P. <br />Be HENSHAW AND STATED HE HAD BEEN ADVISED BY <br />HENSHAW PROPERTY <br />IT THAT THE <br />ONLY DEVICE <br />WHEREBY THE CITY MAY ACQUIRE TITLE TO PROPERTY <br />AT 114 EAST <br />HIGH STREET <br />WOULD BE THROUGH CONTESTED CONDEMNATION <br />PROCEEDINGS, <br />ON MOTION <br />BY MR. HADEN, SECONDED BY MR. TEBELL, THE <br />FOLLOWING RESOLUTION WAS UNANIMOUSLY ADOPTED: <br />SINCE APRIL 1951, WHEN PURCHASE NEGOTIATIONS WERE <br />COMMENCED BY THE CITY OF CHARLOTTESVILLE IN AN EFFORT TO <br />ACQUIRE CERTAIN PROPERTIES WEST OF SECOND STREET AND <br />BETWEEN JEFFERSON AND Hi -3H STREETS FOR THE PURPOSE OF <br />ESTABLISHING THE RECOMMENDED PARKING LOT, THE CITY'S <br />REPRESENTATIVES HAVE BEEN IN CONSTANT TOUCH WITH THE OWNERS <br />OF THE VARIOUS PROPERTIES INVOLVED OR THEIR ATTORNEYS. <br />THERE ARE FOUR SEPARATE PARCELS EMBRACED WITHIN <br />THE RECOMMENDED SURVEY. ONE PARCEL IS OWNED BY THE METHODIST <br />RESOLUTION RE: CHURCH AND UPON IT THE CITY HAS ACQUIRED AN OPTION TO PURCHASE. <br />PARKING LOT <br />ANOTHER PARCEL WAS OWNED BY THE THREE DAUGHTERS OF THE LATE <br />DR. J. FULTON WILLIAMS. TWO OF THESE ARE CONVEYING THEIR <br />INTERESTS TO THE CITY AND THE THIRD, HAVING AGREED THROUGH <br />HER ATTORNEY TO MAKE A SIMILAR CONVEYANCEp HAS SINCE WITHDRAWN <br />FROM THE AGREEMENT. ANOTHER PARCEL, OWNED BY THE ANTRIM FAMILY <br />SEVERAL MEMBERS OF WHICH LIVE OUT OF THE STATE, IS THE SUBJECT <br />OF PURCHASE NEGOT 1 AT IONS. THE FOURTH PARCEL IS OWNED BY MR. <br />P. Be HENSHAW AND WITH RESPECT TO 1T THE CITY9 ACTING IN GOOD <br />FAITHS ENTERED INTO AN ORAL PURCHASE AGREEMENT. HOWEVERV AFTER <br />APPROPRIATING THE AGREED AMOUNT TO PURCHASE THIS PROPERTY9 THE <br />CITY WAS ADVISED BY THE OWNER'S ATTORNEY THAT "THE ONLY DEVICE <br />WHEREBY THE CITY MAY ACQUIRE TITLE TO THIS PROPERTY IS THROUGH <br />A CONTESTED CONDEMNATION PROCEEDING.lt <br />NOW, SINCE THIS COUNCIL HAS NOT AUTHORIZED CONDEMNATION <br />PROCEEDINGS FOR THE PURPOSE OF ACQUIRING THE PROPERTY IN <br />QUESTION FOR PARKING LOT PURPOSES AND DOES NOT CONTEMPLATE SUCH <br />ACTION <br />BE IT THEREFORE RESOLVED BY THE COUNCIL of THE CITY of <br />CH ARLOTTESV 1 LLE $ V` RG 1 N i A 9 THAT 9 WHEREAS IT NOW APPEARS <br />IMPOSSIBLE TO PURCHASES WITHOUT CONDEMNATION PROCEEDINGS <br />ALL THE PROPERTY REQUIRED FOR THE PARKING LOT PROJECTS THAT <br />ALL NEGOTIATIONS FOR THE ACQUISITION OF THE PROPERTY BE TERMINATED; <br />THAT THE FIRST METHODIST CHURCH BE RELIEVED OF ITS OBLIGATION TO THE <br />CITY; AND THAT THE ANTRIM FAMILY BE NOTIFIED THAT THE CITY IS NO <br />LONGER IN A POSITION TO CONTINUE NEGOTIATIONS FOR THEIR PROPERTY. <br />ON MOTION THE MEETING ADJOURNED. <br />CLERIC PRESIDENT <br />• <br />0 <br />
