172 <br /> <br />(continued) <br />CITY'S RIGHT OF WAY <br />AT ROCKLAND AND <br />MERIDIAN STREETS <br /> <br />RESOLUTION: <br />BUCK MOUNTAIN <br />RESERVOIR <br /> <br />Mr. Lgwrence stated that before Christmas, he had requested Council's <br />conveyance of the property so that he would be in the position to require <br />the purchaser to go through with the contract. He stated that since <br />that time, he has made several contacts, including the House Bank Program <br />and now would like Council to convey the property to the owner under the <br />conditions that the housing code violations be met and that certain <br />improvements be made to the outside of the property. He stated that in <br />two weeks he would be able to tell Council that they have a purchaser <br />who has agreed to make specific improvements on the property within a <br />certain amount of time. He stated that at that time he will ask Council <br />for an agreement stating that if the improvements are completed the <br />conveyance will be made. <br /> <br /> Council had no objections to Mr. Lawrence's request and deferred <br /> <br /> the matter until the next regular meeting on January 18th. <br /> <br /> Mr. Hendrix distributed a revised copy of the resolution and reviewed <br /> the changes. He stated that this resolution needs to be passed by the <br /> members of the "Four Party Agreement:" Albemarle County Board of Super- <br /> visors, City Council, the Rivanna Water and Sewer Authority and the <br /> Albemarle County Service Authority. Mr. Hendrix said that the resolution <br /> provides that the periodic inspection and maintenance of the runoff <br /> control devices would be carried out by the Rivanna Water and Sewer <br /> Authority and charged to the Authority. He stated that it also provides <br /> that the County engineers' office would send all plans to the RWSA for <br /> review and comment, and that the Rivanna Board may refuse to accept them <br /> if they feel they are inadequately or improperly designed. Mr. Hendrix <br /> continued, saying that the resolution provides that the cost of the <br /> Watershed Management Official's office will be paid by the RWSA through <br /> its water rates on the same basis as the run-off control devices. The <br /> resolution further states that the City Attorney will be authorized on <br /> a case-by-case basis to work with the County Attorney defending lawsuits <br /> relating to the protection of the water supplies in the Charlottesville- <br /> Albemarle urban area. Mr. Hendrix said the resolution requests that the <br /> RWSA purchase property for the Buck Mountain Reservoir, stating that it <br /> will be financed through long term debt financing and that the debt would <br /> be paid by: 1) urban water rate and 2) surcharge against new connections, <br /> to be collected uniformly in the City and County. <br /> <br /> Mr. Conover raised a question relating to the cost of maintenance <br /> <br /> of the runoff control devices on page 2, part 1 of the resolution. He <br /> stated that this paragraph gives the RWSA protection by saying that the <br /> Rivanna Board may refuse to accept for inspection or maintenance any devices, <br /> but he would be more comfortable with the language if it would give the <br /> City a greater guarantee that the RWSA would maintain the runoff control <br /> devices in proper form. He said that this paragraph merely states that <br /> if the RWSA does not pass or approve the devices then the County would <br /> have no help with the maintenance and inadequate devices might be approved. <br /> · He stated that this does not guarantee that the ordinance will continue to <br /> be applied to protect the watershed area. <br /> <br /> John Berberich, Director of Public Works, stated that the paragraph <br /> <br /> Mr. Conover referred to is essentially a veto power on the part of Rivanna. <br /> <br /> <br />
