Mr. Tolbert said we are not at liberty to alter most of the <br />language in the proposed ordinance. <br /> <br /> Ms. Richards asked about the comment made about raising rent as a result of <br />complaints, and Mr. Brown said that would be a landlord/tenant issue established in <br />court. <br /> <br /> Mr. Caravati ~asked if the City would be the primary enforcer, and Mr. Brown said <br />the action would be criminal, not civil, and the court would have to be convinced that the <br />increase was retaliatory. <br /> <br /> Ms. Richards asked if razor wire could be added to the section prohibiting barbed <br />wire, and said she would like to see barber or razor wire prohibited in commercial areas. <br /> <br /> Mr. Brown noted that Ms. Richards's suggestion would ban something in use now <br />without notification. Mr. Brown said he would like the opportunity to research the matter <br />and let Council know their options. <br /> <br /> Mr. Caravati said he would at least like to see razor or barbed wire prohibited on <br />property adjacent to schools. <br /> <br /> Mr. Lynch said he feels the administrative points should be well taken, and said <br />he feels that most landlords are responsible. Mr. Lynch said he thinks a phone call in the <br />initial stage ora violation would be helpful. <br /> <br /> Mr. Toscano suggested including a reference tothe Virginia Code after each <br />provision and making a notation about whether what is included is current or new City <br />Code. Mr. Toscano said he feels it is worth taking another look at the ordinance given <br />the questions raised and feels there are ways the ordinance could be tweaked. <br /> <br /> Mr. Cox said the ordinance needs to be enforced consistently, and requested that <br />staff provide a report on how the suggestions will be incorporated and how the ordinance <br />will be administered. <br /> <br /> Mr. Caravati said he is also interested in the concern that -was raised about repeat <br />offenders who wait until the last minute to correct the violation. Mr. Caravati asked <br />whether leaving furniture by dttmpsters could be considered vandalism. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Cox, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING CHAPTER 5 (BUILDINGS AND · <br />BUILDING REGULATIONS), CHAPTER 17 (OFFENSES - MISCELLANEOUS) OF <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATYNG TO PROPERTY MAINTENANCE AND UNSAFE STRUCTURES" was' <br />offered and carried over to the next meeting for consideration. <br /> <br />RES,OLUTIQN: SPECIAL PERMIT FOR PRESCHOOL AT LUTHERAN CHURCH <br /> <br /> Ms. Susan Thomas, Planner in Neighborhood Development Services, explained <br />that the Immanuel Lutheran Church at 2416 Jefferson Park Avenue, has requested a <br />special permit for a private pre-school facility. If approved, a maximum of 50 children <br />ages 2 and ½ through pre-kindergarten would be allowed. The Planning Commission <br />recommended approval of the special permit, with conditions. Ms. Thomas said it is felt <br />that many but not al! neighborhood concerns can be mitigated. The traffic generated will <br />be staggered and parking is adequate on site. The noise can be addressed by the location <br />of the playground and privacy fence. <br /> <br /> Mr. Lynch expressed concern that with an earlier site plan things were left undone <br />by the church. He asked what was left undone. <br /> <br /> Ms. Thomas said three lights in the parking area were not on the site plan, three <br />trees were not there, boards on the fence needs repair, the plan called for white oaks, and <br />one tree died, <br /> <br /> <br />
