275 <br /> <br /> Responding to a question from Mr. Cox, Mr. Tolbert said the study should be <br />completed some time within the calendar year, but he doubts that the recommendations <br />will be implemented immediately upon its completion. <br /> <br /> Mr. Lynch recommended that the language in the ordinance be more general <br />rather than referring to this specific study. Mr. Lynch noted that this issue was not <br />included in the consultant's charge and he is not in favor of increasing the scope of the <br />study. <br /> <br /> Ms. Richards said a means needs to be established to involve other property <br />owners in the use of the mall space. <br /> <br /> Mr. Toscano agreed that the urban design study will not resolve the issue as it is <br />not in their charge, andhe made a motion to amend the ordinance to include language <br />provided by Mr. Brown regarding future review of the ordinance. Mr. Cox seconded the <br />motion. <br /> <br /> Mr. Lynch said that rather than fixing a date in the ordinance, he would prefer to <br />say any date thereafter, and Mr. Toscano and Mr. Cox accepted the change to their <br />amendment. <br /> <br /> The ordinance was amended by the following vote. Ayes: Mr. Caravati, Mr. <br />Cox, Ivlr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br /> Mr. Lynch asked what will happen if someone wants a space larger than 800 <br />square feet which is the limit the ordinance imposes. <br /> <br /> Mr. Tolbert said that space for larger than 800 square feet likely does not exist on <br />the mall, and added that limiting the amount of spaces gets to the concern about taking up <br />all the available space. <br /> <br /> The ordinance entitled "AN~ORDIN/hNCE AMENDING AND REORDAINING <br />THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />CHAPTER 28 (STREETS AND SIDEWALKS), ARTICLE VI (SIDEWALKS <br />CAFES)," as amended, which was offered at the February !9th meeting, was approved by <br />the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. <br />Toscano. Noes: None. <br /> <br />RESOLUTION: APPROVING SIDEWALK CAFI~ MAP FOR DOWNTOWN MALL <br /> <br /> Mr. Tolbert said that cafes can be located anywhere on the map exclusive of the <br />fire lane. <br /> <br /> On motion by Ms. Richards, seconded by Mr. Lynch, the resolution approving the <br />sidewalk caf6 map for the Downtown Mall was approved by the following vote. Ayes: <br />Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Toscano. Noes: None. <br /> <br /> WHEREAS3 the City desires to approve certain areas on the Downtown <br />pedestrian Mall, and certain other City sidewalk areas, for use as outdoor cafes; and <br /> <br /> WHEREAS, a public hearing on this matter was held before the City Council on <br />February 19, 2002; and <br /> <br /> WHEREAS, this Council finds and determines that outdoor cafes contribute to <br />the attractiveness and economic welfare of the City, and it is desirable to allow certain <br />City space to be let to caf6 operators for that purpose; now, therefore <br /> <br />BE iT RESOLVED by the Council of the City of Charlottesville: <br /> <br /> 1.This Council approves the Map, dated March 4, 2002, identifying the general <br />areas of the Downtown Pedestrian Mall which may be approved for use as outdoor caf6 <br /> <br /> <br />
