<br /> RESOLVED by the Council of the City of Charlottesville,
<br />Virginia, that:
<br />
<br /> (1) That property located in a B-3 Business District on
<br />the west side of Cedars Court, immediately south of the Cedars
<br />Nursing Home, designated as Parcels 4.1, 4.2, 4.3 and a portion
<br />of Parcel 5.1, on City Real Property Tax Map 31, is hereby granted
<br />a special permit for use as a home for the elderly, or group home,
<br />for not more than 160 residents, as permitted under §§31,28 and
<br />31-92 of the City Code.
<br />
<br /> (2) The Council finds that such use conforms to the
<br />requirements for special permits generally imposed by Article
<br />XX (§31-218 et seq.) of Chapter 31 of the City Code, and this
<br />permit is subject to all conditions and restrictions imposed
<br />generally by such article.
<br />
<br /> (3) Such special permit shall be limited to that portion
<br />of the aforesaid property designated for such use on the site
<br />plan submitted with the special permit application, and shall
<br />further be conditioned upon development of the property in
<br />accordance with such site plan, as conditioned by the Planning
<br />Commission, and finally by the Director of Planning.

<br /> Mr. Mike McGinnis representing the JAYCEES addressed the Council
<br /> and requested that the proposed audit fee in the new bingo
<br /> ordinance be deleted or substantially reduced.
<br />
<br /> On motion by Mr. Albro, seconded by Mr. Gatewood the proposed
<br /> ordinance was amended to reflect an audit fee of 1% on receipts
<br /> over $2,000, up to a maximum of $25.00, by the following recorded
<br /> vote. Ayes: Mr. Albro, Mr. Brunton, Mr. Buck, Mr. Gatewood and
<br /> Mrs. O'Brien. Noes: None.

<br /> An ordinance entitled "AN ORDINANCE TO AMEND CHAPTER 17 OF THE
<br /> CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED BY ADDING
<br /> NEW SECTIONS NUMBERED 17-19.1 THROUGH 17-19.12 AND TO REPEAL
<br /> SECTION 17-19 RELATING TO LOTTERIES, RAFFLES AND BINGO GAMES,"
<br /> ~ich was offered at the meeting of the Council on June 4, 1979,
<br /> was adopted by the following recorded vote. Ayes: Mr. Albro,

<br /> Mr. Brunton, Mr. Buck, Mr. Gatewood and Mrs. O'Brien.. Noes: None.

<br /> and carried over to the next meeting for consideration.

<br /> AND 12-17 THEREOF; AND FURTheR TO AMEND SECTION 26-47 AND 28-3,
