<br />For all violation of this section, the owner shall be fined not less than one
<br />dollar nor more than five dollars, for each offense, and a ch day that said poles sha1l re-
<br />main unpainted, unbranded or unstenciled after written notice thereof shall constitute
<br />a separate offense.
<br />Sec. 37. Electrical construction in streets.
<br />No electrical conductors, wires, conduits, poles, lamps or other electrical
<br />devices of fixtures, shall be constructed, erected strung, laid, maintained, changed or altered
<br />above, below or in any street, avenue, park or public place in any part of the City of
<br />Charlottesville, nor shall any extension of the electrical conductors either overhead or
<br />underground be made, without *he written consent of the City Electrician, Provided that for
<br />any work contemplated which will require and disturbance of the streets or excavaions in
<br />them, or the placing of any obstruction in said streets, such permit from the City electri.
<br />cian shall be approved by the City Ivianager.
<br />An provided that in every case of refusal of a permit by the City Electrician,
<br />ghe person, firm or corporation that has been refused such per it may make a plication to the C
<br />City Manager for said permit, whose decision shall be final.
<br />Any person, firm or corporation making said alterations or excavations, or
<br />doing said electical construction, or erecting said poles, without a permit from either
<br />the City El ctrician of the City 1vlanager, shall be fined not less than one dollar nor
<br />more than five dollarX3 for each offense.
<br />Seo. 38, How City wires located.
<br />The uppermost zone on every pole shall at all times be reserved for the free
<br />use of the City in stringing its fire alarms or police telegraph :vires; and no person,
<br />firm or corporation shall run any wire above said city wires, or within less than twenty-
<br />two inches of hem or cross over them, but whenever it becomes necessary to move the :.yid
<br />City wires for any reason the person, firm or corporation for whose benefit they are moved
<br />shall, at ehe expense ofsuch person, firm or corporation, provide for them a place above
<br />all the o'.her wires at least twenty six inches from them, and shall notify the City
<br />Electrician who shall supervise and direct themoving of said City wires, so that they shall
<br />at all times occupy said uppermost zone. Any person, f6rm or corporation running its wires
<br />In less thantwenty-two inches )f the said city wires, or moving of said city wires except
<br />under the supervision of the City Electbioian, or wifueing or failing to move its own
<br />wires when placed or strung in vilation of this section, shall be fined not less than
<br />five dollars nor more than tend dollars dor each offense, and each day that said wires
<br />small remain placed or strung in violation of this section, after receiving notice to
<br />move them, shall be deemed a separate offense.
<br />Sec. 64. Chimneys and fireplaces.
<br />(a) Except as herein provided all chimneys in evepy building hereafter erected
<br />and all chimneys hereafter altered or rebuilt, shall be constructed of brick, stone, or re-
<br />inforced concrete. No masonry chimney shall have walls less than eight (8) inches thick
<br />unless it be lined on the inside with well -burned terra cotta or fire clay chimney tile set
<br />in Portland Cement mortar, in which case the wall siall be not less than four (4) tnches
<br />thick. The lining shall be continuous from the bottom of the flue to its extreme height.
<br />(b) No chimney shall be corbeled out more than eight (8) inches from a brick
<br />wall, and such corbeling shall consist of at least five courses of brick.
<br />(c) Brick set on edge shall not be permitted in chimney construction. All
<br />Chimneys shall be capped with terra cotta, brick, stone concrete or cast iron.
