Resolunion re: Authorizing the Mayor to szgn an amended agreement with ICMA Retirement Corp. Resolution re: Granting a~ special permit to Arby's Restaurant at 1230 Emmet St. 119 ~WHEREAS, the Ordinance adopted by the Council on July ~ 19, 1976, which created the Authority (the "Ordinance")~ provides that the Authority shall not finance any facility until the location and financ±ng of such facility have been approved by the Council; and WHEREAS, Section 5 of the Ordinance sets.forth certain standards ~to be considered by the Authority and the Council in determining the nature and location of facilities to be financed by the Authority; and WHEREAS, the Authority on August 30, 1979, adopted an inducement resolution agreeing to assist Rothwell Distributing Company in the financing of the acquisition, construction and equipping 'of a facility to be used principally for the warehousing and distribution of malt beverages to commercial customers and office facilities incidental thereto to be located in the City of Charlottesville, Virginia (the "Project") by the issuance of the Authority's industrial development revenue bonds in an amount estimated not to exceed $1,000,000; and WHEREAS, preliminary plans for the Project and the financing have been described to the Council in a presentation by representatives of Rothwell Distributing Company; and WHEREAS, the Project will be located on Parcel 4 of the Garrett Street Project, being that real estate bordering upon 2nd, Garrett and 4th Street and the Chesapeake and Ohio Railroad right- of-way in the City of Charlottesville, Virginia. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CHARLOTTESVILLE, VIRGINIA: 1. It is hereby found and determined that the acquisition, construction and equipping of the Project will be in the public interest and will promote the safety, health, welfare, convenience or prosperity of the City of Charlottesville Virginia, and its citizens. ' 2. The Council hereby approves the location and financing of the Project. 3. It is hereby found and determined that the Project meets the criteria set forth in Section 5 of the Ordinance. 4. This Resolution shall take effect immediately. The City Manager advised the Council that the ICMA Deferred Compensation Plan, paragraph nine has recently been slightly amended to allow under certain conditions that payments may be made to the employee by the employer in the event of some unforseeable emergency. On motion by Mrs. O'Brien, seconded by Mr. Albro the following resolution was unanimously adopted. BE IT RESOLVED by the Council of the City of Charlottes- ville, that the Mayor is hereby authorized to execute on behalf of the City the following document, in form approved by the City Attorney: Amended Deferred Compensation Plan Agreement with the ICMA Retirement Corporation, as amended March 23, 1979. A copy of such document shall be kept on file with the minutes of the Council meeting at which this resolution was adopted. A communication was presented from the Planning Commission recommending that the application for a special permit to use the property located at 1230 Emmet Street for a drive-in window in a B-2 zone be granted for the following reasons: 1. it is in harmony with the 1990 Land Use Plan; 2. given necessary improvements to the site plan it will not have a significant adverse impact on the surrounding neighborhood; and 3~ the aite was one of the sites made non-conforming by the 1976 reclassification of the B-2 zone and recommended for special permit then by the Planning Commission.
