ORDINANCE: <br />AMENDING ORDINANCE <br />RELATING TO <br />MEMBERSHIP <br />QUALIFICATIONS <br />OF BOARD OF <br />ARCHITECTURAL <br />REVIEW <br /> (2nd reading) <br /> <br />APPOINTMENTS: <br />BOARDS AND <br />COMMISSIONS <br /> <br />ORDINANCE: <br />ADJUSTMENT OF <br />SPEED LIMIT ON <br />250 BYPASS <br /> <br />ORDINANCE: <br />AMENDING <br />CURFEW <br />ORDINANCE <br /> <br />PUBLIC <br /> <br />OTHER BUSINESS <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 31-131, AS AMENDED, OF THE CODE OF THE CITY OF CHARLOTTE.S- <br />VILLE, 1976, RELATING TO THE MEMBERSHIP AND QUALIFICATIONS OF THE <br />BOARD OF ARCHITECTURAL REVIEW" which was offered at the meeting <br />of February 21st, was approved by the following vote. Ayes: Mr. <br />Buck, Mr. Conover, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes'.: <br />None. <br /> On motion by Mr. Conover, Mr. Larry Herbert 'was unanimously <br /> appointed to serve a four year-term on the Board of Architectural <br /> Review. This term shall be effective immediately and expire on <br /> January 1., 1988. <br /> Mr. Hendrix stated that this amendment would better define <br /> where speed limits change on the 230 Bypass. <br /> Mrs. Gleason requested that staff do a review of the portion <br /> <br /> of the 230 Bypass from the western City limit to Mclntire Park. <br /> Mr. Conover moved the ordinance entitled "AN ORDINANCE TO <br /> <br /> AMEND AND REORDAIN SECTION 16-9 OF THE CODE OF THE CITY OF <br /> CHARLOTTESVILLE, 1976, TO CLARIFY DESCRIPTION OF MclNTIRE PARK <br /> ENTRANCE ON THE ROUTE 250 BY-PASS," Mrs. Gleason seconded the <br /> motion and the ordinance was carried over to the next meeting for <br /> consideration. <br /> Mr. Wiley, City Attorney, stated that he had spoken with the <br /> juvenile officers in the Police Department and th~ Juvenile Court <br /> judge concerning the ordinance. Mr. Wiley said that the change <br /> would prohibit youths under 18 years of age from being on foot <br /> between 1:00 a.m. and 5:00 a.m. as well as being in a car without <br /> being accompanied by an adult. <br /> Mr. Buck questioned the wisdom of having a law on the books <br /> which is either never enforced or selectively enforced.. <br /> Mr. Wiley responded that the ordinance is enforced by returning <br /> youths to their homes, not by prosecution, and acts as a tool for <br /> the police. <br /> Mrs. Gleason stated that she felt that this was a protective <br /> ordinance which served a positive function. <br /> Mr. Buck stated that he was sympathetic to citizens Who had <br /> experienced trouble with vandals, but felt that was a separate <br /> violation for which persons should be arrested. <br /> Dr. Hall moved to repeal Section 17(a) of the ordinance. The <br /> motion died for lack of a second. <br /> Council requested that the Chief of Police and Commonwealth's <br /> Attorneys be asked for a report on the actual application and <br /> practical effect of such an ordinance. In addition, Mr. C0nover <br /> requested information on the circumstances under which the ~olice <br /> may ask for a person to identify themselves. <br /> There were no matters by the public. <br /> Mr. Wiley presented a resolution authorizing the Mayor to sign <br /> documents associated with the refinancing of a rehabilitation loan <br /> in the Starr Hill area at 633 W. Main Street. Mr. Wiley added that <br /> the Starr Hill Loan Committee had approved the refinancing. <br /> <br /> <br />
