260 <br />SEC. 320 (6) GASOLINE, BENZINE, NAPTHA, AND OTHER FLAMMABLE LIQUIDS - <br />PENALTY. <br />Any person, firm or corporation violating any of the provisions of this <br />section shall be fined not less than $10.00 nor more than $50.00 and each <br />day such violation continues shall constitute a separate offense. <br />All ordinances or parts of ordinances in conflict herewith are hereby <br />repealed. <br />Adopted by the Council September 16, 1940 <br />Ayes: Mr. Gleason, Dr. Haden, Mr. Huff, <br />Mr. Nash, and Mr. Peyton. <br />Noes: None. <br />C&L�GC�zv' r <br />Cler President <br />AN ORDINANCE ADDING A NEW SECTION TO THE CITY CODE DESIGNATED <br />AS SECTION 234 (6) "SUMMONS BY:'POLICE OFFICER, PENALTY FOR FAILURE <br />TO ANSWER". <br />BE IT ORDAINED by the Council of the City of Charlottesville that there be <br />enacted and added to the City Code of 1932 a new section which shall read as <br />follows: <br />SECTION 234 (a) SUMMONS BY POLICE OFFICER AND PENALTY FOR FAILURE TO <br />ANSWER. <br />A Police Officer arresting any person for a misdemeanor may in his <br />discretion, instead of bringing such person to the station house, take the <br />name and address of such person aril deliver to such peron a summons in <br />writingto appear at a time to be specified in such summons before the Civil <br />and Police Justice of the City, and upon taking from such person a promise <br />in writing to appear at such time and place shall release him from custody. <br />Any person refusing to give such written promise to appear shall be <br />taken to the station house.
