440' <br /> <br />ORDINANCE: <br />LOCATION OF CITY <br />UTILITY LINES <br /> <br />ORDINANCE: <br />REZONING PROPERTY <br />BETWEEN L~NKFORD <br />AND CHERRY AVENUE <br />(BURNER NURSERY <br />PROPERTY) FROM <br />R-3 TO B-2 <br /> <br />under Chapter 31 Of the City Code; now, therefore <br /> <br /> BE iT RESOLVED by the Council of the~Ci.ty of CharlOttesville, <br />Virginia that a special use permit is granted pursuant to City <br />Code Section 31-28, as amended, to allow occupancy by nb to 6 <br />unrelated persons per unit in the nine 4 bedroom apartment units <br />on the property at 1900 Jefferson Park Avenue, designated as <br />Parcels 101, 101.1 and 101.2 on City Real Property Tax Map 16. <br /> <br /> Mr. Hendrix stated that this ordinance would give the <br /> <br />Director of Public Works the ability to grant a written waiver <br /> <br />for sewer,.gas or water mains. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 28-4 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 19765 <br />RELATING TO LOCATION OF CITY UTILITY LINES" was moved by Mrs. <br />Gleason, seconded by Dr. Gunter, and carried over to the next <br />meeting for consideration. <br /> <br /> Mr. Huja stated that the Planning Commission had recommended <br />reducing this zoning request from B-3 to B-2 and approval, less <br />a one-acre buffer strip, for the following reasons: 1) It would <br />provide for neighborhood commercial uses which will be supportive <br />of the residential area to the south and east, 2) It would provide <br />a buffer-etween the residential areas (.to the east and south) and <br />potential business areas, 3) It would not allow certain incompatible <br />uses, which are permitted by right in B-3, 4) The property ha~d <br />been used for commercial uses for over S0 years and the rezoning <br />as recommended, will allow uses legally, 5) The proposed development <br />plan will eliminate commercial access from Lankford Avenue, thus <br />minimizing traffic impacts on the neighborhood, and 6) This proposal <br />will allow for some additional housing in an area that may need <br />more housing in the future. <br /> <br /> Dr. Charles Hurt, developer of the proposed project, stated <br /> <br /> that he would be willing to landscape a buffer strip approximately <br /> 20 30 feet wide on the property facing 1st Street, but did not <br /> think it feasible to build housing on 'the one-acre site recommended <br /> by the Planning Commission. <br /> <br /> Mr. Chapman, representing Rev. Alvin EdWards, minister of the <br /> church to be located on ~the same site, stated that he thought the <br /> renters across the street from the proposed buffer strip' would be <br /> satisfied with the 20 - 30 foot strip. <br /> <br /> Dr. Hall stated that he did not think the neighborhood would <br /> <br /> be happy with additional high density housing on the~one acre and <br /> added that he was pleased with the proposed pl'an. <br /> <br /> The ordinance entitled "AN ORDINANCE AMENDING AND REENACTING <br /> <br /> THE DISTRICT MAP INCORPORATED IN. SECTION 31-4 OF THE ZONING ORDINANCE <br /> OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, BY THE REZONING OF <br /> PROPERTY LOCATED BETWEEN LANKFORD AVENUE AND CHERRY AVENUE (BURNET <br /> NURSERY PROPERTY)" was moved by Mr' Barnes, seconded by Dr. Hall, and <br /> carried over to the next meeting for consideration. <br /> <br /> Mr. Buck stated that he would like to see a restrictive agreement <br /> between the property owners and the Housing Authority, owners of the <br /> adjacent property, assuring that the landscaped buffer be maintained <br /> <br /> <br />
