AN ORDINANCE AMENDING AND RE-ENACTING THE CODE OF THE
<br />CITY OF CHARLOTTESVILLE OF 1545 BY THE ADDITION THERETO
<br />OF A NEW CHAPTER NUMBERED 34 AND ENTITLED:
<br />"ARCHITECTURAL DESIGN CONTROL".
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE, THAT THE CODE OF THE CITY OF
<br />CHARLOTTESVILLE OF 1945 BE, AND THE SAME IS, HEREBY AMENDED AND RE-ENACTED BY THE ADDITION THERETO
<br />OF A NEW CHAPTER NUMBERED 34 AND ENTITLED "ARCHITECTURAL DESIGN CONTROL":
<br />SECTION 34.1 RESTRICTED DESIGN DISTRICTS:
<br />IN ORDER TO PROMOTE THE GENERAL WELFARE OF THE CITY THROUGH THE PRESERVATIOPI AND PROTECTION
<br />OF AN AREA OF HISTORIC, ARTISTIC AND CULTURAL INTEREST IN THE CITY OF CHARLOTTESVILLE AND FOR THE
<br />PRESERVATION OF ECONOMIC VALUES REPRESENTED THFREEY, THERE IS HEREBY CREATED AN AREA TO BE DESIGNATED
<br />AS THE "RESTRICTED DESIGN DISTRICT"; SUCH DISTRICT BEING SITUATE IN THE GENERAL ENVIRONS OF COURT
<br />SQUARE AND BEING DEFINED BY A SKETCH OF THE ENGINEERING DEPARTMENT OF THE CITY OF CHARLOTTESVILLE
<br />HERETO ATTACHED AND MADE A PART OF THIS ORDINANCE, WHEREIN THE OUTSIDE BOUNDARIES OF THE RESTRICTED
<br />DESIGN DISTRICT ARE ESTABLISHED BY STATED DISTANCES FROM THE STREET LINES UPON WHICH THOSE PROPERTIES
<br />EFFECTED ABUT.
<br />SECTION 34.2 BOARD OF ARCHITECTURAL REVIEW:
<br />34.21 FOR THE PURPOSE OF MAKING EFFECTIVE THE PROVISIONS OF THIS SECTION THERE IS HEREBY CREATED
<br />A BOARD TO BE KNOWN AS THE "BOARD OF ARCHITECTURAL REVIEW".
<br />34.22 POWERS AND DUTIES OF BOARD;
<br />THE BOARD OF ARCHITECTURAL REVIEW SHALL PASS UPON THE APPROPRIATENESS OF EXTERIOR ARCHITECTURAL
<br />FEATURES OF BUILDINGS AND STRUCTURES HEREAFTER ERECTED, RECONSTRUCTED, ALTERED OR RESTORED IN THE
<br />RESTRICTED DESIGN DISTRICT WHEREVER SUCH EXTERIOR FEATURES ARE SUBJECT TO PUBLIC VIEW FROM A PART OF
<br />ANY STREET WITHIN THE RESTRICTED DESIGN DISTRICT. ALL PLANS, ELEVATIONS AND SUCH OTHER INFORMATION
<br />DEEMED NECESSARY BY THE BOARD TO DETERMINE THE APPROPRIATENESS OF THE EXTERIOR FEATURES OF SUCH BUILDINGS,
<br />SHALL BE MADE AVAILABLE TO THE BOARD BY THE APPLICANT, THROUGH THE OFFICE OF THE BUILDING OFFICIAL,
<br />THE BOARD, IN PASSING UPON THE APPROPRIATENESS OF EXTERIOR ARCHITECTURAL FEATURES, IN ANY CASE,
<br />SHALL KEEP IN MIND THE PURPOSE SET FORTH IN SECTION 34.1 AND SHALL CONSIDER AMONG OTHER THINGS THE GENERAL
<br />DESIGN OF BUILDINGS OR STRUCTURES WHICH SHALL BE EARLY VIRGINIA, GREEK REVIVAL, MID -NINETEENTH CENTURY
<br />VERNACULAR, OR A CONTEMPORARY INTERPRETATION OF ANY OF THESE STYLES, WHICH SHALL BE HARMONIOUS IN MATERIALS
<br />AND COLOR. WITH THE OLD AND CONFORMING BUILDINGS OR STRUCTURES IN THE DESIGN CONTROLLED AREA,
<br />THE BOARD SHALL NOT CONSIDER STRUCTURAL DETAILS, RELATIVE SIZE OF BUILDINGS AND STRUCTURES OF INTERIOR
<br />ARRANGEMENTS OR FEATURES NOT SUBJECT TO PUBLIC VIEW FROM A PART OF ANY STREET WITHIN THE RESTRICTED DESIGN
<br />nISTR1CT.
<br />THE BOARD SHALL NOT MAKE ANY REQUIREMENTS EXCEPT FOR THE PURPOSE OF PREVENTING DEVELOPMENTS OBVIOUSLY
<br />INCONGRUOUS TO THE HISTORIC AND CULTURAL ASPECT OF THE DISTRICT,
<br />34.23 MEMBERSHIP OF BOARD:
<br />THE BOARD OF ARCHITECTURAL REVIEW SHALL BE COMPOSED OF SEVEN MEMBERS AND AN ALTERNATE MEMBER, APPOINTED
<br />BY CITY COUNCIL, ALL OF WHOM SHALL BE QUALIFIED RESIDENTS OF THE CITY OF CHARLOTTESVILLE.
