AN ORDINANCE AMENDING AND REENACTING SECTION 19-21 ENTITLED <br />"DANCE HALLS" OF CHAPTER 19 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1965. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT SECTION 19-21 ENTITLED <br />"DANCE HALLS" OF CHAPTER 19 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1965, BE AMENDED AND <br />REENACTED TO READ AS FOLLOWS: <br />SECTION 19-21. DANCE HALLS. <br />ANY PERSON DESIRING TO CONDUCT A DANCE HALL IN WHICH PUBLIC DANCING IS TO BE ALLOWED, WHERE <br />AN ADMISSION FEE IS CHARGED OR A CHARGE IS MADE FOR PARTICIPATING IN SUCH DANCING, SHALL FIRST <br />PROCURE THE BUSINESS LICENSE REQUIRED FOR DANCE HALLS. A COPY OF THIS ORDINANCE SHALL BE GIVEN <br />TO SUCH PERSON AT THE TIME HE OBTAINS THE BUSINESS LICENSE. <br />MEMBERS OF THE POLICE FORCE SHALL HAVE THE RIGHT TO ENTER ANY DANCE HALL AT ALL HOURS TO SEE <br />THAT THE PEACE AND QUIET OF THE CITY ARE PRESERVED, AND IT SHALL BE UNLAWFUL FOR THE PERSON WHO <br />OBTAINED THE BUSINESS LICENSE FOR THE DANCE HALL TO PERMIT DISORDERLY CONDUCT IN SUCH DANCE HALL. <br />• UPON CONVICTION OF VIOLATING THIS SECTION THE JUDGE OF THE MUNICIPAL COURT MAY, IN ADDITION TO <br />THE PUNISHMENT IMPOSED UPON SUCH CONVICTION REVOKE THE BUSINESS LICENSE FOR SUCH DANCE HALL. THERE <br />SHALL BE NO PRORATION OF THE BUSINESS LICENSE IF IT IS REVOKED AS HEREINABOVE PROVIDED. <br />ADOPTED BY THE COUNCIL <br />MARCH 65 1967 <br />AYES: MR. HAGGERTY, MR. JOHNSON, MR. VOGT. <br />NOES: NONE. <br />CLERK PRESIDENT <br />AN ORDINANCE AMENDING AND REENACTING SECTION 28-16 ENTITLED <br />"MARQUEES" OF CHAPTER 28 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE, 1965, BY THE ADDITION THERETO OF NEW <br />SUBSECTION ( c) . <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT SECTION 28-16 ENTITLED <br />"MARQUEES" OF CHAPTER 28 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 19655 BE AMENDED BY THE <br />ADDITION THERETO OF A NEW SUBSECTION (C) AND REENACTED AS FOLLOWS: <br />SECTION 28-16. MARQUEES. <br />AND SHALL NOT EXTEND NEARER THE CURB LINE THAN TWO FEET. THE RESTRICTION ON SQUARE FOOTAGE AS SET <br />FORTH BY SUBSECTION (B) OF THIS SECTION SHALL NOT APPLY TO THEATRE MARQUEES. SUCH SIGNS MAY EXTEND <br />ABOVE THE TOP OF THE MARQUEE, PROVIDED THE VERTICAL DIMENSION OF THE STRUCTURE, INCLUDING BOTH MARQUEE <br />AND SIGN, SHALL NOT EXCEED FIVE FEET. IF SUCH SIGNS ARE ILLUMINATED, EXPOSED LIGHT SOURCES SHALL <br />• NOT BE USED. <br />ADOPTED BY THE COUNCIL <br />MARCH 61 1967 <br />(C) <br />SIGNS MAY BE LOCATED UNDER MARQUEES SUBJECT TO THE FOLLOWING RESTRICTIONS: <br />(1) <br />THERE SHALL BE ONLY ONE SIGN FOR EACH STORE ENTRANCE. <br />(2) <br />SUCH SIGNS SHALL NOT EXCEED 12" IN DEPTH, WHICH DEPTH SHALL INCLUDE THE <br />• <br />SUPPORTS AND HANGERS ATTACHING THE SIGN TO THE MARQUEE. <br />(3) <br />THERE SHALL BE A MINIMUM DISTANCE FROM THE BOTTOM OF SUCH SIGN TO THE <br />SURFACE OF THE SIDEWALK OF 8 FEET. <br />(4) <br />SUCH SIGNS MAY EXTEND FROM THE STORE FRONT TO A POINT 6" TO THE REAR OF <br />THE FRONT OF THE MARQUEE, WHICH MEANS THAT SUCH SIGNS SHALL BE AT LEAST <br />22 FEET TO THE REAR OF THE CURB. <br />(5) <br />IF SUCH SIGNS ARE ILLUMINATED THE ILLUMINATION SHALL BE BY INTERIOR <br />LIGHTING ONLY, SUBJECT TO THE INTERIOR LIGHTING RESTRICTIONS AS SET <br />FORTH IN THIS CHAPTER. <br />(D) <br />THEATRE <br />MARQUEES PROJECTING OVER A PUBLIC SIDEWALK SHALL NOT BE LESS THAN NINE FEET ABOVE <br />THE SIDEWALK <br />AT THE LOWEST PART OF THE MARQUEE, SHALL NOT EXCEED FIVE FEET IN THE VERTICAL DIMENSION <br />AND SHALL NOT EXTEND NEARER THE CURB LINE THAN TWO FEET. THE RESTRICTION ON SQUARE FOOTAGE AS SET <br />FORTH BY SUBSECTION (B) OF THIS SECTION SHALL NOT APPLY TO THEATRE MARQUEES. SUCH SIGNS MAY EXTEND <br />ABOVE THE TOP OF THE MARQUEE, PROVIDED THE VERTICAL DIMENSION OF THE STRUCTURE, INCLUDING BOTH MARQUEE <br />AND SIGN, SHALL NOT EXCEED FIVE FEET.
