PLAN, THE SUPERINTENDENT OF INSPECTIONS SHALL SERVE NOTICE BY <br />REGISTERED OR CERTIFIED MAIL UPON THE PERSON WHO IS RESPONSIBLE FOR <br />CARRYING OUT THE PLAN. SUCH NOTICE SHALL SET FORTH THE MEASURES • <br />NEEDED FOR COMPLIANCE AND THE TIME WITHIN WHICH SUCH MEASURES <br />SHALL BE COMPLETED. IF THE PERMIT HOLDER FAILS TO COMPLY WITHIN <br />THE TIME SPECIFIED HE MAY BE SUBJECT TO REVOCATION OF THE PERMIT. <br />SECTION 10.1-13. APPEAL TO THE BUILDING CODE BOARD OF APPEALS. <br />(A) ANY PERSON WHO IS AGGRIEVED BY ANY FINAL DECISION OF THE <br />SUPERINTENDENT OF INSPECTIONS PURSUANT TO THIS CHAPTER SHALL HAVE <br />THE RIGHT OF REVIEW OF SUCH ACTION BY THE BUILDING CODE BOARD OF <br />APPEALS. ANY SUCH APPEAL SHALL BE FILED IN WRITING WITH THE <br />BUILDING <br />CODE BOARD OF APPEALS WITHIN THIRTY DAYS <br />OF RECEIVING <br />(C) FOR <br />NOTICE OF <br />SUCH DECISION. THE BOARD SHALL CONSIDER <br />EVIDENCE <br />THE <br />APPLICANT, OWNER'S OF ADJACENT <br />AND DOWNSTREAM PROPERTY, AND <br />TO COMPLY WITH THIS <br />ANY <br />PRESENTED <br />BY THE APPELLANT, THE SUPERINTENDENT OF <br />INSPECTIONS, <br />SECTION 10.1-14. <br />THE DIRECTOR <br />OF PLANNING, THE CITY ENGINEER OR ANY <br />OTHER AFFECTED <br />• <br />PERSONS. <br />THE BOARD MAY, BASED ON WRITTEN FINDINGS <br />OF FACT, AFFIRM, <br />REVERSE OR MODIFY THE SUPERINTENDENT OF INSPECTIONS DECISION. <br />(B) ANY PERSON WHO IS AGGRIEVED BY ANY FINAL DECISION OF THE BUILDING <br />CODE BOARD OF APPEALS SHALL HAVE THE RIGHT OF REVIEW OF SUCH <br />DECISION BY THE CIRCUIT COURT OF THE CITY. ANY SUCH APPEAL SHALL <br />BE FILED IN WRITING WITH THE CIRCUIT COURT WITHIN THIRTY DAYS OF <br />RECEIVING NOTICE OF SUCH DECISION. <br />BUILDINGS AND STRUCTURES FOR WHICH <br />A BUILDING PERMIT SHALL HAVE <br />(C) FOR <br />THE PURPOSES OF THIS SECTION, <br />''AGGRIVED PERSON'' SHALL MEAN <br />PERMIT HAS NOT EXPIRED, <br />THE <br />APPLICANT, OWNER'S OF ADJACENT <br />AND DOWNSTREAM PROPERTY, AND <br />TO COMPLY WITH THIS <br />ANY <br />INTERESTED GOVERNMENTAL AGENCY <br />OR OFFICER THEREOF. <br />SECTION 10.1-14. <br />PENALTY FOR VIOLATION OF CHAPTER. <br />BUILDINGS, STRUCTURES, ALTERATIONS <br />TO BUILDINGS OR STRUCTURES <br />ANY PERSON VIOLATING THE PROVISIONS OF <br />THIS CHAPTER SHALL, UPON CONVICTION, <br />CHANGES OF LAND CHARACTERISTICS FOR <br />BE GUILTY OF A MISDEMEANOR AND BE PUNISHED BY A FINE NOT TO EXCEED ONE THOUSAND <br />DOLLARS OR IMPRISONMENT FOR A PERIOD NOT TO EXCEED THIRTY DAYS, OR BY BOTH <br />SUCH FINE OR IMPRISONMENT. EACH DAYS VIOLATION SHALL CONSTITUTE A SEPARATE OFFENSE. <br />VIOLATIONS OF THE PROVISIONS OF THIS CHAPTER MAY ALSO BE RESTRAINED, PROHIBITED <br />OR ENJOINED BY APPROPRIATE PROCEEDINGS. <br />SECTION 10.1-15. APPLICABILITY OF CHAPTER TO CONSTRUCTION PRIOR TO EFFECTIVE DATE <br />OF THIS CHAPTER. <br />(A) ALL <br />BUILDINGS AND STRUCTURES FOR WHICH <br />A BUILDING PERMIT SHALL HAVE <br />• <br />BEEN <br />ISSUED PRIOR TO JUNE 30, 1975, WHICH <br />PERMIT HAS NOT EXPIRED, <br />MAY <br />BE COMPLETED WITHOUT THE NECESSITY <br />TO COMPLY WITH THIS <br />CHAPTER. <br />(B) ALL <br />BUILDINGS, STRUCTURES, ALTERATIONS <br />TO BUILDINGS OR STRUCTURES <br />AND <br />CHANGES OF LAND CHARACTERISTICS FOR <br />WHICH A FINAL SITE PLAN HAS <br />BEEN <br />ISSUED PRIOR TO JUNE 30, 1975, AND <br />WHICH SITE PLAN HAS NOT <br />EXPIRED, <br />MAY BE COMPLETED WITHOUT THE NECESSITY <br />OF COMPLYING WITH <br />THIS <br />CHAPTER. <br />0 <br />
