CHIEF WHO SHALL NOT HAVE BEEN AN ACTIVE MEMBER OF THE <br />FIRE DEPARTMENT FOR THREE YEARS. NO PERSON SHALL BE ELIGIBLE TO THE OFFICE OF ASSISTANT CHIEF WHO SHALL <br />NOT HAVE BEEN AN ACTIVE MEMBER OF THE FIRE DEPARTMENT FOR AT LEAST ONE YEAR. THE CHIEF OF THE FIRE <br />DEPARTMENT AND <br />THE ASSISTANT CHIEF <br />SHALL, <br />BEFORE ENTERING UPON THE DISCHARGE <br />OF THEIR DUTIES AS SUCH, <br />TAKE AN OATH AS <br />PRESCRIBED FOR ALL <br />OTHER <br />OFFICERS, TO FAITHFULLY PERFORM THE <br />DUTIES OF THE OFFICE TO <br />• <br />WHICH THEY HAVE <br />BEEN ELECTED AND TO <br />CARRY <br />OUT AND PERFORM SUCH DUTIES AS MAY <br />BE REQUIRED BY THE CITY <br />MANAGER OR THE COUNCIL. <br />
