SCRIBNER. <br />NOES: NONE. <br />AN ORDINANCE AMENDING AND REENACTING SECTION 15 OF <br />CHAPTER 11 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1959, ENTITLED "BULK STORAGE; RESTRICTIONS ON <br />UNDERGROUND STORAGE; TRUCK TRANSPORTS". <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT SECTION 15 OF CHAPTER 11 OF <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1959, ENTITLED "BULK STORAGE; RESTRICTIONS ON UNDERGROUND <br />STORAGE. TRUCK TRANSPORTS", BE AND THE SAME IS HEREBY AMENDED AND REENACTED TO READ AS FOLLOWS: <br />SECTION 15. BULK STORAGE; RESTRICTIONS ON UNDERGROUND STORAGE; TRUCK TRANSPORTS". <br />THE STORAGE OR KEEPING OF GASOLINE OR ANY OTHER HIGHLY EXPLOSIVE LIQUIDS IN QUANTITIES OF MORE <br />THAN SIX THOUSAND GALLONS IN ANY ONE CONTAINER IS HEREBY DEFINED TO BE "BULK STORAGE". <br />EXCEPT IN M-2 INDUSTRIAL DISTRICTS OF THE CITY, AS NOW EXISTING OR AS HEREAFTER CHANGED, AND <br />EXCEPT AS PROVIDED IN SECTION 61 OF ARTICLE XV OF APPENDIX II, CODE OF THE CITY OF CHARLOTTESVILLE, <br />1959, THE BULK STORAGE WITHIN THE CITY OF GASOLINE OR OTHER HIGHLY EXPLOSIVE LIQUIDS IS PROHIBITED <br />AND IT SHALL BE UNLAWFUL FOR ANY PERSON TO STORE, KEEP OR HANDLE THE SAME IN BULK WITHIN THE CITY <br />EXCEPT IN M-2 INDUSTRIAL DISTRICTS, OR AS PROVIDED IN SAID ZONING ORDINANCE SECTION 61. THE FORE- <br />GOING PROVISIONS SHALL NOT APPLY TO TANK CARS OR TRUCK TRANSPORTS IN TRANSIT, BUT SHALL APPLY TO <br />THE UNLOADING OF TANK CARS OR TRUCK TRANSPORTS WITHIN ALL PARTS OF THE CITY EXCEPT IN M-2 INDUSTRIAL <br />DISTRICTS AND EXISTING NONCONFORMING BULK STORAGE PLANT SITES IN M-1 INDUSTRIAL DISTRICTS, AND IT <br />SHALL BE UNLAWFUL FOR ANY PERSON TO PLACE OR SPOT A TANK CAR OR TRUCK TRANSPORT CONTAINING BULK <br />STORAGE AS HEREIN DEFINED WITHIN THE CITY FOR THE PURPOSE OF LOADING AND UNLOADING EXCEPT IN M-2 <br />INDUSTRIAL DISTRICTS AND EXISTING NONCONFORMING BULK STORAGE PLANT SITES IN M-1 INDUSTRIAL DISTRICTS. <br />STORAGE UNDERGROUND OF QUANTITIES NOT IN EXCESS OF SIX THOUSAND GALLONS, IN ANY ONE CONTAINER <br />COMPLYING WITH THE PROVISIONS OF SECTION 11-15 WITH RESPECT TO UNDERGROUND TANKS, MAY BE PERMITTED <br />WITHIN THE CITY, EXCEPT IN ANY R-1 OR R-2 RESIDENTIAL DISTRICTS, R-3 MULTIPLE DWELLING DISTRICTS OR <br />B OFFICE SHOP DISTRICTS; PROVIDED, THAT IF SUCH UNDERGROUND TANK BE LOCATED WITHIN TEN FEET OF ANY <br />BUILDING, THE MAXIMUM PERMITTED IN ANY ONE CONTAINER SHALL BE TWO THOUSAND GALLONS; PROVIDED FURTHER <br />THAT IN AN R-3 MULTIPLE DWELLING OR B OFFICE -SHOP DISTRICT ONE UNDERGROUND TANK MAY BE INSTALLED TO <br />CONTAIN NOT IN EXCESS OF 550 GALLONS SO LONG AS SUCH TANK IS NOT LOCATED WITHIN 100 FEET OF ANY <br />DWELLING UNIT AND IS TO SERVE A NON -CONFORMING BUSINESS,USE, AND PROVIDED FURTHER THAT THE CONTENTS <br />OF SUCH 550 GALLON TANK SHALL NOT BE RESOLD TO OTHERS; PROVIDED FURTHER, AN ELEMENTARY OR SECONDARY <br />SCHOOL, WHETHER PUBLIC OR PRIVATE, LOCATED IN ANY R-1 OR R-2 RESIDENTIAL DISTRICT, R-3 MULTIPLE <br />DWELLING DISTRICT OR B -OFFICE SHOP DISTRICT, MAY INSTALL AN UNDERGROUND TANK TO CONTAIN NOT IN EXCESS <br />OF 550 GALLONS SO LONG AS SUCH TANK IS NOT LOCATED WITHIN 100 FEET OF ANY DWELLING UNIT OR 100 FEET <br />OF ANY BUILDING USED FOR SCHOOL PURPOSES AND SO LONG AS THE CONTENTS OF SUCH 550 GALLON TANK ARE NOT <br />RESOLD TO OTHERS. <br />TRUCK TRANSPORTS SHALL NOT MAKE ANY STOPS WITHIN THE CITY EXCEPT FOR THE PURPOSE OF MAKING <br />DELIVERIES TO WHOLESALERS OR RETAILERS OR IN THE EVENT OF MECHANICAL FAILURE. IN THE EVENT OF A <br />STOP FOR DELIVERY, SUCH DELIVERY SHALL BE MADE AS EXPEDITIOUSLY AS POSSIBLE, AND THE TRUCK TRANSPORT <br />SHALL NOT REMAIN AT THE PLACE OF DELIVERY LONGER THAN IS REASONABLY NECESSARY FOR THE PURPOSE OF <br />MAKING DELIVERY. IN THE EVENT OF A STOP ON ACCOUNT OF MECHANICAL FAILURE, THE DRIVER OF THE TRUCK <br />
