107 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council hereby certifies <br />that, to the best of each member's knowledge, (i) only public business matters lawfully <br />exempted from open meeting requirements by Virginia law were discussed in the closed <br />meeting to which this certification resolution applies, and (ii) only such public business <br />matters as were identified in the motion convening the closed meeting were heard, <br />discussed or considered by the Council. <br /> <br />COUNCIL CHAMBER - June 4, 2001 <br /> <br /> Council met in regular session on this date with the following members present: <br />Mr. Caravati, Mr. Cox, Mr. Lynch, Ms, Richards, Mr. Toscano. <br /> <br />AWARDS/RECOGNITIONS: GROPEN DESIGN AND PRINTING <br /> <br /> Mr. Caravati presented the City's Business Recognition Award to Mr. Neal <br />Gropen of Gropen Design and Printing. <br /> <br />PUBLIC <br /> <br /> Mr. Lloyd Smith, Park Street, expressed concern that the request for permit <br />parking on Park Lane East has been stalled because staff want to include all of the <br />apartments on the comer of Park Street and Park Lane East in the survey. Mr. Smith said <br />that his reading of the ordinance would not include the apartments in the survey, and he <br />asked Council to instruct staffto move forward with this. <br /> <br /> Mr. Clyde Gouldman, City Attorney, said that he reads the ordinance differently <br />than Mr. Smith and feels that the apartments should be included in the survey. <br /> <br /> Mr. Kenneth Jackson, 712 Ridge Street, thanked Mr. Toscano, Ms. Richards, Mr. <br />Caravati, Mr. O'Connell and Police Chief Longo for the way they responded to a <br />situation recently. Mr. Jackson said citizens need to be involved in helping the <br />community. <br /> <br />PUBLIC HEARING: SCHOOL BOARD APPOINTMENTS <br /> <br /> Mr. Caravati said that the deadline for School Board applications has been <br />extended to June 15th to allow time to solicit more applicants, and encouraged all <br />interested citizens to consider applying. <br /> <br />PUBLIC HEARING: NOISE ORDINANCE AMENDMENTS (MUSIC ON <br />ORDINANCE DOWNTOWN MALL <br /> <br /> Mr. O'Connell said that concerns were raised last year by residents and merchants <br />on the downtown mall about loud music and noise in general. Mr. O'Connell said that <br />the proposed ordinance relies on decibel levels. <br /> <br /> Mr. Gouldman explained that First Amendment issues are involved in regulating <br />noise levels, but Council can make reasonable regulations. Mr. Gouldman explained that <br />noise ordinances in other communities have been researched and the proposed ordinance <br />is modeled after Alexandria's ordinance which sets a limits of 75 decibels between 6:00 <br />a.m. and 10:00 p.m. and 65 decibels between 10:00 p.m. and 6:00 a. rrr for noise audible a <br />distance of greater than 100 feet. <br /> <br />The public hearing was opened. <br /> <br /> Mr. David Dupont, 1012 Grove Street, asked that the public hearing be <br />rescheduled because two dates were for hearing were advertised and the ordinance was <br />not available until May 30th. Mr. Dupont said there was bias in the notification process <br />and lack of time to review the proposal. Mr. Dupont said First Amendment issues are <br />involved. <br /> <br /> <br />
