<br />to said Civil and Police Justice a trial fee of fifty cents for
<br />one hundred dollars of value or fraction thereof, claimed in such
<br />warrant. The trial fee shall be taxed as part of the costs.
<br />The Civil and Police Justice shall cause to be kept a record of
<br />all fines, forfeitures, fees and costs imposed, arising or collected
<br />in the administration of his office, and shall cause to be reported
<br />and paid by the Clerk of his Court to the City Collector daily,
<br />all trial fees and civil costs except that all fines collected for con-
<br />victions under the State law shall be reported and paid to the
<br />Clerk of the Corporation Court, as provided for by State law.
<br />Sec. 203. Civil and police justice—use and collection of
<br />fines.
<br />All fines imposed under any ordinance of the City shall be for
<br />the use of the City. When imposed the offender may be com-
<br />mitted and the fines may be collected by execution directed to
<br />the Chief of Police or Constable of the City, and returnable in
<br />fifteen days before the Civil and Police Justice. The officer levy-
<br />ing shall sell the article levied on for cash, on the City Hall lot,
<br />or at such other place in the City as the officer levying may de-
<br />sire, after five days notice posted at the door of the Court of the
<br />Civil and Police Justice.
<br />Sec. 204. Civil and police justice—failure to pay fine—
<br />imprisonment.
<br />Any one against whom a fine is adjudged may be confined in
<br />jail by the order of the Civil and Police Justice, until such fine
<br />and the costs are paid; provided, that no term of imprisonment
<br />for the non-payment of a fine and costs shall exceed ninety days.
<br />Sec. 205. Substitute civil and police justice.
<br />A substitute Civil and Police Justice shall be appointed as pro-
<br />vided by State law. Such substitute Civil and Police Justice
<br />shall have such powers, perform such duties, and receive such
<br />compensation as provided by the State law.
<br />Sec. 206. Court room, office, books, stationery.
<br />The Civil and Police Justice shall use the room on the first
<br />floor at the South end of the City Hall as a Courtroom.
<br />The City Manager is directed to furnish the Civil and Police

<br />Justice, at the expense of the City, with an office, all necessary
<br />furniture, books, and stationery. Such books shall be under the
<br />control of the Civil and Police Justice and shall remain the prop-
<br />erty of the City.
<br />Sec. 207. Bailiff and clerk of civil and police justice
<br />court.
<br />The Civil and Police Justice shall appoint a Bailiff, who shall
<br />also be Clerk of his Court. The Bailiff and Clerk shall attend
<br />all courts held by the Civil and Police Justice, receive all fees
<br />and fines imposed and report and pay same daily to the City Col-
<br />lector and shall perform such other duties as may be required of
<br />him by the Civil and Police Justice, by the State law, and by the
<br />Council. He shall be paid such monthly salary as has been or
<br />may hereafter be fixed by the Council and shall give such bond
<br />as is prescribed by section 41.

<br />CHAPTER XXI.
<br />POLICE FORCE.
<br />Sec. 208. Election and term.
<br />The Council shall elect, in the same manner as other officers
<br />of the City are elected, a Chief of Police, a First Lieutenant, a
<br />Second Lieutenant, a Detective Sergeant, two Desk Sergeants,
<br />three Mounted Policemen and as many Patrolmen and substitute
<br />Patrolmen as may be deemed necessary, who shall hold office at
<br />the will of the Council.
<br />Sec. 209. Control of the mayor.
<br />The police force shall be under the control of the Mayor for
<br />the purpose of enforcing peace and order, and for the execution
<br />of the laws of the State and ordinances of the City, and the per-
<br />formance of such other duties as the Council may prescribe.
<br />Sec. 210. Police powers—oath of office.
<br />A policeman shall have all the powers of any conservator of
<br />the peace, and of a constable in criminal cases, and all other pow-
<br />ers, which, under the laws of the City, may enable him to dis-
<br />charge the duties of his office. Every policeman, before enter-
<br />ing upon the discharge of his duties as such, shall take the oath
<br />of office prescribed by the laws of the State, a certificate of which
<br />shall be filed with the Chief of Police.
<br />Sec. 211. Appointments to fill vacancies, and special po-
<br />licemen.
<br />The Mayor may, in cases of emergency, appoint as many spe-
<br />cial policemen as the public safety may require, and may appoint
<br />policemen to fill such vacancies as may occur. He shall report
<br />such appointments to the Council at its next regular meeting for
<br />approval or disapproval.
<br />All appointments will be made subject to physical examination
<br />and examination as to knowledge of the laws, ordinances and
<br />regulations.

<br />The examination as to laws, ordinances and regulations will
<br />be made by the Chief of Police.
<br />The physical examination is to be made by the City Health
<br />Officer, or in his absence by such other physician as the Mayor
<br />may direct.
<br />Sec. 212. Police furlough.
<br />The members of the regular police force, who have been mem-
<br />bers of the force for twelve (12) months shall be allowed an an-
<br />nual furlough of ten days with pay, the time of granting such fur-
<br />lough to be arranged by the Chief of Police in connection with
<br />the Mayor so that the public interest is subserved.
<br />Sec. 213. Chief of police—his duties.
<br />The Chief of Police is the chief executive of the police depart-
<br />ment but he shall always be subject to the orders and regulations
<br />of the Mayor and Council. He shall be under the control of the
<br />Mayor and Council for the purpose of enforcing peace and or-
<br />der, and executing the laws of the State and ordinances of the
<br />City and it shall be the duty of the police force to respect and
<br />obey orders of the Chief not in conflict with these rules and reg-
<br />ulations. It shall be his duty at all times, day or night, to pre-
<br />serve the public peace; prevent the commission of crimes, and
<br />arrest offenders; to protect the rights of persons and of prop-
<br />erty; to regard the public health; to report nuisances in the
<br />streets, alleys and other places; to provide proper police force at
<br />fires; to protect the firemen and property thereat; to discharge
<br />such other duties as may be required of him by the Council.
<br />When charges are filed in his office against any member of the
<br />police force, or when he shall be informed of any gross neglect
<br />of duty, he shall immediately transmit the same to the Mayor,
<br />together with the names of the witnesses to be subpoenaed, that
<br />the charges may be investigated by Council.
<br />He shall be responsible for the good order of the City, and for
<br />the general good conduct of the men and officers of the police
<br />force. It is enjoined on him to pay frequent visits at uncertain
<br />hours, to various portions of the City, and thus be able to super-
<br />vise the conduct of all subordinates.
<br />He shall cause to be served all processes directed to him by a
<br />
