RESOLUTION: <br />APPROVING REFUND <br />TO UNIVERSITY <br />BAPTIST CHURCH <br /> <br />ORDINANCE: <br />SPEED OF <br />TRAINS <br />(2nd reading) <br /> <br />ORDINANCE: <br />AMENDING <br />CHAPTER 4 <br />REGARDING <br />ANIMALS AND <br />FOWLS <br />(2nd reading) <br /> <br />ORDINANCE: <br />CLOSING A <br />PORTION OF <br />SADLER STREET <br /> <br />ORDINANCB: <br />BUDGET SCHBDULE <br /> <br />PUBLIC <br /> <br />OTHER BUSINESS <br /> <br />4'8 3 <br /> <br /> of the "Free" Bridge as a separate highway project, to be funded, designed <br /> and constructed by VDH&T on an expedited basis. <br /> <br /> 2. The City hereby agrees to pay its share~ of the costs of engineering, <br /> acquisition of right-of-way, and construction of the portion of such project <br /> within the Ci'ty limits, under the cost formula of 95% from VDH&T and S% <br /> from the City. <br /> <br /> 3. The City further agrees that if this project is established, and <br /> thereafter the City elects not to continue with the project to completion, <br /> the City will repay VDH&T 100% of the costs incurred by VDH&T for the City <br /> portion of the project up to the time the City notifies VDH&T of its desire <br /> to terminate the project. <br /> <br /> 4. The Council requests the Board of Supervisors of Albemarle County <br /> to adopt a resolution similarly requesting VDH&T action with regard to replace- <br /> ment of the County portion of the bridge. <br /> <br /> Mr. Wiley stated that taxes had been paid by University Baptist Church <br /> <br /> for the building occupied by Hearthstone Children's Home which was tax exempt <br /> and a refund was due. <br /> <br /> On motion by Dr. Hall, seconded by Mrs. Gleason, the resolution authorizing <br /> the refund to University Baptist Church was unanimously approved by Council. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN PORTIONS OF <br />CHAPTER 22 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, BY <br />REPEALING SECTION 22-1, REGARDING THE SPEED OF TRAINS, AND BY MAKING HOUSE- <br />KEEPING AMENDMENTS TO SECTIONS 22-7 AND 22-8," WHICH WAS OFFERED AT THE MEETING <br />OF FEBRUARY 4th, was approved by the following vote. Ayes: Mr. Buck, Mrs. <br />Gleason, Dr. Gunter, Dr.. Hall. Noes: Mr. Barnes. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN CHAPTER FOUR <br /> <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, TO ENACT A <br />LEASH LAW FOR DOGS, TO INCREASE CERTAIN DOG LICENSE TAXES, TO PROHIBIT THE <br />USE OF ANIMAL LEG-HOLD TRAPS, TO REQUIRE OWNERS TO PAY CERTAIN POUND FEES, TO <br />GIVE THE HEALTH D'ISTRICT DIRECTOR CERTAIN DISCRETION REGARDING CONFINEMENT OF <br />ANIMALS WHICH HAVE BITTEN PERSONS, TO ESTABLISH AND ADJUST VARIOUS PENALTIES <br />AND TO MAKE CERTAIN HOUSEKEEPING AMENDMENTS,'~ which was offered at the meeting <br />of February 4th, was approved by the following vote. Ayes: Mr. Barnes, Mr. <br />B~ck, Mrs. Gleason, Dr. Gunter, Dr. Hall. Noes: None. <br /> <br /> Mr. Wiley noted that the viewers did not report back favorably on the <br />request to close a portion of Sadler Street, and that two letters opposing <br />the closing had been received. <br /> <br /> Mr. Keith Woodard, petitioner for the street closing, requested that <br />Council defer action until he is able to meet with the persons opposed to <br />the closing. <br /> <br /> Mr. Werner Sensbach from the University of Virginia stated that closing <br />Sadler Street would eliminate access to University-owned property. <br /> <br /> Mr. Buck noted that past histories of street closings showed that <br /> <br />closings were only granted when there had been unanimous 'agreement by surround- <br />ing property owners. <br /> <br /> Action on the Sadler Street closing was deferred by consensus. <br /> <br /> The schedule for upcoming budget hearings and work sessions was discussed. <br /> <br />There were no matters by the public. <br /> <br /> Mr. Barnes requested that the City Attorney's office study the appropriate <br />standards for reviewing an appeal of the Planning Commission's actions. <br /> <br />Mr. Wiley replied that he would discuss the matter with staff and the <br /> <br /> Plan~ing Commission. <br />ng Was. adjourned. <br /> <br /> <br />
