<br /> <br />CITY OF CHARLOTTESVILLE, VIRGINIA <br />CITY COUNCIL AGENDA <br /> <br />Agenda Date: November 6, 2023 <br />Action Required: Adopt ordinance amendment <br />Presenter: Jacob Stroman, City Attorney <br />Staff Contacts: Ryan Franklin, Assistant City Attorney <br />Title: Amendment of Charlottesville City Code Sec. 15-75 to Comply with <br />Recent Amendments to the Virginia Code Sec. 46.2-924(A) Requiring <br />Drivers to Stop for Pedestrians in Crosswalks (2nd reading) <br />Background <br />Effective July 1, 2023, Code of Virginia, § 46.2-924(A) was amended to require vehicles to no longer <br />yield, but stop for pedestrians at certain street crossings. <br /> <br />Discussion <br />Charlottesville City Code § 15-75 requires that drivers of vehicles only yield the right of way to <br />pedestrians at certain crossings, but does not require them to stop. Thus, City Code § 15-75 is not in <br />conformance recent amendments to Code of Virginia, § 46.2-924. City Council must amend the City <br />Code by modifying its language to replace the requirement to yield with the new requirement to <br />stop. <br /> <br />Alignment with City Council's Vision and Strategic Plan <br />To ensure that the City’s ordinances are consistent with, and do not violate, State law. <br /> <br />Community Engagement <br />The community was not engaged because this is a mandatory State law to which the City needs to <br />conform with by amending its City Code. <br /> <br />Budgetary Impact <br />None <br /> <br />Recommendation <br />Adopt proposed ordinance <br /> <br />Alternatives <br /> <br />Attachments <br />Page 51 of 171
