.~ <br />~~6 <br />EOUNCIL CHAMBER - MAY 2, 1960 <br />THE COUNCIL MET IN REGULAR SESSION ON THIS DATE WITH THE FOLLOWING MEMBERS <br />PRESENT: MR. COLEMAN, MR. MICHIE, MR. SCRIBNER AND MR. WEINBERG. ABSENT; MR. DAVIS. <br />THE MINUTES OF THE MEETINGS OF APRIL 18, 1960 AND APRIL 25, 1960 WERE READ <br />AND APPROVED. <br />A COMMUNICATION WAS PRESENTED FROM SOUTHERN MOTOR INN, INC. REQUESTING A <br />COUNTY WATER CONNECTION <br />SOUTHERN MOTOR INN, INC. COUNTY WATER CONNECTION FOR THEIR PROPERTY AT THE INTERSECTION OF ROUTE Z9 <br />APPROVED. <br />AND THE 25O BY-PASS. THE CITY MANAGER RECOMMENDED THAT A COUNTY WATER AND <br />SEWER CONNECTION BE GRANTED UNDER THE USUAL TERMS AND CONDITIONS. ON MOTION <br />BY MR. WEINBERG, SECONDED BY MR. SCRIBNER, THE FOREGOING RECOMMENDATION WAS <br />UNANIMOUSLY APPROVED. <br />A COMMUNICATION FROM H. D. FAULCONER REQUESTING WATER AND SEWAGE CONNECTIONS <br />P,EQUEST FOR WATER AND SEWAGE FOR OAK TERRACE SUBDIVISION WAS REFERRED TO THE PLANNING COMMISSION FOR RECOMMEND- <br />OAK TERRACE SUB. REFERRED TO <br />PLANNING COMMISSION ATION. <br />ON MOTION 8Y MR. COLEMAN, SECONDED 8Y MR. SCRIBNER, THE FOLLOWING RESOLUTION <br />WAS UNANIMOUSLY ADOPTED: <br />BE IT RESOLVED, THAT THE MAYOR AND CLERK OF THIS CORPORATION <br />RESOLUTION RE: AGREEMENT OF BE AND THEY ARE HEREBY AUTHORIZED TO EXECUTE A CERTAIN AGREEMENT <br />EASEMENT - VA. ELEC. R, POWER CO. <br />OF EASEMENT TO BEAR DATE AS OF MAY Z, 1960, CONVEYING TO THE <br />VIRGINIA ELECTRIC AND POWER COMPANY, A CORPORATION ORGANIZED AND <br />EXISTING UNDER THE LAWS OF THE STATE OF VIRGINIA, A RIGHT OF WAY <br />ACROSS THE PROPERTY OF THE CITY OF CHARLOTTESVILLE, AS SHOWN BY <br />PLAT BEARING NUMBER CH-3076, EXHIBITED TO THE CITY COUNCIL, SAME <br />TO BE SIGNED BY THE MAYOR ON BEHALF OF THE CITY OF CHARLOTTESVILLE <br />AND ATTESTED AND SEAL AFFIXED BY THE CLERK. <br />THE FOLLOWING REPORT WAS PRESENTED: <br />MAY 2, 1960 <br />THOMAS J. MICHIE, MAYOR <br />COUNCIL OF THE CITY OF CHARLOTTESVILLE <br />CHARLOTTESVILLE, VIRGINIA <br />DEAR SIR: <br />ON APRIL 6, 1959 YOU APPOINTED MESSERS. SOL fi. WEINBERG, <br />R. M. DAVIS ANO PAUL D. SUMMERS, JR., AS A COMMITTEE TO CONSIDER <br />THE PROBLEM OF DOGS RUNNING AT LARGE IN THE CITY. PURSUANT TO THIS <br />REPORT RE: DOGS RUNNING APPOINTMENT YOUR COMMITTEE HAS MADE AN EXHAUSTIVE STUDY OF THE <br />AT LARGE. PROBLEM THROUGHOUT THE PAST YEAR. <br />IT HAS BEEN OBVIOUS TO YOUR COMMITTEE SINCE IT COMMENCED <br />ITS STUDY THAT THIS QUESTION IS ONE WHICH ADMITS OF NO MIDDLE GROUND. <br />PEOPLE ARE EITHER FOR OR AGAINST DOGS RUNNING AT LARGE AND WHATEVER <br />THEIR POSITION MIGHT BE IT IS A FIRM ONE. YOUR COMMITTEE HAS CONTACT- <br />ED MANY PEOPLE AND HAS BEEN CONTACTED BY OTHERS THROUGHOUT THE YEAR. <br />THE RESULT OF THE YEARtS STUDY AND THE MANY PERSONAL CONTACTS WITH <br />OTHER CITIZENS OF THIS CITY SHOW THAT IT IS A QUESTION WHICH SHOULD <br />BE ANSWERED BY THE VOTERS, <br />THEREFORE YOUR COMMITTEE RECOMMENDS THAT THE COUNCIL CALL FOR <br />A REFERENDUM ON THE QUESTION OF WHETHER AN ORDINANCE PROHIBITING <br />THE RUNNING AT LARGEOF DOGS SHOULD BE ADOPTED BY THE COUNCILS THE <br />COMMITTEE FEELS THAT ONLY THROUGH THE USE OF A REFERENDUM MAY THE <br />COUNCIL BE APPRAISED OF A MAJORITY~S OPINION ON THIS QUESTION, AND <br />YOUR COMMITTEE FURTHER BELIEVES THAT THE MAJORITY~S OPINION SHOULD <br />CONTROL THE ANSWER TO THE PROBLEM. IT RECOMMENDS TO THE COUNCIL THAT <br />IF A MAJORITY OF THE VOTERS OF THE CITY OF CHARLOTTESVILLE VOTING <br />APP~'OVE nF SUCH AN ORDINANCE THEN THE COUNCIL PURSUANT TO SUCH VOTES, <br />SHOULD PASS AN ORDINANCE SIMILAR TO THE ONE WHICH IS HEREBY ENCLOSED <br />AND MADE A PART OF THIS REPORT. <br />RESPECTFULLY SUBMITTED <br />PDSJR ; MI_ D <br />SOL B.