<br />OF THE MEMBERS, TWO SHALL BE CERTIFIED ARCHITECTS; ONE A MEMBER OF THE CITY PLANNING COMMISSION; ONE AN
<br />ESTABLISHED, LICENSED REAL ESTATE BROKER, AND THREE OTHER PERSONS, THE ALTERNATE MEMBER, AT THE DISCRETION
<br />OF THE APPOINTING AUTHORITY, MAY BE FROM ANY ONE OF THE FOREGOING CATEGORIES.
<br />OF THE MEMBERS FIRST APPOINTED, TWO (2) SHALL BE APPOINTED FOR A TERM OF ONE (1) YEAR; TWO (2) FOR A
<br />TERM OF TWO (2) YEARS; TWO (2) FOR A TERM OF THREE (3) YEARS; AND ONE (1) FOR A TERM OF FOUR (4) YEARS.
<br />THEREAFTER MEMBERS SHALL BE APPOINTED FOR TERMS OF" FOUR YEARS RESPECTIVELY, THE ALTERNATE MEMBER SHALL BE
<br />APPOINTED FOR A TERM OF ONE (1) YEAR. ANY MEMBER, INCLUDING THE ALTERNATE MEMBER, AT THE DISCRETION OF THE
<br />APPOINTING AUTHORITY, MAY BE REAPPOINTED FOR A FULL TERM AND THE FACT THAT A PERSON HAS SERVED A TERM AS AN
<br />ALTERNATE MEMBER SHALL NOT DISQUALIFY HIM FROM APPOINTMENT AS ONE OF THE REGULAR MEMBERS. NO MEMBER SHALL
<br />SERVE FOR MORE THAN TWO CONSECUTIVE FOUR-YEAR TERMS.
<br />VACANCIES SHALL BE FILLED FOR AN UNEXPIRED TERM IN THE MANNER WHICH ORIGINAL APPOINTMENTS ARE REQUIRED
<br />TO BE MADE. CONTINUED ABSENCE OF ANY MEMBER FROM THE REGULAR OR CALLED MEETINGS OF THE BOARD SHALL, AT
<br />THE DISCRETION OF THE APPOINTING AUTHORITY, RENDER SUCH MEMBER LIABLE TO IMMEDIATE REMOVAL FROM OFFICE.
<br />THE ALTERNATE MEMBER SHALL SERVE, AT THE REQUEST OF THE BOARD'S CHAIRMAN, AT ANY MEETING WHEN FOR ANY
<br />REASON A REGULAR MEMBER IS ABSENT OR DECLINES TO SERVE AT SUCH MEETING.
<br />ALL MEMBERS OF THE BOARD, INCLUDING THE ALTERNATE MEMBER, SHALL SERVE AS SUCH WITHOUT COMPENSATION,
<br />FOUR MEMBERS OF THE BOARD PRESENT AND VOTING SHALL CONSTITUTE A QUORUM AND FOR THIS PURPOSE THE
<br />ALTERNATE MEMBER SHALL BE DEEMED TO BE A MEMBER OF THE BOARD.
<br />AT THE FIRST MEETING OF THE BOARD THE MEMBERS BY MAJORITY VOTE SHALL ELECT ONE OF THEIR NUMBER TO
<br />SERVE AS CHAIRMAN, AND THEREAFTER A CHAIRMAN SHALL BE ELECTED ANNUALLY AT THE FIRST MEETING TO BE HELD ON
<br />OR AFTER JULY 1ST IN EACH YEAR. SIMILARLY THE MEMBERS SHALL ELECT A VICE-CHAIRMAN AND A SECRETARY.
<br />ANY MEMBER OF THE BOARD MAY BE REMOVED FROM OFFICE BY CITY COUNCIL, AFTER A PUBLIC HEARING, FOR
<br />INEFFICIENCY, NEGLECT OF DUTY OR MALFEASANCE.
<br />34.24 APPROVAL OF BOARD
<br />NO BUILDING PERMIT UNDER THE PROVISIONS OF THE BUILDING CODE SHALL HEREAFTER BE ISSUED FOR THE
<br />ERECTION, RECONSTRUCTION, ALTERATION OR RESTORATION OF THE EXTERIOR OF ANY BUILDING, OR STRUCTURE, OR
<br />PART THEREOF WITHIN THE RESTRICTED DESIGN DISTRICT UNLESS AND UNTIL THE APPLICANT SHALL HAVE SECURED A
<br />CERTIFICATE OF APPROPRIATENESS FROM THE BOARD; PROVIDED, HOWEVER, THAT THIS REQUIREMENT SHALL NOT APPLY
<br />WHEN THE WORK PROPOSED IS ONLY TO MAINTAIN OR REPAIR SOME PART OF A BUILDING, SUCH AS A ROOF, PORCH$
<br />CORNICE, ETC., AND WHEN NO CHANGE OF DESIGN OR GENERAL OUTSIDE APPEARANCE OF SUCH BUILDING IS INVOLVED.
<br />34.25 CERTIFICATE OF APPROVAL:
<br />UPON APPROVAL OF THE PLANS FOR SUCH ERECTION, RECONSTRUCTION, ALTERATION OR RESTORATION,THE BOARD
<br />SHALL CAUSE A CERTIFICATE OF APPROPRIATENESS, CERTIFYING APPROVAL, TO BE ISSUED TO THE APPLICANT* SUCH
