ORDINANCE: <br />REZONING PROPERTY <br />LOCATED ON FIFTH <br />STREET, S.W. <br /> <br />EXECUTIVE SESSION <br /> <br />MINUTES <br /> <br />PUBLIC <br /> <br />PUBLIC HEARING: <br />BUCK MOUNTAIN <br />CREEK PROJECT <br /> <br />PUBLIC HEARING: <br />TRANSPORTATION <br />GRANT APPLICA- <br />TION <br /> <br /> On motion by Mr. Conover, seconded by Mr. Buck, an ordinance entitled <br />"AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN <br /> <br />SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE <br />BY THE REZONING OF A PARCEL OF LAND LOCATED ON FIFTH STREET, S.W." was <br />offered and carried over to the next meeting for consideration. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, Council voted to <br /> <br />meet in executive session to discuss matters exempted by Section 2.1-344 (a) <br />(1) Personnel, (2) Property, and (6) Legal of the Virginia Freedom of <br /> <br />Information Act. <br /> <br /> The meeting was adjourned. <br /> <br />Cle <br /> COUNCIL CHAMBERS <br /> <br />President <br /> <br />August 2, 1982 <br /> <br /> Council met in regular session this date with the following members <br />present: Mr. Buck, Mr. Conover, Mrs. Gleason, Dr. Gunter. Absent: Dr. <br />Hall. <br /> <br /> The minutes of June 21st were approved as presented, with Mrs. Gl'eason <br />abstaining. <br /> <br />There were no matters by the public. <br /> <br /> Mr. Hendrix explained that the Rivanna Water and Sewer Authority was <br />proposing to purchase Buck Mountain at the present time, and preserve it <br />for future construction for additional water supply for the area. <br /> <br /> Mrs. Peggy King from the League of Women Voters, stated that she thought <br />it might be better to have the water source under the City's control, which <br />she indicated might necessitate a tax or rate increase. <br /> <br /> As there were no other speakers, the public hearing was closed. <br /> <br /> Mr. Hendrix explained that before the resolution authorizing the grant <br />application could be considered, a public hearing must be held. The grant <br />would subsidize part of the deficit of operating the transit system. <br /> <br /> As there were no speakers, the public hearingwas closed. <br /> <br /> Mr. Conover moved, Mrs. Gleason seconded, and the following resolution <br />was unanimously adopted: <br /> <br /> Resolution authorizing the filing of an application with the Department <br />of Transportation, United S~ates of America, for a grant under the.Urban <br />Mass Transportation Act of 1964, as amended. <br /> <br /> WHEREAS, the Secretary of Transportation is authorized to make grants <br />for mass transportation projects; <br /> <br /> WHEREAS, the contract for financial assistance will impose certain <br />obligations upon the applicant, including the provision by it of the local <br />share of project costs; <br /> <br /> WHEREAS, it is required by U. S. Department of Transportation in accord <br />with the provisions of Title VI of the Civil Rights Act of 1964, that in <br />connection with the filing of.an application for assistance under the Urban <br />Mass Transportation Act of 1964, as amended, the apptieant give an assurance <br />that it will comply with Title VI of the Civil Rights Act of 1964 and the <br />U. S. Department of Transportation requirements thereunder; and <br /> <br /> WHEREAS, it is the goal of the Applicant that minority business <br />enterprise be utilized to the fullest extent possible in connection with <br />this project, and that definitive procedures shall be established and <br />administered to ensure that minority businesses shall have the maximum <br />feasible opportunity to compete for contracts when procuring construction <br />contracts, supplies, equipment contracts, or consultant and other services: <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY CHARLOTTESVILLE CITY COUNCIL: <br /> <br /> 1. That Cole Hendrix, City Manager, is authorized to executive and <br />file an application on behalf of the City of Charlottesville with the <br />U. S. Department of Transportation, to aid in the financing of operating <br />assistance projects pursuant to Section 5 of the Urban Mass Transportation <br />Act of 1964, as amended. <br /> <br /> 2. That Cole Hendrix, City Manager, is authorized to execute and <br />file with such applications an assurance or any other document required <br /> <br /> <br />
