Mr. Albro stated that he had serious reservations about whet~er <br /> a meeting of this sort should be held at this particular time. He <br /> stated he thinks Mrs. Wadlington raises some valid points and perhaps <br /> at some future time this meeting could be held. He stated that the <br /> Council is aware of the fact that there have been public remarks about <br /> possible litigation over what Council did with respect to approving <br /> the Queen Charlotte Project. He stated he has a strong feeling that <br /> Queen Charlotteand the reason why it was approved will be the main <br /> topic of conversation and having had some past experience he knows, <br /> that what Council members say about why they voted certain ways and <br /> what their concerns were can be very significant in litigation and he <br /> doesn't feel that this is something that should be done until the <br /> litigation resolves itself. '~- <br /> <br /> Mr. Wiley stated it obviously depends on what is discussed as <br /> <br /> to whether or not it will have some bearing on the litigation, but <br /> he shares Mr. Albro's concern that it could have some bearing on <br /> the litigation. He stated that based on reports and the press the <br /> board is declining to review any a~plications for anything in the <br /> historic district pending the outcome of this meeting and he doesn't <br /> think that is really an appropriate position for any board to take <br /> since they are obligated by law to consider cases which are brought <br /> before them and yet he thinks it is necessary and advisable for their <br /> <br /> roles to be clarified if they/are to feel able to proceed. He stated <br /> ? <br /> that perhaps if they have specific questions that they would like <br /> <br /> answered the Council might be able to deal with these and provide <br /> them with the answers in a way that was felt would not have a direct <br /> bearing on the outcome of the litigation. <br /> <br /> Mr. Gatewood asked if those questions could be answered in a <br /> letter from the Mayor and Mr. Wiley stated that was what he had in <br /> mind. <br /> <br /> Mrs. 0'Brien asked Mr. Albro if he would have the same problem <br /> <br /> if it were made clear that Queen Charlotte would not be discussed <br /> since she thinks it is very important that this meeting be held with <br /> the Board. <br /> <br /> Mr. Albro stated that unless there is some dire emergency for <br />this meeting he doesn't think anyone will be hurt by postponing it <br />until what is obviously the major issue is resolved and he does not <br />think it is fair to the review board to aay what concerns you can not <br />be discussed. <br /> <br /> Mrs. 0'Brien suggested that the Mayor be requested to advise <br /> <br />Mrs. Wadlington that the Council would like to meet with them in the <br />future, but they have some legal problems about doing so at this <br />point in time and they would appreciate if if the architectural review <br />board would~move ahead as they have done in the past and they will <br />meet with the board, as soon as it is deemed legally feasible. <br /> <br /> <br />
