74 <br />has a clear title, upon the certificate of the Treasurer that the <br />purchase money for said section has been fully paid. To such <br />deed the Mayor shall attach the seal of the city, however, that in <br />any such deed it shall be expressly set out that the section thereby <br />conveyed shall be used for the interment of white persons only, <br />and that its management and contrcl shall be subject to any laws, <br />ordinances or resolutions passed or thereafter passed, by the City <br />Council for the management, government or improvement of the <br />cemetery in which the section is located, or for the management, <br />government or improvement of the sections in said cemeteries. <br />See. 398. To whom lots shall be sold. <br />All the sections in Maplewood and Oak Hill cemeteries shall be <br />used exclusively for the burial or interment of white persons; <br />except that part in Oak Hill cemetery which has been set apart <br />for colored persons. <br />Sec. $99. Burial of paupers. <br />The Committee on Cemeteries shall designate such portion of <br />Oak Hill Cemetery as may be necessary for the interment or <br />burial of paupers. <br />Sec. 400. Charges for keeping sections in order. <br />Every owner of a section or part of a section in any cemetery <br />of the city shall pay annually to the keeper on the 1st day of <br />July the following fees, viz: For a full section, five dollars; half <br />section, three dollars and fifty cents; and quarter section, two <br />dollars, which amounts shall be placed to the credit of the <br />cemetery fund, to be expended only for keeping said sections in <br />good condition. <br />Sec. 401. Record of burials, permit, etc. <br />The keeper shall keep a record of each cemetery showing the <br />name, division, block, section, grave and date of interment of <br />every person buried in said cemeteries, and no interment shall be <br />made without a permit from the Board of Health. <br />Sec. 402. Fees for digging graves. <br />For digging a grave for a person fourteen years of age and <br />over the fee shall be five dollars; and for graves for persons under <br />CHAPTER XXV. <br />WATER AND SEWER DEPAl1TMgNT. <br />See. 407. General control and government—by com- <br />mittee. <br />The standing Committee of the Council on Water and Sewers <br />shall have control and general government of the city's water <br />works and sewer system; shall authorize the employment of all <br />help and regulate their wages; the purchase of tools, implements <br />and other supplies, as may be necessary for carrying on the work <br />in this department, in accordance with section 12 of these ordi- <br />nances. They shall prescribe what mains and service pipes shall <br />be laid, what extensions and repairs are to be made, what taps <br />are to be made to mains and location of same. <br />Sec. 408. Annual reports—when and how made. <br />The committee shall at the regular meeting of the Council in <br />September of each year make a report and account for the pre- <br />ceding year, showing the following: <br />a. Amount expended in construction, extension and permanent <br />improvement; <br />b. Amount expended for salaries, labor, coal, pipe, fittings and <br />other items of current expense. <br />c. Amount of annual interest on the bonded indebtedness of <br />these departments. <br />d. Amount of receipts from sale of water and other sources. <br />e. Amount of water used for municipal and other purposes, its <br />value to be based on the lowest prevailing rate. <br />f. An inventory of all tools, pipe, fittings and other supplies, <br />stating their condition and value. <br />g. Also to impart to the Council such information in relation to <br />these departments as they may deem important. <br />Sec. 409. Superintendent—his election, term of office <br />and compensation. <br />There shall be elected by the Council at the time and in the <br />fourteen years of age the fee shall be three dollars which fees shau <br />be paid in advance unless guaranteed by some responsible person <br />and every grave shall be not less than five feet in depth. No <br />interment shall be made which shall disturb the remains of the <br />dead, or which shall displace or injure any monument or stone <br />placed over a grave. <br />Sec. 403. Trespass, etc. <br />For breaking, injuring, or destroying any monument, gravestone <br />or mark, shrub, plant or tree in the cemeteries, or any property <br />appertaining thereto, or for trespassing in any manner on the <br />grounds, the person or persons so offending shall be fined not <br />less than $2 nor more than $20, and said fine shall be placed to <br />the credit of the cemetery fund. <br />Sec. 404. Financial reports, etc. <br />The keeper shall keep an account of all money received by hint <br />for burial assessments, or sale of lots and keeping sections is <br />order and shall pay over the same to the Treasurer weekly; and <br />he shall keep an account of money expended for labor or other <br />expenses of the cemeteries and make weekly reports to the coni <br />mittee. He shall give bond with security for the faithful per. <br />formance of his duties. <br />Sec. 405. Quarterly reports to be made by chairman of <br />committee. <br />The chairman of the Committee on Cemeteries shall make a <br />report to the Council quarterly, showing the receipts and expen& <br />tures for the cemeteries of the city and such other matters as they <br />may deem necessary. <br />Seo. 406. River View Cemetery. <br />The corporation known as the "River View Cemetery Company" <br />is hereby empowered to carry out the powers granted it by the <br />charter of said company, so long as the same are exercised in due <br />accordance therewith. <br />manner prescribed for the election of other officers by the Council <br />a Superintendent for the Water and Sewer Department of the <br />city whose term of office shall be for two years (except in cases <br />of vacancy) and until his successor is elected and qualified— <br />unless sooner removed for cause, as provided for in these ordi- <br />nances—and before entering upon the duties of his office shall <br />give bond payable to the city of Charlottesville, with approved <br />security, conditioned in accordance to law for the faithful <br />performance of his duties, in amount specified in section 44. > Or <br />services rendered he shall be paid in monthly installments such <br />salary as may be fixed by the Council. <br />Boo. Same—duties and powers. <br />The Superintendent, subject to the control of the commIdOl <br />shall have charge of all the property pertaining to the water and <br />sewer system and all fixtures and pipes connected therewith. l;e <br />shall carefully inspect all parts of the water works and sewer <br />system and have the same kept in good order, and in proper <br />operation, and the water furnished as pure and clear as practi' <br />cable, with promptness and regularity, to the city and to all per' <br />sons entitled to its use under the provisions hereinafter contained. <br />Sec. 411. Same—employment and control of help. <br />Subject to the consent of the committee, the Superintendent mal' <br />employ such help as may be necessary for carrying on the work <br />in this department, in all its details, in an economical and satin• <br />factory manner, and over all such employees he shall haVe ab• <br />solute control. He shall pay the employees such wages as are <br />usual and necessary in the opinion of the committee; batt the pay <br />of no employee shall at any time be increased by the cornmitt' <br />in an amount exceeding $100 per annum without first having ob• <br />tained authority therefor from the City Council in due forin- <br />Sec. 412.
