Edwards. <br /> <br />BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that: <br /> <br /> (1) That South Rockland Street shall hereinafter be officially named Rosa Terrace, as <br />recommended by staff and with the concurrence of the property owners whose addresses <br />would be affected; and <br /> <br /> (2) That Lee Court shall hereinafter be officially named Latrobe Court, as <br />recommended by staff and as requested by the property owners whose addresses would be <br />affected. <br /> <br />RESOLUTION: CABLE TV RATE REGULATION - AN ACCOUNTING ORDER <br /> <br /> Mr. Clyde Gouldman, City Attorney, explained that the FCC has affirmed Council's <br />decision regarding Adelphia Cable's "a ia carte" offerings and a deadline of 120 days was <br />given for Council action. Because Adelphia has not resubmitted the required forms, the <br />resolution before Council would direct Adelphia to keep track of rates charged customers so <br />that if and when Council decides a refund to customers is in order, the information will be <br />available. Mr. Gouldman noted that two sentences in the resolution need to be changed to <br />reflect the fhct that Adelphia has not submitted the required forms to date. <br /> <br /> Mr. John McKay, an attorney representing Adelphia Cable, stated that he thinks the <br />action required to be taken by Council should be by ordinance raIher than by a resolution; <br />except for the accounting language, he believes the Council has no authority for the <br />remainder of the resolution; and there was no such finding in FCC regulations that refers to <br />finding anything illegal. Mr. McKay stated that he believes the resolution before Council is <br />over-reaching and bounding on defamation, and he objects to anything other than the <br />accounting order. <br /> <br /> Mr. Gouldman stated that the issue of an ordinance versus a resolution has been <br />previously brought up by Adelphia, but he does not agree with their opinion. Mr. Goutdman <br />stated that refunds would only go back as far as allowed by the FCC. Mr. Gouldman stated <br />that he considers Adelphia going to "a la carte" offerings contrary to FCC regulations. <br /> <br />Mr. Vandever stated that he is inclined to pass both a resolution and ordinance. <br /> <br /> Ms. Gouldman stated that Council can adopt an ordinance in one reading on a <br />four/fifths vote. <br /> <br /> On motion by Ms. Slaughter, seconded by Ms. Daugherty, the "RESOLUTION <br />ESTABLISHING INITIAL CABLE TELEVISION RATES FOR THE BASIC SERVICE <br />TIER AND RELATED EQUIPMENT" was approved, with Rev. Edwards absent for the <br />vote~ <br /> <br /> WHEREAS, the City of Charlottesville, Virginia, ("City") is the Grantor of a Cable <br />Conununications Franchise Ordinance ("Ordinance") executed on or about June 15, 1992, by <br />and between the City and Multi-Channel T.V.
