<br />A PUBLIC HEARING WAS HELD ON THIS DATE ON A PROPOSED CHANGE TO SECTION 33-68
<br />OF THE ZONING ORDINANCE. NO ONE APPEARED FOR OR AGAINST 7HiS CHANGE. AN ORDINANCE
<br />PUBLIC HEARING RE: ENTITLED "AN ORDINANCE AMENDING AND REENACTING SECTION 33-68, (1) of CHAPTER 33

<br />MEETING OF THE COUNCIL ON JUNE 1, 1959, WAS ADOPTED BY THE FOLLOWING RECORDED

<br />THE CITY MANAGER ADVISED MR. HADEN THAT ACCORDING TO THE RIGHT-OF-WAY PLANS,
<br />AS PREPARED BY THE STATE HIGHWAY DEPARTMENT AND DATED MAY, 1959, SUBSTANTIALLY
<br />ALL OF THE EAST END MERCHANTS PARKING LOT PROPERTY WOULD BE USED IN CONSTRUCTING
<br />THE BELMONT ROUTE ZO BRIDGE.
<br />THE CITY ATTORNEY REPORTED THAT HE HAO BEEN WORKING WITH THE ATTORNEYS
<br />MATTER RE: CLOSING PORTIONS OF REPRESENTING THE CHARLOTTESVILLE PARKING CENTER, INC. WITH REFERENCE TO CLOSING

<br />THE PORTIONS OF THIRD STREET, S. E. AND WATER STREET WITHIN THE BOUNDARIES OF
<br />THE PROPOSED PARKING CENTER. AFTER REVIEWING THE MATTER, ON MOTION BY MR.
<br />SCRIBNER, SECONDED BY MR. WEINBERG, THE FOLLOWING RESOLUTION WAS UNANIMOUSLY
<br />ADOPTED:
<br />WHEREAS, ON FEBRUARY 3, 1883, THE TOWN OF CHARLOTTESVILLE AGREED
<br />TO LEAVE SOUTH STREET AND SCHOOL STREET (NOW THIRD STREET), SO FAR AS THEY
<br />WERE THEN OCCUPIED BY THE CHESAPEAKE AND OHIO RAILWAY COMPANY, AS THEY WERE AND
<br />WHEREAS, IT APPEARS THAT SAID TOWN DID NOT THEN HAVE AUTHORITY
<br />UNDER iTS CHARTER TO CLOSE ANY OF ITS PUBLIC STREE7S~ AND
<br />RESOLUTION RE: CLOSING
<br />PORTIONS OF THIRD STREET, S. E. WHEREAS, ON JUNE 21, 1910, THE COUNCIL OF THE CITY OF CHARLOTTESVILLE
<br />ADOPTED A RESOLUTION, PURSUANT TO AUTHORITY VESTED IN SAID COUNCIL BY SECTION 14,
<br />CLAUSE 1 OF THE THEN CITY CHARTER, CLOSING THIRD STREET FROM WATER STREET TO THE
<br />MAIN LINE TRACKS OF THE CHESAPEAKE AND OH10 RAILWAY COMPANY, FOR SO LONG AS THE
<br />SAID STREET WAS USED BY THE CHESAPEAKE AND OHIO RAILWAY COMPANY FOR PURPOSES OF
<br />A FREIGHT DEPOTS AND
<br />WHEREAS, UNDER THE TERMS OF SAID RESOLUTION, AND BY VIRTUE OF A PROPOSED
<br />CONVEYANCE OF THE SAID FREIGHT DEPOT PROPERTY FROM THE CHESAPEAKE ANO OHIO RAILWAY
<br />COMPANY TO THE CHARLOTTESVILLE PARKING CENTER, INC., IT APPEARS THAT THIRD STREET
<br />WILL REVERT TO THE CITY OF CHARLOTTESVILIE~ AND
<br />WHEREAS, BY RESOLUTION ADOPTED MARCH 2, 1959, CHARLOTTESVILLE PARKING
<br />CENTER, INC., WAS ASSURED THAT THIRD STREET WOULD BE CLOSED AS SOON AS IT ACQUIRED
<br />TITLE TO SAID FREIGHT DEPOT PROPERTY,
<br />NOW, THEREFORE, ON APPLICATION OF CHARLOTTESVILLE PARKING CENTER, INC.,
<br />THERE BEING NO OBJECTION FROM ANY QUARTER, SO FAR AS THIS COUNCIL IS ADVISED,
<br />BE IT RESOLVED, BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE, THAT
