WEINBERG. <br />NOES: NONE. <br />RESIDENT <br />AN ORDINANCE AMENDING AND RE-ENACTING ARTICLE III TITLED DISTRICTS AND <br />BOUNDARIES THEREOF, SECTION 33.7 SUBPARAGRAPH 4 AND ARTICLE XIII TITLED <br />EXCEPTIONS AND MODIFICATIONS, SECTION 33.55 SUBPARAGRAPH 2 OF CHAPTER 33 <br />OF THE CHARLOTTESVILLE CITY CODE OF 1945, AS AMENDED, BEING THE ZONING <br />ORDINANCE OF CHARLOTTESVILLE. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE THAT ;ARTICLE III, SECTION 33.7 SUB- <br />PARAGRAPH 4 AND ARTICLE XIII SECTION 33.55 SUBPARAGRAPH 2 OF CHAPTER 33 OF THE CHARLOTTESVILLE CITY <br />CODE OF 1945; AS AMENDED, BEING THE ZONING ORDINANCE OF CHARLOTTESVILLE, BE AND THE SAME IS AMENDED <br />AND RE-ENACTED TO READ AS FOLLOWS: <br />ARTICLE III. DISTRICTS AND BOUNDARIES THEREOF. <br />SECTION 33.7. GENERAL PROVISIONS. <br />4. NO LOT AREA SHALL BE REDUCED OR DIMINISHED SO THAT THE YARD OR OTHER S'ACES <br />SHALL BE SMALLER THAN PRESCRIBED BY THIS ORDINANCE NOR SHALL THE DENSITY OF <br />-OPULATION BE INCREASED IN ANY MANNER EXCE'DT IN CONFORMITY WITH THE AREA REGULATIONS <br />HEREIN ESTABLISHED, EXCEPT THAT THIS PROVISION SHALL NOT PRECLUDE THE CONSTRUCTION <br />OF A RESIDENCE ON A LOT OF RECORD EXISTING BEFORE JANUARY 21, 1958. <br />ARTICLE XIII. EXCEPTIONS AND MODIFICATIONS. <br />SECTION 33.55. THE FRONT YARDS HERETOFORE ESTABLISHED SHALL BE ADJUSTED IN THE FOLLOWING INSTANCES: <br />2. WHERE A LOT IN THE R-1, R-2, R-3 OR B DISTRICTS IS LOCATED AT THE INTERSECTION OF <br />TWO (2) OR MORE STREETS THERE SHALL BE A SIDE YARD ON THE SIDE STREET FRONTAGE OF SUCH <br />CORNER LOT OF NOT LESS THAN TWENTY (20) FEET IN THE R-1, R-2 AND R.-3 DISTRICTS AND FIVE (5) <br />FEET IN THE B DISTRICT, EXCEPT THAT FOR A LOT OF RECORD AS OF JANUARY 21, 1958 IN THE R-1 <br />AND R-2 DISTRICTS AND FOR SINGLE AND TWO FAMILY DWELLINGS IN THE R-3 DISTRICT THE AFORESAID <br />TWENTY (20) FOOT SIDE STREET YARD REQUIREMENT MAY BE REDUCED TO WHATEVER FOOTAGE WILL PERMIT <br />A MAXIMUM BUILDABLE WIDTH OF NOT MORE THAN THIRTY-TWO (32) FEET, PROVIDED HOWEVER THAT IN NO <br />CASE SHALL SUCH SIDE STREET YARD REQUIREMENT BE LESS THAN TEN (10) FEET.
