500 <br /> <br />APPROPRIATION: <br /> <br />,$14.3,985 <br /> TSM PROJECTS <br /> UTILITY <br /> RELOCATIONS <br /> <br />RESOLUTION: <br />AUTHORIZING REAL <br />ESTATE TAX <br />REFUND <br /> <br />RESOLUTION: <br />GRANTING SPECIAL <br />PERMIT FOR KAPPA <br />ALPHA TO EXPAND/ <br />ENLARGE <br /> <br /> BE IT~RESOLVED by_the Council of the City of. Charlottesville, <br />Virginia, that the sum of $1,902.00 is hereby appropriated from <br />General Fund account 01-4219'0 (Shelter for Homeless Alcoholics <br />account) to Grant Fund account 11-12220 (FY 1983.Charter HQuse <br />account), for the purpose of covering~a shortfall of-State funds <br />which had been expected to be paid to the City. <br /> <br /> Mr. Hendrix stated that the appropriation was for utility <br /> <br />work to be done in conjunction with the Highway Department, and <br /> <br />the City would be reimbursed for 9S% of. the cost. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, the $43,98S <br />appropriation for the TSM Projects was offered and carried .over <br />to the next meeting for consideration. <br /> <br /> Mr. Hendrix explained that the real estate a. ssessment for the <br />hOuse at 1S18 Cherry Avenue.was based on it containing a finished <br />basement and because that was found to'be untrue, a refund was due. <br /> <br /> On motion by Mr. Barnes, seconded by Dr. Hall, the resolution <br />authorizing the refund of $12S.43 to James M. and Yoriko M. Beach <br />was unanimously approved by Council. <br /> <br /> Mr. Satyendra Huja, Director of Community Development, stated <br />that the Planning Commission recommended approval of the special <br />permit for the following reasons: 1) It is in harmony with the <br />Land Use Plan of the Comprehensive Plan, 2) It will not have a <br />significant adverse impact on the surrounding~area, and 3) The site <br />and buildings adequately accommodate the proposed occupants and <br />parking. Approval was conditioned on the following: 1) Administrative <br />approval of the site plan, 2)Provision of sidewalks has required along <br />Rugby Road, along with the increase of the curve radius at the corner, <br />and 3) Further conside.ration of provisions for handling storm water <br />runoff. <br /> <br /> Mr. Huja added that since the Planning Commission decision, it. <br />was found that pipe drainage and a retaining wall was not required, <br />and that the sidewalk costs would be shared by the City. <br /> <br /> On motion by Mrs. Gleason, seconded by Dr. Gunter, the special <br />permit to expand Kappa Alpha Fraternity at 600 Rugby Road was unani- <br />mously approved by Council. <br /> <br /> WHEREAS~ Kappa AlPha Renovation Association has submitted a <br />petition for a-special permit to expand the present fraternity <br />complex at 600 Rugby Road and Grady Avenue; and <br /> <br /> WHEREAS, following a joint public hearing before this Council <br /> and the Planning Commission, duly advertised and held on Mar'ch 12, <br /> 198S, this Councilfinds that such use will conform to'the standards <br /> set,forth in Section 31-32.1 of the City Code and to the criteria <br /> applicable, to special permit-s generally Under Chapter 31 of the <br /> City Code; now, therefore, -- <br /> <br /> BE IT RESOLVED by t'he Council of the City of Charlottesville, <br />Virginia that a special use..permit is granted pursuant to City Code <br />Section 3t-28, as amended, to enlarge Kappa Alpha Fraternity located <br />at 600 Rugby Road, identified on City Real Property ..Tax Map S as <br />Parcels 126 and 127, for a maximum of twenty-five residents. ~Such <br />enlargement shall be carried oUt in accordance with the site plan as <br />approved by the Director Of Planning. ~ <br /> <br /> Mr. Buck statedthat he.felt it made good financial and .safety <br /> sense to complete the remainder of the sidewalk~on Rugby Road. <br /> <br /> Mr. Hendrix recommended that Council authorize the completion <br /> <br /> of the sidewalk on Rugby Road. <br /> <br /> <br />
