83 <br /> <br /> Mr. Kurt Keesecker, 630 Park Street, Apt. G, said that he is an employee of Bruce <br />Wardell, the architect for the project, and is interested in purchasing one of the outlots for <br />a single family house. Mr. Keesecker said he supports the amended contract and is eager <br />to break ground. <br /> <br />The public hearing was closed. <br /> <br /> Mr. Frank Stoner, a partner in Belmont Commons, said that they have done a <br />fairly exhaustive study of the site, have conducted two focus group studies, and have <br />preliminary cost estimates for the Voluntary Remediation Program. Mr. Stoner said it is <br />not financially feasible to remove the contamination, mostly cinders, on the east end of <br />the property because the cost is estimated to be $1 million. The proposal is to develop <br />the west end ofthe property and to require that the City enroll in the Voluntary <br />Remediation Program within 45 days, which will allow Belmont Commons to stay with <br />the original timetable. <br /> <br /> Responding to a question from Mr. Toscano, Mr. Huja said the City could file for <br />the Remediation Program within 30 days. <br /> <br /> Responding to a question from Ms. Richards, Mr. Huja said that the City will <br />recoop its investment in the property in less than three years. <br /> <br /> Responding to a question from Ms. Richards, Mr. Stoner said they will be <br />responsible for the road infrastructure. <br /> <br /> Responding to a question from Mr. Cox, Mr. Stoner said the City will retain <br />ownership of the eastern portion of the site while it is being remediated, but after it is <br />cleaned it could be used as park land or could be conveyed to the homeowners <br />association. <br /> <br /> Mr. Cox asked whether the ongoing maintenance responsibility for the eastern <br />portion will fall on the City, and Mr. Huja said that it will as long as it is public property. <br /> <br /> Mr. Caravati asked if the slope will be fenced, and Mr. Stoner said it probably <br />makes sense to fence it, but he wants to wait and see it after it is graded. <br /> <br /> Responding to a question from Mr. Lynch, Mr. Huja said that the parcels on the <br />east side are less than 20,000 square feet. <br /> <br /> Mr. Lynch asked how confident the developers are that the site can be remediated <br />under the Voluntary Program and what will the City get for partial remediation, and Mr. <br />Stoner said that about four studies have been done on this parcel and he feels pretty <br />confident that the remediation work can be done for the estimated cost. Mr. Stoner said <br />the criteria for the Voluntary Remediation Program is that the pathway to exposure be <br />isolated or eliminated and that there be no groundwater contamination. Mr. Stoner said <br />there are no hazardous materials, but because of the cinders that were dumped on the <br />property, it cannot be build on. Following the Remediation Program, the City will be <br />given a certificate that immunizes the City from future exposure. <br /> <br /> Responding to an additional question from Mr. Lynch, Mr. Stoner said that he <br />cannot acquire the contaminated property because he cannot secure a loan because of the <br />contamination. He said it could take up to a year or more to get through the Voluntary <br />Remediation Program, but while this is occurring he can move forward on the other <br />property. <br /> <br /> Mr. Craig Brown, Deputy City Manager, said that the signatory on the contract <br />should be the City Manager, and said the ordinance should be amended to indicate that. <br /> <br /> On motion by Mr. Cox, seconded by Ms. Richards, the ordinance entitled "AN <br />ORDINANCE AMENDING THE LAND PURCHASE AND DEVELOPMENT <br />AGREEMENT DATED DECEMBER 10, 2000, BETWEEN BELMONT COMMONS, <br /> <br /> <br />
