RESOLUTION: <br />APPOINTING <br />VIEWERS TO <br />CONSIDER <br />CLOSING AN <br />ALLEY BETWEEN <br />FORREST AND <br />ALBEMARLE <br />STREETS <br /> <br /> Mr. Buck acknowledged that a few legal questions remained and asked <br />that the two neighborhoods try and meet to resolve their differences and <br /> <br />return to Council. <br /> <br /> On motion by Mrs. Gleas°n, seconded by Mr. Barnes, the resolution <br />appointing viewers to consider closing a portion of an alley between <br />Forres~ and Albemarle Streets was unanimously approved by Council.. <br /> <br /> WHEREAS, this CouncJ <br />of an alley, fifteen fee~ <br />Street between Dale Avem <br /> <br /> WHEREAS, it appears <br />1S.1-364 of the Code of <br />advertised; now, therefo~ <br /> <br /> BE IT RESOLVED by tn <br />Ms. Mary Jane Haynes, Me <br />in writing to Council wh <br />vacation. <br /> <br />RESOLUTION: Mr. Satyendra Huja, <br />GRANTING SPECIAL <br />PERMIT FOR the original request by ~t <br />INCREASED <br />DENSITY AT following the Planning Co <br />1900 JEFFERSON <br />PARK AVENUE <br /> <br />ha~s received a petition requesting vacation <br />wide, connecting forrest Street and Albemarle <br /> and' Ch~arlton Avenue; and <br /> <br />to Council that the notice~required by Section <br />'irginia (!950), as amended, has been duly <br />e <br /> <br />e Council of the City of charlottesville that <br />srs. W. J. Copeland and H. P. Winn, Jr. report <br />t inconvenience, if any, would result from such <br /> <br />Director of Community Development, stated that <br />he owners was for eight persons per uni~, but <br />m-mission's recommendation that the limit be <br /> <br />reduced to six, the~ owners had agreed. Mr. Huja stated that the Planning <br />Commission recommended approval for the following reason: It is in harmony <br />with the Land Use Plan of the Comprehensive Plan, provided that no more <br />than 24 cars be kept on the premises by the occupants of the nine unit <br /> <br />addition. <br /> <br /> Mrs. Gleason emphasized that t. he project had been built and partially <br />~occupied before the ordinance regarding the four person limit had gone <br /> <br /> into effect. <br /> <br /> Mr. William Smith, r~Presenting the owners of the property, stated <br />that cars would be stickered for parking, in the apartment lot and the <br /> <br />owner would have unstickered cars towed. <br /> <br /> Mr. ~Buck noted that <br />written to Council opposi <br />due to the increase of tr <br /> <br /> Mr. Barnes agreed th <br /> <br />~he Johnson Village Neighborhood Associati-on had <br /> <br />lg the granting of the special permit primarily <br />~ffic in the Shamrock Road area. <br /> <br />~t increased traffic would be a problem, but did <br /> <br />not think a parking restr!ction as recommended by the Planning Commission <br />was enforceable. <br /> <br /> Mr. Smith stated that many students live in the apartments because <br />they do not own cars and it is close to the University of Virginia and the <br />bus route. <br /> <br /> Mr. Buck stated he would support the special permit for six persons <br /> <br />per unit ~because it "fell between the cracks" of the old and new ordinances <br />and added that he hoped t~is would be the final request of this type. <br /> On motion by Dr. Hail,! seconded by Mrs. Gleason, the resolution <br />Granting Special Use Permit .To Allow for Occupancy by up to 6 Unrelated <br />Persons in Barrister Apartments at 1900 Jefferson Park Avenue was unanimously <br />approved by Council. <br /> <br /> WHEREAS, application has been made 'for a special use permit to allow <br />for occupancy by up to 6 unrelated persons per unit in the nine 4 bedroom <br />units of the Barrister Ap~rtments~a~ 1900 Jefferson park Avenue under <br />Section 31-28(k)of the COde of the~City of Charlottesville, as amended; and <br /> <br /> WHEREAS, the site plsn for Barrister Apartments was approved, but they <br />had not bee~ fully occupied., prior to the adoption of Section 31-28(k); and <br /> <br /> WHEREAS, following a joint public hearing before this Council-and the <br />Planning Commission, duly advertised and held on September Il, 1984, this <br />Council finds that such u~its will conform to the standards set forth in <br />Section 31-28(t) and to t~e criteria applicable to special permits generally <br />under Chapter 31 of the Ci~ Code <br /> <br />439 <br /> <br /> <br />
