259 "Project") located in the City of Charlottesville, Virginia (the "City"), and to pay other costs of the Project; and WitEREAS, the Issuer has called a public hearing to be held on February 15, 2002, as required by Section 147(f) of the ImemaI Revenue Code of 1986, as amended (the "Code"), and Section 15.2-4906 of the Code of Virginia of 1950, as amended; and WltEREAS, Section 147(0 of the Code (I) requires that the governmental unit having jurisdiction over the area in which any facility f'manced with the proceeds of the Note is located hold a public hearing and (ii) permits the City to appoint any individual to conduct such public hearing; NOW~ THEREFORE, BE IT I~ESOLVED BY THE CITY COUNCIL OF THE CITY OF CHARLOTTESVILLE, VIRGINIA: 1. The Council hereby appoints the Issuer to conduct, on its behalf, a public hearing on February 15, 2002, on the issuance of the Note. 2. This Resolution shall take effect immediately upon its adoption. .ORDINANCE: REZON1NG 1205 CARLTON AVENUE FROM R-2 TO M-1 On motion by Mr. Lynch, seconded by Ms. Richards, the ordinance entitled "AN ORIDNANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 34-15 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESIVLLE, 1990, AS AMENDED, BY THE REZONtNG OF 1205 CARLTON AVENUE" was offered and carried over to the next meeting for consideration. Mr. Toscano indicated that he will abstain from voting on the rezoning. ORDINANCE: REZONING 209 MONTICELLO ROAD FROM R-2 TO B-2 On motion by Mr. Lyncl~, seconded by Ms. Richards, the ordinance entitled "AN ORDINA2qCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED FN SECTION 34-15 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESIVLLE, 1990, AS AMENDED, BY THE REZON1NG OF 209 MONTICELLO ROAD" was offered and carried over to the next meeting for consideration.
