Edwards absent: <br /> <br />a. Minutes of December 19 <br /> <br />b. APPROPRIATION: $18,749 - Additional assessment - Juvenile Detention <br /> Home (2nd reading) <br /> <br /> BE IT RESOLVED by the Council for the City of Charlottesville, Virginia, that the <br />sum of $18,759 is hereby appropriated from the unappropriated balance of the General Fund <br />to expenditure account 05~301-043020 to fund the City'spro rata share of the cost of <br />increased security measures at the Shenandoah Valley Juvenile Detention Home. <br /> <br />c. APPROPRIATION: $22,500 - Library HVAC Repairs (2nd reading) <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia, that the <br />sum of $22,500 is hereby appropriated from account code 26-020-122050 in the Capital <br />Projects Fund to expenditure account 26-020-075000 as the City's share of the increased cost <br />of HVAC repairs at the Central Branch of the Jefferson-Madison Regional Library. The <br />City's total share of the cost of this project will now be $100,000 and will be matched by <br />Albemarle County. <br /> <br />ORDINANCE: "AN ORDINANCE TO ACCEPT CERTAIN SURPLUS <br />PROPERTY ON MADISON AVENUE NEAR ROSE HILL DRIVE FROM <br />THE CHARLOTTESVILLE SCHOOL BOARD AND CONVEY S AID <br />PROPERTY TO THE AMERICAN RED CROSS" (2nd reading) <br /> <br />PUBLIC HEARING: CHARGING RENT FOR SIDEWALK CAFES <br />ORDINANCE <br /> <br /> Mr. Toscano explained that the Downtown Malt Committee recommended thai the City <br />charge rent for the use of ipublic space by sidewalk cafes and that fees for vendors be <br />increased, in light of the decision to charge rent for the news kiosk on the downtown mall. <br /> <br />The public hearing was opened. <br /> <br /> Ms. Terry Shotwell, owner of The Nook Restaurant and Terry's Place, stated that a few <br />sidewalk cafe owners met and agreed that it was reasonable for the City to charge rent, but <br />recommended that no more than $1 a square foot be charged. <br /> <br /> Mr. Stan Tatum, Planning Commission member and Mall Committee member, <br /> I . <br />explained that the Committee recommended charging rent for cafes due to the cost to the <br />City of maintaining the mall and in the hope that charging rent would encourage cafe owners <br />to make a more serious commitment in the operation of their cafes. Mr. Tatum stated that <br />the recommended rent of'$3 per square foot was an average of the rent charged by <br />communities that were su~eyed <br /> <br /> Mr_ J. D. Thomas, co-owner of the Moondance Cafe, stated that while he agrees that it <br />would be reasonable to charge rent for the cafes, he noted that the rent for his cafe would be <br />approximately $3,300, which he feels would be a prohibitively expensive increase over the <br />current cost of $25. Mr. Thomas also recommended that the cost be pro-rated, or that cafes <br />be allowed to use the space for 12 months. Mr. Thomas stated that he could live with a rent <br />of $1 per square foot if pro-rated <br /> <br /> Mr. Clyde Gouldman, City Attorney, stated that the intention of the ordinance is to <br />charge rent for a 9-month season, with any less time being pro-rated on that basis. <br /> <br /> <br />
