RESOLUTION: <br />GRANTING SPECIAL <br />PERMIT TO WCHV/ <br />W~V RADIO TO <br />ERECT RADIO <br />TRANSMISSION <br />TOWER <br /> <br />Mr. Huja gave the.foll]:0~ng reasons for the Planning Commission's <br /> <br />recommendation to approve the special permit: 1) It is in harmony ~ith <br /> <br />the Comprehensive Plan and the Land Use Plan, 2) It will not have a <br /> <br />significant adverse impact on the surrounding neighborhood, 3) The <br /> <br />proposed development adequately provides for the additional occupants <br /> <br />in terms of off-street parking and suitably designed units and meets <br /> <br />the National Building Code suggested standard of 200 gross square feet <br /> <br />per occupant/floor. <br /> <br />Mr. Buck stated that he did not want the granting of the special <br /> <br />permit to be considered a precedent for future projects and felt that <br /> <br />the builders had shown a hardship would exist in their case. <br /> <br />Mrs. Gleason and Mr. Barnes agreed that a hardship existed and that <br /> <br />was the reason for granting the special permit. <br /> <br />On motion by Mr. Barnes, seconded by Mrs. Gleason, the soecial <br /> <br />permit for increased density at 1910-1916 Jefferson Park Avenue was <br /> <br />unanimously approved by Council. <br /> <br /> WHEREAS, application has been-made for a special use permit to <br />allow for occupancy by up to 6 unrelated persons per unit in 23 proposed <br />3-bedr°om apartment units at 1910-1916 Jefferson Park Avenue under <br />Section 31z28(k) of the Code of the City of Charlottesville, as amended; <br />and <br /> <br /> WHEREAS, the site plan for the proposed apart.merits was approved, <br />but improvements had not yet been made, prior to the adoption of <br />Section 31-28(k); and <br /> <br /> WHEREAS, following a joint public hearing before this Council and <br />the Planning Commission, duly advertised and held on September 11, 1984, <br />this Council finds that such units will conform to the standards set <br />forth in Section 31-28(k) and to the criteria applicable to special <br />permits generally under Chapter 31 of the City Code; now, therefore, <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, <br />Virginia that a specia,1 use permit is granted pursuant to City Code <br />Section 31-28, as amended, to allow occupancy by up to 6 unrelated <br />persons per unit in the 23 proposed 3~bedroom apartment units on the <br />property at 1910-1916 Jefferson Park Avenue, designated as Parcels 96, <br />97, 98 and 99 on City Real Property Tax Map 16. <br /> <br />Mr. Huja stated that the 30 foot tower would allow the radio station <br /> <br />to remove the-. three taller towers. Mr. Huja presented the following <br /> <br />reasons for the Planning Commission's recommendation to approve the <br /> <br />special permit: 1) It is not contrary to the Comprehensive Plan, 2)It <br /> <br />will not have a significant adverse impact on the surrounding neighborhood, <br /> <br />3) It will enable the removal of three nonconforming t.owers in a R-I zone. <br /> <br />This approval is conditioned upon the following: 1) Administrative approval <br /> <br />of the site plan as-corrected, 2) That the removal of the three 200' towers <br /> <br />take place within six months of final approval to transmit from the new <br /> <br />towers in the County, and 3) The tower shall have an unobstructed yard on <br /> <br />all sides equal to the height of the tower except for the side toward WCHV/ <br /> <br />WWWV buildings. <br /> <br />On motion by Mrs. Gleason, seconded by Dr. Hall, the special permit <br /> <br />for the radio transmission tower was unanimously approved by Council. <br /> <br /> WHEREAS, Clay Media, Inc. has applied for a special permit to erect <br />a ?O-foot radio transmission tower adjacent to its radio broadcasting <br />studios at 1140 Rose Hill Drive; and <br /> <br /> WHEREAS, such appIication has been duly advertised as provided by <br />the law and has been the subject of a public hearing jointly held by <br />this Council and the City Planning Commission on October 9, 1984; and <br /> <br /> WHEREAS, the City Planning Commission has recommended the approval <br />of such special permit; an'd <br /> <br />4:'33 <br /> <br /> <br />
