<br />ASSURANCES TO
<br />COMMONWEALTH
<br />REGARDING HIGHWAY
<br />UTILITY PERMITS
<br />
<br />to-the next meeting for consideration.
<br />
<br /> BE IT RESOLVED. by the Council of the City of Charlottesville,
<br />Virginia,. that an additional sum of $9,000.00 is hereby appro-
<br />priated, from the grants fund to expenditure account 11-25050,
<br />bringing the total appropriation to the expenditure account to
<br />$64,000.00. Such appropriation shall be for use by the Charlottes-
<br />ville Police Department in a Sobriety Checkooint./Roadblock Program
<br />for the period October 1, 1983 to September 30, 1984, and shall b.e'
<br />subject to the receipt of a like amount in revenue from a Virginia
<br />Division of Motor Vehicles grant, number AL8.3-00-052.
<br />
<br />Mr. Hendrix stated that the $18,000 grant would be used to
<br />
<br />conduct a study on the feasibility of a Multi-Modal Transportation
<br />
<br />Center and that a public hearing had been held on the subject by
<br />
<br />Council in August of 1983.
<br />
<br /> Dr. Hall moved the $'18,000 appropriation for the Multi-Modal
<br />Transportation Center Study Grant, Dr. Gunter seconded the motion,
<br />and it was carried over to-the next meeting for consideration.
<br /> BE IT RESOLVED by the Councit.of~ the City of Charlottesville,
<br />Virginia that the sum of $18~,000 is hereby appropriated to
<br />expenditure account 11-33050 in the Grants Fund for the purpose
<br />of conducting a concept and feasibility study for a multi'modal
<br />transportation center. Such appropriation shall be conditioned
<br />upon receipt of a like amount ~n revenue in grants from the
<br />Urban Mass Transportation AdministratiOn and the Virginia Department
<br />of Highways and Transportation, program number VA-90-0005.
<br /> Mr. Buck.read the proclamation which Council was asked to adopt
<br />
<br />proclaiming February as Black HiStory Month.
<br /> On motion by Mrs. Gleason, seconded by Dr. Hall, the resolution
<br />prOclaiming February as Black History Month was unanimously adopted
<br />
<br />by Council.
<br />
<br /> WHEREAS, blacks have made contributions to America even before
<br />the birth of the nation; and
<br /> WHEREAS, February ha's been set aside nationally as a time to
<br />remember and learn facts about black contributions to America; and
<br /> WHEREAS, black Americans have fought and died for the preser-
<br />vation and promotion of human rights, justice and peace for .all
<br />Americans; and
<br />
<br /> WHEREAS, knoWledge and appreciation of black history establishes
<br /> th.e fact that-all citizens have benefited from the p~resence of blacks
<br /> in this community;
<br />
<br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHARLOTTESVILLE,
<br />VIRGINIA does .hereby proclaim February, 1984 as BLACK.HISTORY MONTH
<br />in recognition of the struggles and contributions of blacks a.nd to
<br />make all citizens more awa~e of the significance of the achievements
<br />of blacks in our community and throughout this country, and urges all
<br />citizens to mark this month by supporting and encouraging the efforts
<br />of all interested groups and organizations.
<br />
<br /> Mr. Roger Wiley, City Attorney, explained that the resolution
<br />
<br />was now required by the Highway Department.
<br />
<br />The reso'lution "Assurances to Commonwealth Regarding~Highway
<br />Utility Permits" was moved by Mr. Conover, .seconded by Dr. Hall and
<br />
<br />unanimously approved by Council.
<br />
<br /> WHEREAS, it becomes necessary from time to time for the
<br />City of Charlottesville to obtain permits from the Virginia
<br />Department of Highways and Transportation (VDH&T) to install,
<br />construct, reconstruct, maintain, and operate certain utility
<br />facilities along, across, over and upon the highway system of
<br />Virginia; and
<br />
<br /> WHEREAS, expense, damage or injury may be sustained by the
<br />Commonwealth of Virginia growing out of the granting to the City
<br />by VDH&T of these permits for the work aforesai, d; and
<br /> WHEREAS, one of the conditions of these permits is that the
<br />City shall indemnify the Commonwealth of Virginia against all
<br />damages and injuries to the.~highways and bridges and to persons
<br />or property lawfully upon such highways, resulting from the
<br />installation, maintenance or repair of such city utilities;
<br /> NOW, THEREFORE, Be it Resolved by the Council of the City
<br /> of Charlottesville, Virginia that the City agrees in all respects
<br /> to comply with all of the conditions of utility permits that have
<br />
