<br />to exist for the acquisition of permanent easements and rights-of-way
<br />across Parcel 144 on City Real Property Tax Map 55 in order to proceed
<br />with a sanitary sewer improvement project; and
<br />
<br /> BE IT FURTHER RESOLVED by the Council of the City of Charlottes-
<br />ville, Virginia that the City Attorney be and hereby ~s directed to
<br />institute condemnation proceedings for the acquisition of the
<br />permanent easements and right-of-way across a portion of Parcel 144
<br />on City Real Property Tax Map 55 and to file the necessary documents
<br />with the Circuit Court of the City of Charlottesville as provided in
<br />Sections 15.1 and 15.1-899 of the Code of Virginia (1950), as amended,
<br />and Sections 41 and 50.1 of the Charter of the City of Charlottesville,
<br />Virginia..

<br />Mr. Wiley stated that a notice of the street closing petition
<br />
<br />had been advertised. There were no comments from the public.
<br />
<br />On motion by Dr. Hall, seconded by Mrs. Gleason, the following
<br />
<br />resolution was adopted by the following vote. Ayes: Mr. Buck, Mr.
<br />
<br />Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None.

<br /> A RESOLUTION appointing viewers to consider a request for the
<br />vacation of a portion of a 12' alley lying between Lot 10, 20 and
<br />strip, Block 57, Belmont, designated as Parcel 126 on City Real
<br />Property Tax Map 60.

<br /> WHEREAS, this Council has received a petition requesting
<br />vacation of a portion of a 12' alley lying between Lot 10, 20 and
<br />strip, Block 57, Belmont, designated as Parcel 126 on City Real
<br />Property Tax Map 60; and
<br />
<br /> WHEREAS, it appears to Council that the notice required by
<br />Section 15.1-364 of the Code of Virginia (1950), as amended, has
<br />been duly advertised;
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
<br />Charlottesville, that Ms. Mary Jane Haynes, Messrs. W. J. Copeland
<br />and H. P. Winn, Jr. report in writing to Council what inconvenience,
<br />if any, would result from such vacation.

<br />On motion by Dr. Hall, seconded by Mrs. Gleason, the following
<br />
<br />resolution was adopted by the following vote. Ayes: Mr. Buck, Mr.
<br />
<br />Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None.
<br />
<br /> WHEREAS, it is recognized that pollutants from diffuse or nonpoint
<br />sources degrade the water quality of streams in Virginia; and
<br />
<br /> WHEREAS, this degradation of water by nonpoint sources of pollution
<br />can restrict the beneficial uses of those waters by citizens of the
<br />Commonwealth; and
<br />
<br /> WHEREAS, the Commonwealth of Virginia has adopted a group of Best
<br />Management Practices to abate and control the amount of nonpoint source
<br />pollutants from entering the surface and groundwaters of Virginia; and
<br />
<br /> WHEREAS, the Commonwealth has endorsed a statewide voluntary
<br />program to implement these Best Management Practices in order to abate
<br />and control nonpoint sources of water pollution; and
<br />
<br /> WHEREAS, the County of Albemarle and City of Charlottesville
<br />beginning in 1975, have initiated several water quality studies, and
<br />have developed regional management plans and County ordinances to
<br />evaluate and minimize the effects of point and nonpoint sources of
<br />pollution; and
<br />
<br /> WHEREAS, these management plans and ordinances currently utilize
<br />Best Management Practices.
<br />
<br /> NOW, THEREFORE BE IT RESOLVED that the Board of Supervisors of
<br />Albemarle County and the Council of the City of Charlottesville, endorse
<br />the State Plan for reducing nonpoint source water pollution through
<br />voluntary action and a nonregulatory program; and
<br />
<br /> BE IT FURTHER RESOLVED that the Board of Supervisors and the City
<br />Council encourage all citizens within these jurisdictions to utilize
<br />Best Management Practices wherever practical; and
<br />
<br /> FURTHER RESOLVED that the Board of Supervisors and the City Council
<br />direct the County Executive and the City Manager to insure that
<br />appropriate Best Management Practices are utilized by the County whenever
<br />practical.

<br /> WHEREAS, the Council of the City of Charlottesville did on January
<br />1S, 1968 adopt a Resolution to close portions of Sonoma Street, Stonehenge
<br />Avenue, and an alley between Monticello and Stonehenge Avenues as shown in
<br />red on a sketch of "Belmont" dated August 1967 which is hereto attached
<br />
