245 <br /> <br />Manager begins receiving compensation as a full time employee <br />from some employer other than the City. <br /> <br />B. Early Termination. In the event City Council elects to terminate <br />this agreement at any time during the term of this contract, as may <br />be done under Section 4(A) of the contract, Manager shall be paid all <br />accrued salary and other benefits through October 31, 2006 or for <br />three years, whichever is less. In addition, City Council shall also <br />continue Manager's salary and benefits on the same terms as those <br />existing immediately prior to termination for each of the nine (9) <br />months subsequent to the last day of the term or the expiration of <br />three years from the date of termination, whichever occurs first; <br />provided, however, that such post termination payments and benefits <br />shall cease at any time during said nine-month period that Manager <br />begins receiving compensation as a full time employee from some <br />employer other than the City. <br /> <br /> 4. Section 8 of the Agreement entitled "Performance Evaluation" is <br />amended by the addition of Section 8 (C), which shall state as follows: <br /> <br />C. As part of the goals and performance objectives defined pursuant <br />to paragraph (B), the Manager and City Council shall identify, in <br />writing, certain "stretch" objectives, or ambitious and challenging <br />goals which will be difficult for the Manager to achieve but which <br />will have a significant and lasting positive effect on the City if <br />accomplished. The Manager shall include these agreed-upon stretch <br />objectives in his annual work plan and, during each subsequent <br />performance evaluation, provide City Council with a written report <br />on the status of his work towards those objectives. City Council <br />may, in its discretion, award the Manager a one-time salary <br />supplement in an amount up to 10% of his annual base salary for <br />accomplishment, or for significant progress towards <br />accomplishment, of any agreed-upon stretch objective. <br /> <br /> 5. Section 13 of the agreement is corrected by changing the reference to 14 <br />years in the first paragraph to 14 years and seven months. <br /> <br /> 6. All other terms and conditions in the Agreement not inconsistent with <br />this Motion shall remain in full force and effect. The Mayor is authorized to <br />execute a revised version of the Agreement incorporating the changes referenced <br />in this Motion. <br /> <br /> <br />
