Resolunion re: <br />Authorizing the Mayor <br />to szgn an amended <br />agreement with <br />ICMA Retirement <br />Corp. <br /> <br />Resolution re: <br />Granting a~ special <br />permit to Arby's <br />Restaurant at <br />1230 Emmet St. <br /> <br />119 <br /> <br /> ~WHEREAS, the Ordinance adopted by the Council on July ~ <br />19, 1976, which created the Authority (the "Ordinance")~ provides <br />that the Authority shall not finance any facility until the <br />location and financ±ng of such facility have been approved by <br />the Council; and <br /> <br /> WHEREAS, Section 5 of the Ordinance sets.forth certain <br />standards ~to be considered by the Authority and the Council in <br />determining the nature and location of facilities to be financed <br />by the Authority; and <br /> <br /> WHEREAS, the Authority on August 30, 1979, adopted an <br />inducement resolution agreeing to assist Rothwell Distributing <br />Company in the financing of the acquisition, construction and <br />equipping 'of a facility to be used principally for the warehousing <br />and distribution of malt beverages to commercial customers and <br />office facilities incidental thereto to be located in the City <br />of Charlottesville, Virginia (the "Project") by the issuance of <br />the Authority's industrial development revenue bonds in an amount <br />estimated not to exceed $1,000,000; and <br /> <br /> WHEREAS, preliminary plans for the Project and the financing <br />have been described to the Council in a presentation by representatives <br />of Rothwell Distributing Company; and <br /> <br /> WHEREAS, the Project will be located on Parcel 4 of the <br />Garrett Street Project, being that real estate bordering upon 2nd, <br />Garrett and 4th Street and the Chesapeake and Ohio Railroad right- <br />of-way in the City of Charlottesville, Virginia. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF CHARLOTTESVILLE, VIRGINIA: <br /> <br /> 1. It is hereby found and determined that the acquisition, <br />construction and equipping of the Project will be in the public <br />interest and will promote the safety, health, welfare, convenience <br />or prosperity of the City of Charlottesville Virginia, and its <br />citizens. ' <br /> <br /> 2. The Council hereby approves the location and financing <br />of the Project. <br /> <br /> 3. It is hereby found and determined that the Project <br />meets the criteria set forth in Section 5 of the Ordinance. <br /> <br /> 4. This Resolution shall take effect immediately. <br /> <br /> The City Manager advised the Council that the ICMA Deferred <br />Compensation Plan, paragraph nine has recently been slightly <br />amended to allow under certain conditions that payments may be made <br />to the employee by the employer in the event of some unforseeable <br />emergency. <br /> <br /> On motion by Mrs. O'Brien, seconded by Mr. Albro the following <br />resolution was unanimously adopted. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottes- <br />ville, that the Mayor is hereby authorized to execute on behalf of <br />the City the following document, in form approved by the City <br />Attorney: <br /> <br /> Amended Deferred Compensation Plan Agreement with the <br /> ICMA Retirement Corporation, as amended March 23, 1979. <br /> <br /> A copy of such document shall be kept on file with the <br /> minutes of the Council meeting at which this resolution was adopted. <br /> <br /> A communication was presented from the Planning Commission <br /> recommending that the application for a special permit to use the <br /> property located at 1230 Emmet Street for a drive-in window in a <br /> <br />B-2 zone be granted for the following reasons: 1. it is in harmony <br />with the 1990 Land Use Plan; 2. given necessary improvements to the <br />site plan it will not have a significant adverse impact on the <br />surrounding neighborhood; and 3~ the aite was one of the sites <br />made non-conforming by the 1976 reclassification of the B-2 zone <br />and recommended for special permit then by the Planning Commission. <br /> <br /> <br />
