186 <br /> <br />Consideration re: <br />Ordinance - Fees for <br />Mechanical & Plumbing <br />.Permits <br /> <br />Consideration re: <br />Ordinance - Amending <br />and reordaining the <br />ordinance closing, <br />vacating and <br />discontinuing a <br />portion of unopened <br />Henry Avenue <br /> <br />Executive Session <br /> <br />Clerk <br /> <br /> Mrs. O'Brien stated the next Council may decide it does not want <br /> <br />to be the Housing Authority and she would like to look out for the <br />interest of the Authority and perhaps the City could assume responsibility <br />for the stream as it runs through Authority property, since it could <br />be a problem for the Authority ~given where it gets its funds. Mrs. <br />O'Brien asked if there were some way the street could be vacated and <br />have the City assume maintenance of the creek for the Authority. <br /> <br /> Mr. Wiley stated that could be worked out by agreement between <br /> <br />the City and the Authority. <br /> <br /> The City Attorney was requested to prepare an agreement between <br /> <br />the City and the Housing Authority for the future maintenance of the <br />creek. <br /> <br /> An ordinance entitled "AN ORDINANCE CLOSING~ VACATING AND <br />DISCONTINUING A PORTION OF UNOPENED WARE STREET IN THE CITY OF <br />CHARLOTTESVILLE," was offered by Mr. Alhro, seconded by Firs. O'Brien <br />and carried over to the next meeting for consideration. <br /> <br /> An ordinance entitled uAN ORDINANCE TO AMEND AND REORDAIN <br /> SECTIONS 5-~9 AND 5~25 OF THE CODE OF THE CITY OF C~LARLOTTESVILLE, <br /> 1976, AS AMENDED, RELATING TO THE FEES FOR MECHANICAL ~ND pLUM~ING <br /> PERMITS," which was offered at the meeting of the Council on <br /> November 19, 1979, was adopted by the following recorded vote. Ayes: <br /> Mr. Albro, Mr. Br.unton, Mr. Buck, Mr. Gat.ewood and Mrs. O'Brien. <br /> Noes: None. <br /> <br /> The City Attorney advised the Council that earlier this year an <br /> ordinance was adopted closing and vacating a portion of Henry Avenue <br /> south of Harris Street. He stated that ordinance described the <br /> vacation by reference to the Southern Railway tracks and said it <br /> would be vacated for a distance of 105 feet north of those tracks. <br /> He stated that~the problem was the tracks intersect the former streets~ <br /> right-of-way at lessi~than a 90° angle, thus creating a c=ooked line <br /> that does not match up with the property line beside the tracks and <br /> the purpose of the proposed ordinance is to adjust that line and <br /> pick up the small sliver of land. <br /> <br /> An ordinance entitled "AN ORDINANCE TO AMEND AND REORDAINING <br /> <br /> THE ORDINANCE CLOSING, VACATING~AND DISCONTINUING A PORTION OF UNOPENED <br /> HENRY AVENUE IN THE CITY OF CHARLOTTESVILLE," was offered by Mr. Buck, <br /> seconded by Mr. Albro and carried over to the next meeting for <br /> consideration. <br /> A motion by Mrs. O'Brien, seconded by Mr. Gatewood that Council <br /> meet in executive session to discuss matters exempted by Section <br /> 2.1A344(a)(1) and 2.1-344(a)(6) of the Virginia Freedom of Information <br /> Act, was adopted by the following recorded vote. Ayes: l~r. Albro, <br /> Mr. Brunton, Mr. Buck, Mr. Gatewood and Mrs. O'Brien. Noes: None. <br /> On motion the meeting adjourned. <br /> <br /> President <br /> <br /> <br />
