WHOSE DEPARTMENT SUCH EMPLOYEES ARE EMPLOYED AND AGREED TO BY THE CITY MANAGER AND SUCH EMPLOYEES. <br />IN THE CASE OF DEPARTMENT HEADS, THEIR SERVICE MAY BE CONTINUED BY THE CITY MANAGER WITH THE APPROVAL <br />OF THE CITY COUNCIL. IN THE CASE OF COUNCIL APPOINTEES, THE COMMISSIONER OF REVENUE, THE CITY TREASURER, <br />THE CITY SERGEANT, THE CLERK OF THE CORPORATION COURT, AND THEIR EMPLOYEES, CONTINUED SERVICE WILL HAVE <br />TO BE APPROVED BY THE CITY COUNCIL. NO EMPLOYEE WILL BE REQUIRED TO SERVE BEYOND THE AGE OF 65 YEARS <br />IF HE WISHES TO RETIRE, AND HE SHALL BE ELIGIBLE FOR ANY RETIREMENT PAY TO WHICH HIS LENGTH OF SERVICE <br />(NOT LESS THAN 15 YEARS) AND RATE OF PAY ENTITLE HIM UNDER THE PROVISIONS HEREOF. <br />(7) (A) WHEN AN EMPLOYEE EMPLOYED BEFORE THE EFFECTIVE DATE OF THIS DECLARATION REACHES THE AGE <br />OF 65 YEARS AND DOES NOT HAVE AT LEAST 15 YEARS OF CONTINUOUS EMPLOYMENT WITH THE CITY, HIS EMPLOYMENT <br />SHALL TERMINATE FORTHWITH UNLESS HIS CONTINUED SERVICE IS REQUESTED AS PROVIDED IN PARAGRAPH (6) OF <br />THIS SECTION. IF SUCH EMPLOYEE'S SERVICE IS CONTINUED UNTIL HE DOES HAVE A LEAST 15 YEARS (OR MORE) <br />OF CONTINUOUS SERVICE WITH THE CITY, HE SHALL THEN BECOME ELIGIBLE FOR RETIREMENT HEREUNDER, WITH HIS <br />RETIREMENT PAY BEING BASED ON RATE OF ANNUAL SALARY AT AGE OF 65 AND LENGTH OF SERVICE BEING COMPUTED <br />AT 15 YEARS. <br />• (7) (B) WHEN AN EMPLOYEE EMPLOYED AFTER THE EFFECTIVE DATE OF THIS DECLARATION REACHES THE AGE <br />OF 65 YEARS AND DOES NOT HAVE A LEAST 15 YEARS OF CONTINUOUS EMPLOYMENT WITH THE CITY, HIS EMPLOYMENT <br />SHALL TERMINATE FORTHWITH EXCEPT AS PROVIDED IN PARAGRAPH (6) OF THIS SECTION. <br />(8) IF AN EMPLOYEE CONTINUES HIS SERVICE WITH THE CITY AFTER REACHING THE AGE OF 65 YEARS SUCH <br />CONTINUED SERVICE IS TEMPORARY AND MAY BE DISCONTINUED AT ANY TIME BY RECOMMENDATION OF THE DEPARTMENT <br />SP1 <br />CV HEAD AND THE CITY MANAGER, OR BY THE COUNCIL, AS THE CASE MAY BE. <br />W <br />(9) EXCEPT IN THOSE CASES COVERED IN PARAGRAPH (7) (A) OF THIS SECTION, THE RETIREMENT PAY OF <br />ANY EMPLOYEE WHO CONTINUES HIS SERVICE WITH THE CITY AFTER REACHING THE AGE OF 65 YEARS SHALL BE BASED <br />ON RATE OF COMPENSATION AND LENGTH OF SERVICE AT AGE OF 65, REGARDLESS OF ANY FURTHER SERVICE WITH THE <br />CITY, BUT SUBJECT TO AND INCLUDING ANY INCREASE OR DECREASE THAT THE EMPLOYEE WOULD HAVE RECEIVED UNDER <br />THE PROVISIONS OF PARAGRAPH (10) OF THIS SECTION HAD HE RETIRED AT AGE 65. <br />(10) WHENEVER THE CITY INCREASES OR DECREASES THE PAY OF ITS ACTIVE EMPLOYEES, THE RETIREMENT <br />PAY OF ALL RETIRED EMPLOYEES MAY BE INCREASED OR DECREASED BY THE COUNCIL IN APPROXIMATELY THE SAME <br />RATIO AS THE ACTIVE EMPLOYEES WITHIN THE SAME COMPENSATION GROUP. <br />(11) IF AN EMPLOYEE IS DISCHARGED AT ANY TIME, OR IF HE VOLUNTARILY LEAVES THE SERVICE OF THE <br />CITY BEFORE HE BECOMES ELIGIBLE FOR RETIREMENT PAY HEREUNDER, HE FORFEITS ALL RIGHTS TO RETIREMENT <br />PAY FOR HIS SERVICES BEFORE SUCH DISCHARGE OR VOLUNTARY SEPARATION FROM SERVICE. <br />(12) RETIREMENT PAY ALREADY BEING PAID BY THE CITY TO RETIRED CITY EMPLOYEES WILL NOT BE <br />AFFECTED BY THIS DECLARATION OF POLICY, EXCEPT THAT THE PROVISIONS OF PARAGRAPHS (10) AND (13) OF <br />THIS SECTION SHALL APPLY THERETO. <br />• (13) THE COUNCIL HAS THE RIGHT FROMrTIME TO TIME TO MAKE CHANGES IN THE POLICY EXPRESSED IN <br />THIS DECLARATION, AND TO MAKE EXCEPTIONS IN INDIVIDUAL CASES WHERE THE STRICT APPLICATION OF THE POLICY <br />HEREIN EXPRESSED WOULD, IN THE OPINION OF THE COUNCIL, CAUSE AN UNJUST HARDSHIP. <br />SECTION C - RETIREMENT PAY RATES <br />SUBJECT TO THE TERMS OF THE FOREGOING GENERAL STATEMENT OF POLICY AND THE RULES AND DEFINITIONS <br />ABOVE GIVEN, THE CITY WILL PAY MONTHLY RETIREMENT PAY FOR LIFE TO ITS FULL-TIME EMPLOYEES RETIRING <br />AT AGE 65 OR OVER, WITH NOT LESS THAN 15 YEARS OF CONTINUOUS SERVICE AT THE TIME OF SUCH RETIREMENT, <br />AND TO SUCH OTHER FULL-TIME EMPLOYEES WITH NOT LESS THAN 15 YEARS OF CONTINUOUS SERVICE WHO ARE <br />RETIRED WITH THE APPROVAL OF THE COUNCIL BECAUSE OF SOME PHYSICAL DISABILITY, WHICH RETIREMENT PAY <br />SHALL BE COMPUTED FROM THE TABLE SET OUT BELOW, SUBJECT, HOWEVER, TO REDUCTION FOR PRIMARY SOCIAL <br />SECURITY BENEFITS AS STATED IN SECTION A-1 OF THIS PLAN. <br />TABLE FIXING RETIREMENT PERCENTAGES BASED ON SALARY AND YEARS <br />OF SERVICE AND INCLUDING PRIMARY SOCIAL SECURITY BENEFITS <br />• SALARY GROUP 15 YRS.
