218 <br /> <br />RESOLUTION: <br />GRANTING SPECIAL <br />PERMIT FOR <br />PROPERTY LOCATED <br />AT 1301 WERTLAND <br />STREET <br /> <br />hy la~ and haa been. t.h~ ~uhj]e.c.t .of'~ pu~l~c.rLe~ar'm~ ~:j~:int~l'~ B~fI'd' <br />by this Council and the City Planning Commission on May 10, 1983; <br />and <br /> WHEREAS, the City Planning Commission has recommended <br />approval of such special permit, now, therefore, <br /> BE IT RESOLVED by the City of Charlottesville, Virginia, that: <br /> t. The property located in B-3 Business District at 409 East <br />Market Street and 4th Street, N.E., designated as a portion of <br />ParceI 51 on City Real Property Tax Map 53, is hereby granted a <br />special permit for use for an assembly operation as permitted under <br />Section 31-93 of the City Code. <br /> 2. City Council finds that sUch use conf0~ms to the require- <br /> ments for special permits generally imposed by Article XX (Section <br /> 21-218 et seq.) of Chapter 31 of the City Code, and this permit is <br /> subject to all conditions and restrictinns imposed generally by <br /> such article. <br /> <br /> 3. Such permit shall be conditioned upon development and use <br /> of the property in accordance with the approved site pla~ for the <br /> property, and failure to adhere to the requirements of the site <br /> plan shall be deemed cause for re~ocation of the special permit. <br /> <br /> Mr. Higgins presented the resolution granting a special permit <br /> for high density residential apartments in an historic structure at <br /> 1301 Wertland Street. The original request had been-for SO units but <br /> had been reduced to 44 units. The Planning Commission recommended <br /> approval of the special permit for the following reasons: 1) it was <br /> in harmony with the comprehensive plan, 2) it would have no signifi- <br /> cant adverse effect on the neighborhood, 3) the design was compatible <br /> with the present architectural structure, and 4) it would fill a need <br /> for housing, in the area. Mr. Higgins noted that conditions such as <br /> proper grading and utility placement had been placed on the granting of <br /> <br />the permit. <br /> <br /> Mrs. Gleason moved, Mr. Conover seconded, and the following <br /> <br />resolution was unanimously passed: <br /> <br />ORDINANCE: <br />YELLOW AMBULANCE <br />RATE INCREASE <br />RBQUEST <br />~2nd reading) <br /> <br /> BE IT RESOLVED by the CoUncil of the City of Charlottesville <br />that there is hereby granted pursuant to Section 31-33 of the Code <br />of the City of Charlottesville a special permit for the use of <br />property located at 1301 Wertland Street for construction of <br />apartment units at a density of 24 units per acre, or a maximum of <br />44 units on such.property. Such permit shall be subject to the <br />conditions and regulations set forth in the aforesaid Section 31-33 <br />for such higher density development as well as to all general conditions <br />and regulations imposed upon special permits by Chapter 31 of Such <br />City Code, including the obtaining by the development of an approved <br />site plan prior to initiating use of the property for such purposes. <br /> <br />Mr. Hendrix said that his staff had reported that Anderson Brothers <br /> <br />of Crozet was probably infringing on the Yellow Ambulance franchise and <br /> <br />that it had been surmized that deregulation would probably give Anderson. <br /> <br />Brothers more business and thereby put Yellow Ambulance out of business. <br /> <br />Mr. Michael Carroll of the City Manager's staff, reported that <br /> <br />there was some confusion about Yellow Ambulance receiving Medicare re- <br /> <br />imbursement. <br /> <br />The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> <br />SECTION 3 OF THE CONTRACT AND PERMIT PORTION OF THE ORDINANCE ADOPTED <br /> <br />FEBRUARY 19, 1980, WHICH GRANTED AN EXCLUSIVE FRANCHISE TO YELLOW <br />AMBULANCE COMPANY. TO OPERATE A NON-EMERGENCY AMBULANCE SERVICE, SUCH <br />AMENDED SECTION TO INCREASE THE RATE CHARGED FOR SUCH SERVICE" was adopted <br /> <br />with the following vote. Ayes: Mr. Buck, Mr. Conover, Mrs. Gleason, <br /> <br />ORDINANCE: <br />AMENDING SECTION <br />31-279.1 RELATING <br />TO SUSP-ENSION OF <br />TIME LIMITS ON <br />PERMITS, CERTIFI- <br /> <br />Dr. Gunter, Dr. Hall. Noes: None. <br /> <br /> Mr. Higgins reported that the Planning C~mmission had recommended <br /> <br />denial of the amendment by a 4 - 3 vote. ,- <br /> <br /> Mr. Conover moved to deny the amendment and stated his support of <br /> <br /> <br />
