359 <br />(G) PREPARATION FOR SINGLE-FAMILY RESIDENCES SEPARATELY <br />BUILT, UNLESS IN CONJUNCTION WITH MULTIPLE CONSTRUCTION IN <br />• SUBDIVISION DEVELOPMENT; <br />(H) DISTURBED LAND AREAS FOR COMMERCIAL OR NONCOMMERCIAL <br />USES OF LESS THAN TEN THOUSAND SQUARE FEET IN SIZE; <br />(I) INSTALLATION OF FENCE AND SIGN POSTS OR TELEPHONE AND <br />ELECTRIC POLES AND OTHER KINDS OF POSTS OR POLES; <br />(J) EMERGENCY WORK TO PROTECT LIFE, LIMB OR PROPERTY, AND <br />EMERGENCY REPAIRS; PROVIDED THAT IF THE LAND DISTURBING <br />ACTIVITY WOULD HAVE REQUIRED AN APPROVED EROSION AND <br />SEDIMENT CONTROL PLAN, IF THE ACTIVITY WERE NOT AN <br />EMERGENCY, THEN THE LAND AREA DISTURBED SHALL BE SHAPED <br />AND ESTABLISHED IN ACCORDANCE WITH THE REQUIREMENTS OF THE <br />VIRGINIA EROSION AND SEDIMENT CONTROL HANDBOOK. <br />(5) PERSONS: SHALL MEAN ANY INDIVIDUAL, PARTNERSHIP FIRM, ASSOCIATION, <br />JOINT VENTURE, PUBLIC OR PRIVATE CORPORATION, TRUST, ESTATE, <br />COMMISSION, BOARD, PUBLIC OR PRIVATE INSTITUTION, UTILITY, COOPERA- <br />TIVE, COUNTY, CITY, TOWN OR OTHER POLITICAL SUBDIVISION OF THIS STATE, <br />ANY INTERSTATE BODY, OR ANY OTHER LEGAL ENTITY. <br />co <br />SECTION 10.1-2. APPROVAL FOR LAND DISTURBING ACTIVITIES. <br />t� <br />EXCEPT AS PROVIDED IN SECTIONS 10.1-5 AND 10.1-6, IT SHALL BE UNLAWFUL <br />FOR ANY PERSON TO ENGAGE IN ANY LAND DISTURBING ACTIVITY UNTIL HE HAS SUBMITTED <br />TO THE SUPERINTENDENT OF INSPECTIONS AN EROSION AND SEDIMENT CONTROL PLAN FOR <br />SUCH LAND DISTURBING ACTIVITY AND UNTIL THAT PLAN HAS BEEN REVIEWED AND APPROVED <br />BY THE SUPERINTENDENT OF INSPECTIONS. <br />SECTION 10.1-3. APPROVAL REQUIRED FOR CERTAIN EXISTING CONDITIONS. <br />IT SHALL BE UNLAWFUL FOR ANY PERSON WHO OWNS LAND IN THE CITY WILLFULLY <br />TO SUFFER OR PERMIT ANY PORTION OF HIS LAND TO REMAIN IN SUCH A CONDITION THAT <br />SOIL EROSION AND SEDIMENTATION CAUSES REASONABLY AVOIDABLE DAMAGE OR HARM TO <br />ADJACENT TO DOWNSTREAM PROPERTY, ROADS, STREAMS, LAKES OR PONDS. THE SUPERINTENDENT <br />OF INSPECTIONS, ON HIS OWN INITIATIVE OR UPON COMPLAINT OF ANY CITIZEN, SHALL <br />NOTIFY THE OWNER OF ANY SUCH LAND THAT SUCH CONDITION EXISTS AND SHALL REQUIRE <br />SUCH OWNER TO SUBMIT AN EROSION AND SEDIMENT CONTROL PLAN TO CONTROL SUCH EROSION <br />AND SEDIMENTATION. IF SUCH OWNER FAILS OR REFUSES TO SUBMIT SUCH PLAN TO THE <br />• SUPERINTENDENT OF INSPECTIONS WITHIN SEVEN DAYS AFTER SUCH NOTICE, OR IF HE <br />FAILS OR REFUSES TO PROVIDE THE CONTROLS REQUIRED BY THE PLAN APPROVED BY THE <br />SUPERINTENDENT OF INSPECTIONS WITHIN THE SPECIFIED TIME PERIODS AFTER NOTICE OF <br />SUCH APPROVAL, HE SHALL BE DEEMED TO HAVE VIOLATED THE PROVISIONS OF THIS SECTION <br />AND SHALL BE SUBJECT TO THE PROVISIONS OF 510.1-14 FOR SUCH VIOLATIONS; PROVIDED, <br />HOWEVER, THAT THE SUPERINTENDENT OF INSPECTIONS MAY, FOR GOOD CAUSE, EXTEND <br />THE PERIOD OF SUCH COMPLIANCE FOR A REASONABLE TIME. <br />SECTION 10.1-4. REQUIREMENTS PRIOR TO ISSUANCE OF PERMITS. <br />NO PERMIT SHALL BE ISSUED BY ANY ADMINISTRATIVE OFFICER OF THE CITY FOR <br />THE CONSTRUCTION OF ANY BUILDING OR OTHER DEVELOPMENT REQUIRING A PERMIT, NOR <br />SHALL ANY GRADING LAND DISTURBING, OTHER PERMIT, SUBDIVISION PLAT OR FINAL SITE <br />PLAN BE APPROVED, RELATING TO LAND SUBJECT TO THIS CHAPTER UNLESS AND UNTIL THE <br />• <br />
