<br />Sec. 490(30). Encumbering estate to evade any provi-
<br />sions of this section.
<br />Any person who shall transfer, alienate or encumber in any
<br />manner, his estate, real or personal, with the intent to evade any
<br />provisions of this section, and all persons aiding and abetting in
<br />such evasions, shall be deemed guilty of a misdemeanor and
<br />punished as provided in subsection (6) of this section.
<br />Sec. 490 (31) . Unlawful to grind or transport malt, etc.
<br />—burden of proof.
<br />It shall be unlawful for any person to grind, or transport malt
<br />in this City or any substitute for the same by whatever name it
<br />may be called to be used in the manufacture of ardent spirits
<br />and the burden of proof shall be upon any person grinding or
<br />transporting malt to show that such malt is not to be used in vio-
<br />lation of this section.
<br />Sec. 490(32). Incriminating testimony no excuse for
<br />not testifying—prescribing certain rules of evidence
<br />—proof of general reputation of defendant for vio-
<br />lation of prohibition laws admissible.
<br />No person shall be excused from testifying for the City as
<br />to any offense committed by another under this section by rea-
<br />son of his testimony tending to incriminate himself, but the testi-
<br />mony given by such person on behalf of the City shall in no case
<br />he used against him nor shall he be prosecuted as to the offense
<br />as to which he testified.
<br />It shall be competent in a prosecution for any offense against
<br />this section to prove the general reputation of the defendant as
<br />a violator of the prohibition laws.
<br />Sec. 490 (33) . Possession of deadly weapons by per-
<br />sons unlawfully engaged in manufacturing, trans-
<br />porting, or selling ardent spirits.
<br />If any person shall unlawfully manufacture, transport, or sell
<br />any ardent spirits, as herein defined, and at the :time of such
<br />manufacturing, transporting, or selling or aiding or assisting in
<br />any manner in such act, shall carry on or about his person, or
<br />have on or in any vehicle which he may be using to aid him in

<br />any such purpose, or have in his possession, actual or construc-
<br />tive, at or within one hundred yards of any place where any such
<br />intoxicating liquor is being unlawfully manufactured, transported
<br />or sold, any firearm, dirk, bowie -knife, razor, slung -shot, metal
<br />knucks or any weapons of like kind, upon conviction he shall be
<br />confined in jail not more than one year, nor less than thirtv
<br />days.
<br />All persons manufacturing, transporting, or selling, or aid-
<br />ing or abetting in such act, with knowledge of the possession
<br />by any one or more of their number of the deadly weapons as
<br />above set forth shall be deemed principals to the crime and pun-
<br />ished as such.
<br />Any such firearms, dirk, bowie -knife, razor, slung -shot, metal
<br />knucks or any weapons of like kind shall be confiscated as now
<br />provided by law.
<br />Sec. 490 (34) . When officer may break and enter houses.
<br />If in any house, building, boat, car, or other place, as is here-
<br />inbefore mentioned, the sale, offering, storing or exposing for
<br />sale of ardent spirits is carried on clandestinely, or in such man-
<br />ner that the person or persons engaged therein cannot be seen or
<br />identified by the officer or officers charged with the execution of
<br />a warrant, under any section of this act, any such officer may,
<br />whenever it is necessary for the arrest or identification of the
<br />person or persons offending, or of seizing such ardent spirits,
<br />break open and enter such house, building, boat, car or place, or
<br />any room or part of any of them.

<br />CHAPTER XXXIX.
<br />PLUMBING, SEWERS AND DRAINAGE.
<br />Sec. 491 (1) . Plumbing installation—general.
<br />All installations of plumbing and drainage in every building
<br />shall be made in accordance with the most approved methods of
<br />sanitary plumbing installation with due regard to public health.
<br />The United States Department of Commerce publication "Rec-
<br />ommended Minimum Requirements for Plumbing" shall be
<br />considered as standard for general plumbing installations on all
<br />work unless otherwise specified in this Chapter.
<br />Sec. 491 (2) . Plumbing inspector — appointment —
<br />term—salary.
<br />A plumbing inspector shall be appointed by the City Manager
<br />subject to the approval of the Council. He shall hold office at the
<br />will of the City Manager and shall receive such compensation
<br />as the Council, on the recommendation of the City Manager,
<br />may fix.
<br />Sec. 491 (3) . Plumbing inspector—duties.
<br />The Plumbing Inspector shall be charged with the duties of
<br />enforcing the plumbing laws of the City. He shall also perform
<br />such other duties as the City Manager may assign to him.
<br />The Plumbing Inspector shall not engage in the business of
<br />plumbing, pipe fitting or any other business pertaining thereto
<br />or be interested, either directly or indirectly, in any firm or cor-
<br />poration engaged in said lines of business during his term of
<br />office.
<br />He shall inspect all buildings in course of erection, alteration
<br />or repair for the purpose of seeing that the laws and ordinances
<br />covering plumbing are complied with.
<br />Upon being notified by any plumber engaged in work for
<br />which he has received a permit, the Plumbing Inspector shall
<br />promptly examine such work and shall condemn it, order the re-
<br />moval of any defective or illegal material, or any plumbing or
<br />drainage, failing to comply with the provisions of this section.
<br />The Plumbing Inspector, or his authorized assistant, shall is -

<br />sue all permits for plumbing work and issue the required certif-
<br />icate of approval on the satisfactory completion of such work.
<br />Sec. 491(4) . Registration of plumbers.
<br />Every person engaged, or about to engage, in the plumbing
<br />business in the City, as a master or journeyman plumber, or
<br />any person coming from other places for the purpose of engaging
<br />in the plumbing business in the City as a master or journeyman
<br />plumber shall appear in person before the plumbing inspector
<br />and receive a certificate of registry upon satisfactory proof that
<br />he is a master or practical journeyman plumber; and no person
<br />other than a registered plumber shall be allowed to engage in
<br />plumbing or make any connection with a sewer, drain, soil, waste,
<br />or water pipe or any other pipe connected therewith.
<br />Upon satisfactory proof that the certificate of registration of
<br />a master or journeyman plumber was obtained through fraud or
<br />error or the recipient thereof is shown to be dishonest, grossly
<br />incompetent or repeatedly neglectful of the rules and regulations
<br />herein contained, the City Manager shall revoke the certificate of
<br />registration, with the right on the part of the person whose cer-
<br />tificate is revoked to appeal to the City Council.
<br />Sec. 491(6) . Licenses—bond required.
<br />Any person, firm or corporation about to engage in the plumb-
<br />ing business or the installation of plumbing systems in the City
<br />shall first be licensed as required by the license laws of the City.
<br />Before such licenses shall be issued by the Commissioner of
<br />Revenue the applicant must exhibit a certificate showing that the
<br />law hereafter required has been executed.
<br />Every person, firm or corporation engaged in the plumbing
<br />business shall enter into a bond with security satisfactory to the
<br />City Manager in the penalty of $500.00 to indemnify and save
<br />harmless the City, its citizens, residents and property owners
<br />against any and all loss by reason of his failure to comply with
<br />the requirements of this Chapter or from neglect or carelessness
<br />in his work, and conditioned further that should any such work
<br />be defective or incomplete and such person, firm or corporation
<br />shall fail to correct the same within ten days after written notice
<br />from the Plumbing Inspector, or his duly authorized representa-
