98 <br /> <br />AN ORDIDANCE AMENDING AND RE-ENACTING SECTIONN 608 OF T7F CITY CODE. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF CHARLOTTESVILLE, That section 608 of the City Code; <br /> <br />entitled "RIDING ON RUNNING BOARDS OR STEPS OF SIDES OF SUMMER CARS ON STREET RAILWAYS <br /> <br />PROHIBITED": be amended and re-enacted to read as follows; <br /> <br />It shall be unlawful for any passenger to ride on the running boards or steps on <br /> <br />the sides of summer cars on any street railway. <br /> <br />For every violation. of this section the offender shall be fined not less than one <br /> <br />dollar ($1.)* <br /> <br />It shall be the duty of every street railway company to enforce this ordinance <br /> <br />undor a penalty of $5. for each case of failure to require compliance with this section <br /> <br />Adopted by the Council August 15 ,1911. presented and approved August 16, _ <br />President Signature. Mayor Signature. <br /> <br />AN ORDINANCE AMEDING AND RE-ENACTING SECTION 357 OF TIfE CITY CODE: <br /> <br />BE IT ORDAINED BY TIIE COUNCIL OF CHARLOTTESVILLE,That section 367 of the City Code <br /> <br />entitled "PRIVIES ,EARTH -CLOSETS, etc. " be amended and re-enacted to read as follow; <br /> <br />S e c. 367 - -PRIVIES , EARTH -CLOSETS , eta. <br /> <br />No privy, other than a water closet, shall be located within ten feet of any street _ <br /> <br />within the same distance of the line of adjoining property unless the owner of such <br /> <br />adjoining property consent to its being, located or remaining within such distance; _ <br /> <br />no earth privy shall,be permitted to exist within the city,except in cases where _ <br /> <br />are excluded from watsr or sewer facilities and then only when a permit has been <br /> <br />granted by the Health Officer or by the Board of Health and upon a license of three <br /> <br />dollars ($3) per annum, payable quarterly in advance, said permit to be in force ford <br /> <br />year from -its issue,or for such xxxt time less than a year as the license has been _ <br /> <br />for,and may be renewed at the discretion of the Ttealth Officer or the Board of Health <br /> <br />upon the payment of the license of three dollars as provided above. <br /> <br />Anyone violating this section shall be fined t eo dollars ($2) for each day the <br /> <br />offense continues after being notified by the Mayor or Health Officer to remove the <br /> <br />same. <br /> <br />This ordinance shall be in force from and after June 1,1912. <br /> <br />Adopted by the Council April 11,1912 Presented and approved April 13, _ <br />President (No signature) Mayor Signature. <br /> <br />AN ORDINANCE AMENDING AND RE-ENACTING SECTION 369 OF THE CITY CODE: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF CIIARLOTTESVILLE,That sec.359 of the City Code, entitled <br /> <br />"Privies,etc. --wlien cleaned",be amended and re-enacted to read as followes; <br /> <br />SEC/369 --PRIVIES , etc. --WHEN CLEANED/ <br /> <br />A. The cleaning of closets or privies within the City limits shall be done exclusively _ <br /> <br />or under the direction of the department of Streets & Sanitation ,and that it shall be _ <br /> <br />for any private person to contract to do said work through or by any private citizen. <br /> <br />B. The said closets or privies shall be properly cleaned and disinfected by said departments <br /> <br />and the excrement from said closets or privies shall be removed in sealed barrels or other <br /> <br />covered receptacles and disinfected by said department or under its direction, and _ <br /> <br />or disposed of at such places and in such manner as shall be dictated by the Mayor and _ <br /> <br />of Health. <br /> <br />C. A charge of seventy five cents per quarter shall be made upon the occupant of the <br /> <br />premises whereon a closet or privy is maintained and used, which charge shall cover the <br /> <br />expenses of said department for cleaning and disinfecting each closet or privy and remove <br /> <br />the excreta, the said charge or fee to be paid by the occupant to the City Treasurer <br /> <br />beginning of each quarter. <br /> <br />D. Any person or persons exercising the privilege of maintaining said closets _ <br /> <br />who shall refuse to pay the fee or charge in the manner set out in this ordinance, or _ <br /> <br />having paid the fee, fails to report to the Mayor any neglect of the scavenger to perform <br /> <br />his duty shall be guilty of a misdemeanor and upon conviction thereof be fined not <br /> <br />than $10. <br /> <br />E. The scavenger tax imposed in this ordinance shall be payable quarterly in to <br /> <br />City Treasurer,and collectable at the same time and in the same manner as the water tax. <br /> <br />The bill for said tax shall be noted quarterly on the printed card or other not to <br /> <br />Treasurer to water-takers, and the duty of collecting and accounting and of making returns _ <br /> <br />of delinquents is imposed on said officer,who shall hold the amount paid in in sacredd to _ <br /> <br />tures for sanitation during the year in which it is collected,and at the end of <br /> <br />cover any remainder into the mass of general revenues. <br /> <br />F. All persons subject to the scavenger tax who are returned delinquent shall, after the <br /> <br />tenth day of any quarter be subject, to a fine of not less than ten cents a day until the <br /> <br />and fine are paid.
