Resolution re: <br />Authorizing the Mayor <br />to execute a deed <br />for the sale of City <br />property <br /> <br />Resolution - <br />Appointing Viewers - <br />Garrett Street <br /> <br />2.85 <br /> <br /> WHEREAS, the Council of the City of Charlottesville, <br />Virginia (the "Council"), has created the Industrial Development <br />Authority of the City of Charlottesville, Virginia (the "Authorityi'), <br />pursuant to tke Virginia Industrial Development and Revenue Bond Act <br />to fulfill the purposes of such Act; and <br /> <br /> WHEREAS, the Ordinance adopted by the Council on July 19, <br />1976, which created the Authority (the "OrdinanceS,), provides that <br />the Authority shall not finance any facility until the location and <br />financing of such facility have been approved by the Council; <br /> <br /> WHEREAS, Section 5 of the Ordinance sets forth certain <br />standards to be considered by the Authority and the Council in <br />determining the nature and location of facilities to be financed by <br />the AuthOrity; and <br /> <br /> WHEREAS, the Authority on September 19, 1979, adopted an <br />inducement resolution agreeing to assist The Kroger Co. zn the <br />financing of the acquisition, construction and equipping of a facility <br />to be used for the retail sale of products of agriculture, <br />pharmaceutical products and general merchandise to be located in <br />the City of Charlottesville, Virginia (the UProject") by the issuance <br />of the Authority's industrial development revenue bonds in an amounn <br />estimated not be exceed $3,000,000; and <br /> <br /> WHEREAS, preliminary plans for the Project and the financing <br />have been described to the Council in a presentation by a representative <br />of~The Kroger Co.; and <br /> <br /> WHEREAS, the Project will be located at the intersection of <br />Hydraulic Road and U. S. Route 29 in the City of Charlottesville <br />Virginia. ' <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF CHARLOTTESVILLE, VIRGINIA: <br /> <br /> 1. It is hereby found and determined that the acquisition, <br />construction and equipping of the Project will be in the public <br />interest and will promote the safety, health, welfare, convenience or <br />prosperity of the City of Charlottesville, Virginia, and its citizens. <br /> <br /> 2. The Council hereby approves the location and financing <br />of the Project. <br /> <br /> 3. It is hereby found and determined that the Project meets <br />the criteria set forth in Section 5 of the Ordinance. <br /> <br /> 4. This Resolution shall take effect immediately. <br /> <br /> On motion by Mrs. O'Brien, seconded by Mr. ~lbro the following <br />resolut~on~.was unanimously adopted. <br /> <br /> A RESOLUTION appointing viewers to consider a request for the <br />vacation of a small portion of Garrett Street. <br /> <br /> WHEREAS, this Council has received a petition requesting <br />vacation of a small portion of Garrett Street; and <br /> <br /> WHEREAS, it appears to Council that the notices required by <br />815.1-364 of the Code of Virginia (1950), as amended have been duly <br />posted; ' <br /> <br /> NOW, THEREFORE~ BE IT RESOLVED by the Council of the City <br />of Charlottesville that Messrs. Mason S. Byrd, W. J. Copeland and H. P. <br />Winn report in writing to Council what inconvenience, if any, would <br />result fmom such vacation. <br /> <br /> The City Manager advised the Council that the City has been <br />requested to close a portion of unopened Ware Street, south of Cherry <br />Avenue to Rohinson Place. He stated this street abuts the First Street <br />Housing project. He stated the Housing Authority has raised a number <br />of issues regarding the closing of this street, since they will be <br />required to maintain a portion of the stream on this property. <br /> <br /> Mrs. O'Brien remarked that the Housing Authority has very little <br />money to maintain streams. <br /> <br /> Mr. Wiley stated that he assumed that if the Housing Authority <br />were going to do something to the branch it would have to come to tme <br />City CounCil for the money as long as the two bodies are composed of the <br />same people that shouldn't be too.b~g a problem. The City Attorney <br />also pointed out the stream has been on City property for a number of <br /> <br />years. <br /> <br /> <br />
