AN ORDINANCE Arv1ENDING AND RE-ENACTING SECTION 55 OF CHAPTER 29 OF <br />THE CHARLOTTESVILLE CITY CODE OF 1945 RELATING TO THE REMOVAL OF <br />TRASH, GARBAGE, ETC. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT SECTION <br />55 OF CHAPTER 29 OF THE CHARLOTTESVILLE CITY CODE OF 1945 BE AND THE SAME IS <br />HEREBY AMENDED AND RE-ENACTED SO AS TO READ AS FOLLOWS: <br />SECTION 55. REMOVAL OF TRASH, GARBAGE, ASHES, ETC., <br />BY THE CITY. <br />SUCH TRASH, GARBAGE, ASHED, ETC. AS THE CITY ELECTS TO REMOVE SHALL <br />BE SEPARATED, BY THE CITIZENS DESIRING TO DISPOSE OF SAME, INTO TWO CLASSES, <br />ONE OF BURNABLE MATTER, SUCH AS TRASH, GARBAGE, TIN CANS, ETC., AND THE <br />OTHER OF NON -BURNABLE MATERIALS, SUCH AS ASHES, OLD METAL, GLASS, ETC., <br />BURNABLE MATTER SHALL BE PLACED IN SEPARATE RECEPTACLES FROM NON -BURNABLE <br />MATERIAL. MATTER CONSISTING IN WHOLE OR IN PART OF FOODSTUFF OF ANY KIND <br />OR ANY VIET OR DAMP GARBAGE SHALL BE PLACED IN NON -LEAKING RECEPTACLES OF <br />NOT OVER THIRTY GALLONS CAPACITY WITH CLOSE FITTING COVERS WHICH SHALL NOT <br />BE FILLED WITHIN FOUR INCHES OF THE TOP. DRY TRASH, SUCH AS PAPER, OLD <br />CARTONS, CRATES AND BOXES MAY BE PLACED IN ANY SUITABLE RECEPTACLE SO <br />COVERED OR SECURED THAT THE TRASH WILL NOT BE BLOWN THEREFROM AND PAPERS <br />MAY BE SECURELY TIED IN BUNDLES. SUCH RECEPTACLES OR BUNDLES SHALL BE <br />PLACED ALONG THE EDGE OF THE SIDEWALK ON SUCH DAYS AND AT SUCH HOURS AS <br />MAY BE PRESCRIBED IN RULES AND REGULATIONS ISSUED BY THE CITY MANAGER . <br />ALL SUCH RECEPTACLES SHALL BE REMOVED FROM THE SIDEWALK BY THE <br />OWNER THEREOF AS SOON AS EMPTIED. <br />THE CITY MANAGER IS HEREBY EMPOWERED TO ADOPT AND PUT INTO FORCE <br />SUCH RULES AND REGULATIONS COVERING THE REMOVAL OF ASHES, GARBAGE AND <br />TRASH AS HE MAY DEEM NECESSARY, AND SUCH REGULATIONS AFTER APPROVAL <br />BY THE COUNCIL SHALL HAVE THE FORCE AND EFFECT OF AN ORDINANCE. <br />ANY PERSON VIOLATING THIS SECTION OR ANY REGULATION WHICH MAY BE <br />PRESCRIBED SHALL BE FINED NOT LESS THAN ONE DOLLAR ($1.00) NOR MORE <br />THAN FIVE DOLLARS (,5.00) FOR EACH OFFENSE. <br />ADOPTED BY THE COUNCIL <br />JANUARY 39 1949 <br />AYES; MR. ADAMS, MR. BARR, <br />MR. HADEN, MR. HAMM, <br />AND MR. TEBELL. <br />NOES: NONE <br />,r <br />LERK PRESIDENT <br />AN ORDINANCE AMENDING AND RE-ENACTING SECTION 21 OF CHAPTER 33 OF THE <br />CHARLOTTESVILLE CITY CODE OF 1945 AS HERETOFORE AMENDED RELATING TO <br />THE BOARD OF ZONING APPEALS AND COSTS OF APPEAL. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT <br />SECTION 21 OF CHAPTER 33 OF THE CHARLOTTESVILLE CITY CODE OF 1945 AS HERE- <br />TOFORE AMENDED BE AND THE SAME IS HEREBY AMENDED AND RE-ENACTED SO AS TO <br />READ AS FOLLOWS: <br />SECTION 21. BOARD OF ZONING APPEALS; COST OF APPEALS. <br />A BOARD OF ZONING APPEALS IS HEREBY ESTABLISHED9 IT SHALL CONSIST <br />OF FIVE MEMBERS TO BE APPOINTED, AND EXERCISE SUCH POWERS AS PROVIDED BY <br />THE LAWS OF THE STATE. <br />IN ADDITION TO THE REQUIREMENTS OF THE STATE LAW RELATIVE TO AN APPEAL <br />FROM A DECISION OF THE BUILDING INSPECTOR TO THE BOARD OF ZONING APPEALS, <br />EVERY SUCH APPELLANT, BEFORE DELIVERING A NOTICE OF APPEAL TO SAID BOARD, <br />SHALL DEPOSIT THE SUM OF TWENTY DOLLARS AS COSTS WITH THE DIRECTOR OF F1- <br />NANCE, WHO SHALL NOTE ON SAID NOTICE THAT THE DEPOSIT REQUIP.ED HAS BEEN <br />PA ID. <br />EACH MEMBER OF THE BOARD OF ZONING APPEALS SHALL BE ALLOWED A FEE OF <br />FIVE DOLLARS (,$5.00) FOR EACH MEETING ATTENDED BY SUCH MEMBER, WHICH SHALL <br />BE PAID BY THE CITY TREASURER UPON PRESENTATION OF PROPER VOUCHER, AFTER <br />BEING APPROVED BY THE DIRECTOR OF FINANCE. <br />CLERK <br />ADOPTED BY THE COUNCIL <br />JANUARY 3, 1949 <br />AYES: MR.
