RESOLUTION:
<br />AUTHORIZING
<br />CITY MANAGER
<br />TO SIGN
<br />GRANT APPLI-
<br />CATIONS FOR
<br />TRANSIT SYSTEM
<br />
<br /> WHEREAS, the Authority, on February 21, 1984, adopted a resolution
<br />agreeing to assist the Company in financing the Project and approving
<br />a. plan of financing for the Project and the issuance of the Bonds,
<br />subject to the terms to be agreed upon, and has recommended, that the
<br />Council approve the issuance of the Bonds; and
<br />
<br /> WHEREAS, a copy of the Authority's resolution, a certificate of
<br />the public hearing and a Fiscal Impact Statement have been filed with
<br />the Council; and
<br />
<br /> WHEREAS, preliminary plans fo'r the Project and the financing have
<br />been described to the Council in a presentation by representatives of
<br />the Company;
<br />
<br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE
<br />VIRGINIA: ,
<br />
<br /> 1. It is hereby found and determined that the Project will be in
<br />the public interest~ and will promote the safety, health, welfare,
<br />convenience or prosperity of the City of Charlottesville Virginia and
<br />its citizens. ' , ,
<br />
<br /> 2. The Council hereby approves the location and a plan of financing
<br />for the Project.
<br />
<br /> 3. It is hereby found and determined that the Projects meets the
<br /> criteria set forth in Section S of the Ordinance.
<br />
<br /> 4.. The Council'approves the issuance of the Bonds b.y the Authority
<br /> for the benefit of .the Company, as required by Section '103(k) and
<br /> Section 1S.1-1378.1 of the Virginia Code, to permit the Authority to
<br /> assist in the financing of the Project.
<br />
<br /> 5. The approval of the issuance of the Bonds does not constitute
<br />an endorsement to a prospective purchaser of the Bonds of the credit-
<br />worthiness of the Project or the Company.
<br />
<br /> 6. This Resolution shall take effect immediately upon its adoption.
<br />
<br /> Mr. Hendrix stated that the two resolutions authorizing the City Manager
<br />to sign grants for the Transit System were standard resolutions required by
<br />the Virginia Department of Highways and Transportation before the City can
<br />receive the funds.

<br /> Mrs. Gleason moved the two resolutions, Dr. Gunter seconded the motion,
<br />
<br />and the resolutions were unanimously approved by Council.
<br />
<br />(1) Be It Resolved by the CounCil of the City of Charlottesville, Virginia,
<br />that the City Manager is authorized, for and on behalf of the City, to
<br />execute and file-an application to the Virginia Department of'Highways and
<br />Transportation, Commonwealth of Virginia (VDH&T), for a grant of transportation
<br />special revenues under Chapter 684, Item 644 of the 1982 Acts of the General
<br />Assembly as amended ("The 1982 Appropriations Act"); in the amount of $32,420.00
<br />for fiscal year commencing July 1, 1984, to defray the public transportation
<br />Administrative expenses of the City of Charloytesville; to accept from VDH&T
<br />grants in such amounts as may be awarded; to execute the necessary grant
<br />agreements; and to authorize the Transit Manager to furnish to VDH&T such
<br />documents and other information as may be required for processing the grant
<br />request.

<br /> In connection with such grant application the Council certifies that the
<br /> funds will be used in accordance with the requirements of the 1982 Appropriations
<br /> Act, as amended, and only for the purposes specified therein; that the City
<br /> will provide matching funds in the 50% State and 50% City ratio as required
<br /> in the Act; that.the record of receipts and expenditures of funds granted
<br /> the City as authorized in the Act may be Subject to audit by VDH&T and by
<br /> the State Auditor of Public Accounts.

<br />(2) B~ It Resolved by the Council of the City of Charlottesville, Virginia,
<br />that the City Manager is authorized, for and on behalf of the City, to
<br />execute and file an application to the Vi.rginia Department of Highways and
<br />Transportation, Commonwealth of Virginia (VDH&T), for a grant of transportation
<br />special revenues under Chapter 684, Item 644 of the 1982 Acts of the General
<br />Assembly as amended ("The 1982 Appropriations Act"); in the amount of
<br />$319,077.00 for fiscal year. commencing July 1, 1984, to defray the public
<br />transportation fuels, lubricants, tires, and maintenance parts and supplies
<br />expenses of the City of Charlottesville; to accept.from VDH&T grants in
<br />such amount as may be awarded; to. execute the necessary grant agreements; and
<br />to authorize the Transit Manager to furnish to VDH&T such documents and other
<br />information as may be required for processing the grant request
<br />
<br /> In connection with such grant application the'Council certifies that the
