SEC. 312-A. CITY JAILOR - FOREMAN - WORK FORCE - ASSISTANTS. <br /> <br />The Council shall elect a jailor who shall have general supervision <br /> <br />of the City Jail and shall have the same duties and power concerning <br /> <br />the custody, care and control of prisoners as are now imposed upon and <br /> <br />conferred upon sheriffs and city sergeants under general law, and shall <br /> <br />be obedient to the order of the courts to the same extent as sheriffs <br /> <br />and sergeants. He shall give bond in the sum of $1000.00 as required <br /> <br />by Section 41-B of the City Code. <br /> <br />The City Manager shall appoint a competent and efficient person <br /> <br />as foreman of said work force and when necessary shall appoint another <br /> <br />as assistant foreman. <br /> <br />SEC. 313-A. THEIR DUTIES AND AUTHORITY. <br /> <br />The jailor shall in accordance with such regulations as the council <br /> <br />may prescribe, purchase all food and other supplies and all equipment <br /> <br />necessary for the operation of the jail, and the costs of the same shall <br /> <br />be paid out of the city treasury. The jailor shall be paid by the State <br /> <br />and the United States, the same fees in connection with prisoners as is <br /> <br />provided for by general laws, which fees shall be paid by the jailor into <br /> <br />the treasury of the city. <br /> <br />The council shall elect such deputy jailors as may be necessary for <br /> <br />the conduct of the jail, and the salary of the city jailor, as well as <br /> <br />such deputies, shall be fixed by the council of the city and paid out <br /> <br />of the city treasury, which shall be in lieu of all fees, commissions <br /> <br />or other compensation received by them. The city jailor and said <br /> <br />deputies shall be employed by and hold their positions at the pleasure <br /> <br />of the city council. <br /> <br />The foreman, and assistant foreman, of the work force are hereby <br /> <br />vested with all the powers and responsibilities of policemen, and shall <br /> <br />be under the control of the City Manager and may be suspended or <br /> <br />removed from office peremptorily by the City Manager or Council, without <br /> <br />formal proceedings, for any cause deemed sufficient by him or them. <br /> <br />SEC. 314-A. RULES AND REGULATIONS. WORK FORCE. <br /> <br />The following rules shall govern the City Manager and other officers <br /> <br />in the discharge of their duties relating to the work force. <br /> <br />1. The foreman of the work force shall take out such prisoners <br /> <br />as may from time to time be delivered to him by the City Jailor and shall <br /> <br />require them to perform such labor as may previously have been designated <br /> <br />by the City Manager. The foreman shall treat such prisoners humanely, <br /> <br />using at the same time, however, all such measures, as may be necessary <br /> <br />to secure diligent service on the part of the prisoners and to prevent <br /> <br />their escape. <br /> <br />2. The assistant foreman of the work force shall assist the <br /> <br />foreman in such manner as may be designated by him. <br /> <br />3. Each prisoner who is assigned to said work force shall obey <br /> <br />each and every proper order of the foreman or assistant foreman; he <br /> <br />shall perform such work as required of him by the officers in charge <br /> <br />of said force; and shall work each day the force is out unless excused <br /> <br />by sickness or by the City Manager. <br /> <br />4. The foreman shall not punish an offending prisoner on any <br /> <br />street or other public place, but shall return him to the City jail, <br /> <br />there to be dealt with as provided by rule 6; and the foreman may call <br /> <br />upon the City Jailor, or any member of the Police Force, for such <br /> <br />assistance as he may require in dealing with an obstreperous prisoner. <br /> <br />5. When a prisoner claims to be sick the Jailor shall promptly <br /> <br />notify the physician of the jail, who shall visit such prisoner during <br /> <br />the day in which he is so notified; if in his opinion the prisoner is <br /> <br />unfit for work, he shall so certify to the City Manager and said <br /> <br />physician shall continue to visit the prisoner daily so long as he may <br /> <br />require medical attention. <br /> <br />6. Should any prisoner or person assigned to work on said work <br /> <br />force disobey any proper order of the officers in charge of said work <br /> <br />force, or any rules and regulations of the Council, he shall be punished <br /> <br />by said officers in charge so that the same be not less than fifteen <br /> <br />nor more than thirty-nine stripes or lashes in any one day. Such <br /> <br />punishment shall take place at the jail, or in lieu thereof, or in <br /> <br />addition thereto such disobedience may be reported to the Judge com- <br /> <br />mitting such person to jail, who may add such additional punishment <br /> <br />as he may deem proper. <br /> <br />SEC. 315-A. PRISONERS - CREDIT FOR GOOD CONDUCT - ADDITIONAL <br /> <br />ALLOWANCE. <br /> <br />Prisoners shall be allowed a credit upon their term of imprison- <br /> <br />ment at the rate of four days per month for good conduct, and in <br /> <br />addition thereto shall be allowed a credit of 50¢ per day for each <br /> <br />day of confinement whether the same be on account of sentence imposed <br /> <br />or for failure to pay fine or costs, but nothing herein contained <br /> <br />shall prevent the City from collecting said fine and costs or any <br /> <br />part thereof by Civil Proceedings.
