Lynch said he would like to wait until an alternative place is available before <br />passing a leash law. <br /> Ms. Richards said she feels the erosion issue needs to be addressed at Riverview <br />Park. <br /> <br /> Mr. Lynch said he agrees that dogs should be on a leash in the playground area at <br />Riverview Park, and dogs owners should be asked to keep their dogs off the play area. <br /> <br />RESOLUTION: SPECIAL PERMIT FOR RUGBY-MCINTYRE APARTMENTS (611 <br />RUGBY ROAD) <br /> <br /> Ms. Susan Thomas, Planner in Neighborhood Development Services, explained <br />that the Rugby-Mclntyre Apartment building is a pre-existing, non-confkming use which <br />is now required to meet regulations since it is being renovated. The special permit will <br />allow occupancy of up to 137. Two waivers are requested: waiver of the setback of 200 <br />feet and a reduction in the required recreation space. Ms. Thomas said that the Planning <br />Commission and staff feel the requests are acceptable, and noted that the legal occupancy <br />of the apartment will actually decrease. <br /> <br /> Responding to a question from Mr. Cox, Ms. Thomas said that some adjacent <br />neighbors expressed concern with the larger addition proposed which would block their <br />view of the sky and trees. <br /> <br /> Responding to a question from Mr. Cox, Mr. John Gorman, architect for the <br />project, said that the addition will be more visible in the winter, but noted that the height <br />is not being increased above the existing height of the apartment building. <br /> <br /> Mr. Cox said he does not completely understand the impact of the addition and <br />cannot visualize what he is being asked to approve. <br /> <br /> Responding to a question from Mr. Caravati, Mr. Gorman said that the northern <br />side of the property will be landscaped with deciduous and evergreen trees and will be <br />supplemented with ground level shrubs and trees. <br /> <br /> Mr. Lynch said he agrees with Mr. Cox and does not know what the addition <br />looks like. <br /> <br /> Mr. Gorman said that the addition is not yet designed but will basically be a <br />replica of the existing building and will be 18 feet away from the existing building. <br /> <br /> Responding to a question from Ms. Richards, Mr. Gorman said that the number of <br />units is being increased by changing the type of some of the units. <br /> <br /> Responding to a question from Mr. Cox, Mr. Gorman said that parking will be <br />added. <br /> <br /> Mr. Cox questioned whether the impact of the new addition could be lessened by <br />relocating it. Mr. Cox said he does not feel he has enough information to feel there is a <br />public good if the permit is approved. <br /> <br /> Mr. Gorman said there is currently no storm water management or detention on <br />the property, and additional income is needed to offset this expense. Mr. Gorman said <br />additional improvements planned are improving circumstances with noise and dust, <br />improved landscaping, and addressing complaints about lights from cars, which will be <br />screened by the new building. Mr. Gorman noted that the plan has been adjusted <br />because of suggestions by staff and neighbors. <br /> <br /> Mr. Gouldman said that approving a special permit because of the public good is <br />a good concept but is not included in the ordinance. Mr. Gouldman said that <br />compatibility with the surrounding area is the legal standard for approving special use <br />permits. <br /> <br /> <br />
