Said bonds shall be issued under the authority of section 127 of the <br /> <br />Constitution of Virginia and section 3082 of the Code of Virginia of 1919 as amended and _ <br /> <br />bonds shall not be included in determining the limitation of the power of the City <br /> <br />to incur indebtedness as provided in the first paragraph of section 127 of the Constitu- <br /> <br />tion because said bonds herein provided for come within the exception provided in sub- <br /> <br />section B of section 127 of the Constitution as they are to be approved by an <br /> <br />affirmative vote of the majority of all qualified voters of the City of Charlottes - <br /> <br />Ville, voting upon the question of their iUsuance at tho general election next succeeding _ <br /> <br />enactment of this Ordinance and are for the propose of supplying water from which the <br /> <br />City will derive a revenue sufficient to pay for the cost of opert:tion and adminis- <br /> <br />tration of maintaining the water supply including interest on the bonds and the cost of <br /> <br />_ against loss by injury to persons and property and an annual amount to be <br /> <br />covered and paid into a sinking fund sufficient to pay at or before maturity all bonds <br /> <br />issued on account of said undertaking including those now outstanding as well as those to <br /> <br />be issued in this series. <br /> <br />5. The City Council fixes five years from the date of the election hereinafter <br /> <br />provided for determining whether or not the revenue from such undertaking is sufficient <br /> <br />to pay for the cost of operation and administration including interest on bonds issued <br /> <br />therefor and the cost of insurance against loss by injury to persons or property and <br /> <br />an annual amount to be covered and paid into a sinking fund sufficient to pay at or <br /> <br />before maturity all bonds issued on account of said undertaking including those now <br /> <br />outstanding as well as those to be issued, hereunder. <br /> <br />6.That said bonds and the coupons shall be payable at the Office of the <br /> <br />Treasurer of the City of Charlottesville Virginiu and at such other place or places as <br /> <br />the Council may designate. <br /> <br />7. That after this bond issue has been authorized by a vote of the people the <br /> <br />Finance Committee of the Council shall prepare and dispose of said issue in its entirety <br /> <br />at one sale or in such installments as may be deemed desirable by said Committee. <br /> <br />Any sale of said bonds shall be subject to ratification of tine Council. <br /> <br />Be That it is hereby orddred thiit an election by held on the 6th day of November <br /> <br />1923 at which qualified voters may vote for or against the said issue of the bonds. The <br /> <br />ballot in said election shall provide: For $500,000.00 for improving and increasing the Water <br /> <br />Supply. <br /> <br />Against $500,000.00 for Imoroving and Increasing the Water Supply. <br /> <br />Said voters desilcing to vote for said bond issue shell draw a line through <br /> <br />"Against $500,000.00 for Improving and Increasing the Water Supply" and those desiring <br /> <br />to vote against said issue shall draw a line through "For $500,000.00 for Improving and <br /> <br />Increasing the Water supply," said election to be held in accordance with section 24 <br /> <br />of the Charter of the City of Charlottesville and the Laws Virginia regarding elections <br /> <br />by the people. <br /> <br />The the Mayor of said City be and he is hereby authorized and directed to give the _ <br /> <br />quired notice by publication in a newspaper published in the City of Charlottesville for <br /> <br />four sucessive weeks before said election and that a copy of said notice be recorded in <br /> <br />the book kept for that purpose. <br /> <br />Adopted by Council October 1, 1923. <br />Ayes, Brown, Morris & Joachim, Noes None. <br /> <br />Clerk Signature. <br />President Signature. <br />
