318 <br /> <br />RESOLUTION: <br />GRANTING SPECIAL <br />PERMIT FOR <br />WAREHOUSES ON <br />B-3 ZONED <br />PROPERTY ON <br />CHERRY AVENUE <br /> <br />ORDINANCE: <br />AMENDING TO <br />PERMIT TOWING <br />OF VEHICLES <br />UNLAWFULLY <br />PARKED IN <br />HANDICAPPED <br />SPACES <br /> (2nd reading) <br /> <br />ORDINANCE: <br />AMENDING <br />RETIREMENT <br />PLAN <br /> <br /> Mr. Ron Higgins, Planner for the Department of Community <br />Development, explained that a request had been made for a special <br />permit to allow warehouses to be built on the south side of Cherry <br />Avenue. Mr. Higgins noted that the property had been rezoned from <br />B-2 to B-3 in 1979, and reported that the Planning Commission was <br />split 'in their recommendation to Council. Reasons for denial were: <br />1) It is contrary to the~ Land Use Plan of the Comprehensive Plan <br />and 2) The proposed use is not compatible with the residential uses <br />in the area and will not serve the immediate neighborhood. Reasons <br />for approval were: 1) It will not have a significant adverse impact <br />on the surrounding neighborhood as it has been planned sensitively <br />to the neighborhood and 2) The proposed use is less intense than some <br />permitted uses by right in the B-3 zone. <br /> Mr. Conover questioned w~hether ~he property should be more <br /> appropriately zoned B-2 to be more in conformity with the Land Use Plan. <br /> Mr. Higgins responded that it is very difficult to downzone <br /> property. <br /> Dr. Hall moved to deny the special permit and Mr. Conover seconded <br /> the motion to deny. <br /> <br /> Mr. Robert Biebel, representing the property owners, stated ~that <br /> <br /> he had toured the Fifeville neighborhood with Mr. Eugene Williams and <br /> had worked with the Neighborhood Association to make changes to the <br /> project such as substituting a solid wood fence and placing landscape <br /> outside of the fence. <br /> <br /> Mrs. Celestine Harbert, President of the Fifeville Neighborhood <br /> Association, stated that while some compromises had been agreed to, <br /> the neighborhood remained opposed to the project. <br /> The motion to deny the special permit was approved by the following <br /> vote. Ayes: Mr. Conover, ~r. Gunter, Dr. Hall. Noes: Mrs. Buck, Mrs. <br /> Gleason. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION <br /> 16-43.1, AS AMENDED, OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br /> TO PERMIT THE TOWING OF VEHICLES UNLAWFULLY PARKED IN SPACES RESERVED <br /> FOR THE HANDICAPPED" which was offered at the meeting of January 3, <br /> 1983, was approved by the following vote. Ayes: Mr. Buck, Mr. Conover, <br /> Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. <br /> Mr. Buck outlined the following options which were being <br /> considered: 1) apply the ~resent formula for present employees and <br /> Formula D for employees beginning work after January 1, 1984, 2) include <br /> the Sheriff's deputies as public safety officials, 3) increase supple- <br /> ment for public safety officials from 50% to 100% and 4) remove <br /> mandatory cost of living raise for retirees. <br /> <br /> Ms. Sheila Haughey reviewed minor changes to the ordinance which <br /> had been made since the ordinance was considered in September. <br /> <br /> Mr. David Cole, representing the Firefighters Association, re- <br /> emphasized his support of maintaining the present formula for present <br /> employees. He stated that while the firefighters had initially <br /> supported the idea of a cap, they were no longer in favor of it. <br /> Mr. John deKoven Bowen, Chief of Police, stated his support for <br /> <br /> <br />
